Resolução da Assembleia da República n.º 86/2020
Sumário: Aprova o Acordo sobre Transporte Aéreo entre a República Portuguesa e o Reino
dos Países Baixos, relativamente a Curaçao, assinado em Lisboa, em 25 de junho de
2019.
Aprova o Acordo sobre Transporte Aéreo entre a República Portuguesa e o Reino dos Países Baixos,
relativamente a Curaçao, assinado em Lisboa, em 25 de junho de 2019
A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do ar-
tigo 166.º da Constituição, aprovar o Acordo sobre Transporte Aéreo entre a República Portuguesa
e o Reino dos Países Baixos, relativamente a Curaçao, assinado em Lisboa, em 25 de junho de
2019, cujo texto, nas versões autenticadas nas línguas portuguesa, holandesa e inglesa, se publica
em anexo.

ACORDO SOBRE TRANSPORTE AÉREO ENTRE A REPÚBLICA PORTUGUESA E O REINO
DOS PAÍSES BAIXOS, RELATIVAMENTE A CURAÇAO
A República Portuguesa e o Reino dos Países Baixos, relativamente a Curaçao (doravante
designadas «as Partes»):
Sendo Partes da Convenção sobre Aviação Civil Internacional, aberta à assinatura em Chicago,
a 7 de dezembro de 1944;
Desejando organizar, de forma segura e ordenada, serviços aéreos internacionais e a promover,
o mais amplamente possível, a cooperação internacional no âmbito de tais serviços; e
Desejando concluir um acordo para fomentar o desenvolvimento de serviços aéreos regulares
entre e para além dos seus territórios:
acordam o seguinte:
Artigo 1.º
Definições
Para efeitos deste Acordo, entende-se por:
a) «Convenção» a Convenção sobre Aviação Civil Internacional, aberta à assinatura em Chicago,
a 7 de dezembro de 1944, incluindo qualquer anexo adotado ao abrigo do artigo 90.º da referida
Convenção e qualquer emenda aos anexos ou à Convenção, ao abrigo dos seus artigos 90.º e 94.º,
na medida em que esses anexos e emendas tenham sido adotados por ambas as Partes;
b) «Tratados UE» o Tratado da União Europeia e o Tratado sobre o Funcionamento da União
Europeia;
c) «Autoridades aeronáuticas», no caso da República Portuguesa, a Autoridade Nacional de
Aviação Civil; no caso do Reino dos Países Baixos, relativamente a Curaçao, o ministro responsável
pela aviação civil; ou, em ambos os casos, qualquer pessoa ou organismo autorizado a desempenhar
as funções atualmente exercidas pelas referidas autoridades, ou funções semelhantes;
d) «Empresa de transporte aéreo designada» qualquer empresa de transporte aéreo designada
e autorizada em conformidade com o artigo 3.º deste Acordo;
e) «Território» o significado que é atribuído no artigo 2.º da Convenção;

f) «Serviço aéreo», «serviço aéreo internacional», «empresa de transporte aéreo» e «escala
para fins não comerciais» o significado que é atribuído no artigo 96.º da Convenção;
g) «Tarifa» os preços a pagar pelo transporte de passageiros, bagagem e carga, bem como
as condições que regem a aplicação desses preços, incluindo os preços e as condições referentes
aos serviços de agência e outros serviços auxiliares, mas excluindo remuneração ou condições
para o transporte de correio; e
h) «Anexo» o quadro de rotas apenso a este Acordo, bem como quaisquer cláusulas ou notas
que constem desse anexo.
Artigo 2.º
Direitos de tráfego
1 — Cada Parte concede à outra Parte os seguintes direitos relativamente aos serviços aéreos
internacionais explorados pelas empresas de transporte aéreo designadas da outra Parte:
a) O direito de sobrevoar o seu território sem aterrar; e
b) O direito de fazer escalas no seu território, para fins não comerciais.
2 — Cada Parte concede à outra Parte os direitos especificados neste Acordo para efeitos de
exploração de serviços aéreos internacionais regulares nas rotas especificadas na secção apro-
priada do quadro de rotas, anexo a este Acordo. Tais serviços e rotas são doravante designados,
respetivamente, «os serviços acordados» e «as rotas especificadas». Na exploração de um serviço
acordado numa rota especificada, as empresas de transporte aéreo designadas por cada Parte
deverão gozar, para além dos direitos especificados no n.º 1 deste artigo, e em conformidade com
o disposto neste Acordo, do direito de aterrar no território da outra Parte, nos pontos especificados
para essa rota no quadro de rotas deste Acordo, com o objetivo de proceder ao embarque e de-
sembarque de passageiros, bagagem, carga e correio.
3 — Nada do disposto no n.º 2 deste artigo será interpretado como conferindo às empresas
de transporte aéreo designadas de uma Parte o direito de proceder, no território da outra Parte, ao
embarque de tráfego transportado mediante remuneração ou em regime de fretamento e destinado
a outro ponto no território dessa Parte.
4 — Se, por motivo de conflito armado, perturbações de ordem política, ou circunstâncias es-
peciais e extraordinárias, as empresas de transporte aéreo designadas de uma Parte não puderem
explorar serviços aéreos nas suas rotas normais, a outra Parte esforçar-se-á por facilitar a conti-
nuidade desse serviço através de adequados reajustamentos de tais rotas, incluindo a concessão
de direitos, pelo período de tempo que for necessário, para facilitar a viabilidade das operações.
O disposto neste número será aplicado sem discriminação entre as empresas de transporte aéreo
designadas das Partes.
Artigo 3.º
Designação e autorização de exploração das empresas de transporte aéreo
1 — Cada Parte tem o direito de designar, por escrito, empresas de transporte aéreo com o
propósito de explorar os serviços acordados nas rotas especificadas no anexo, bem como o direito
de retirar ou alterar tais designações. Essas designações serão efetuadas por escrito e transmitidas
à outra Parte, por via diplomática.
2 — Aquando da receção da notificação da designação, bem como da apresentação dos pro-
gramas de uma empresa de transporte aéreo designada, na forma e de acordo com as modalidades
estabelecidas para as autorizações de exploração e permissões técnicas, a outra Parte, no prazo pro-
cedimental mínimo, concederá as autorizações de exploração e permissões apropriadas, desde que:
a) No caso de uma empresa de transporte aéreo designada pela República Portuguesa:
i) A empresa de transporte aéreo se encontre estabelecida no território da República Portuguesa,
nos termos dos Tratados UE e seja titular de uma licença de exploração válida em conformidade
com o Direito da União Europeia; e

ii) O controlo efetivo de regulação da empresa de transporte aéreo seja exercido e mantido
pelo Estado-Membro da UE responsável pela emissão do seu certificado de operador aéreo e a
autoridade aeronáutica competente esteja claramente identificada na designação; e
iii) A empresa de transporte aéreo seja detida, diretamente ou através de participação maio-
ritária, e seja efetivamente controlada pelos Estados-Membros da UE ou da Associação Europeia
de Livre Comércio e/ou por nacionais desses Estados;
b) No caso de uma empresa de transporte aéreo designada por Curaçao:
i) A empresa de transporte aéreo se encontre estabelecida no território de Curaçao e seja titular
de uma licença de exploração válida em conformidade com o Direito aplicável; e
ii) O controlo efetivo de regulação da empresa de transporte aéreo seja exercido e mantido por
Curaçao e Curaçao seja responsável pela emissão do certificado de operador aéreo e a autoridade
aeronáutica competente esteja claramente identificada na designação; e
iii) A empresa de transporte aéreo seja detida, diretamente ou através de participação maiori-
tária, e seja efetivamente controlada por Curaçao e/ou pelos seus nacionais;
c) A empresa de transporte aéreo designada preencha as condições estabelecidas na legis-
lação nacional que a Parte que aprecia a ou as candidaturas aplica normalmente à exploração de
serviços aéreos internacionais.
Artigo 4.º
Recusa, revogação, suspensão ou limitação de direitos
1 — Quanto aos direitos especificados no artigo 2.º deste Acordo, cada Parte tem o direito de
recusar, revogar, suspender ou limitar as autorizações de exploração ou permissões técnicas de
uma empresa de transporte aéreo designada pela outra Parte, ou de sujeitar o exercício desses
direitos às condições consideradas necessárias, quando:
a) No caso de uma empresa de transporte aéreo designada pela República Portuguesa:
i) A empresa de transporte aéreo não se encontre estabelecida no território da República Por-
tuguesa nos termos dos Tratados UE ou não for titular de uma licença de exploração válida, em
conformidade com o Direito da União Europeia; ou
ii) O controlo efetivo de regulação da empresa designada não seja exercido ou mantido pelo
Estado-Membro da UE responsável pela emissão do certificado de operador aéreo, ou a autoridade
aeronáutica competente não esteja claramente identificada na designação; ou
iii) A empresa de transporte aéreo não seja detida, diretamente ou através de participação
maioritária, ou não seja efetivamente controlada por Estados-Membros da UE ou por Estados da
Associação Europeia de Livre Comércio e/ou por nacionais desses Estados;
b) No caso de uma empresa de transporte aéreo designada por Curaçao:
i) A empresa de transporte aéreo não se encontre estabelecida no território de Curaçao ou não
seja titular de uma licença de exploração válida em conformidade com o Direito aplicável; ou
ii) O controlo efetivo de regulação da empresa de transporte aéreo não seja exercido ou mantido
por Curaçao ou Curaçao não seja responsável pela emissão do certificado de operador aéreo e a
autoridade aeronáutica competente não esteja claramente identificada na designação; ou
iii) A empresa de transporte aéreo não seja detida, diretamente ou através de participação
maioritária, ou não seja efetivamente controlada por Curaçao e/ou pelos seus nacionais;
c) No caso de a empresa de transporte aéreo designada não satisfazer as condições estabele-
cidas na legislação que a Parte que aprecia a ou as candidaturas aplica normalmente à exploração
de serviços aéreos internacionais; ou

d) No caso de essa empresa de transporte aéreo designada não cumprir a legislação da Parte
que concede a autorização ou permissão; ou
e) No caso de a empresa de transporte aéreo designada não explorar os serviços acordados,
em conformidade com as condições previstas neste Acordo e no seu anexo.
2 — A menos que a imediata recusa, revogação, suspensão, limitação ou imposição das con-
dições referidas no n.º 1 deste artigo sejam essenciais para evitar novas infrações à legislação,
o direito de recusar, revogar, suspender, limitar ou impor condições apenas será exercido após a
realização de consultas com a outra Parte. As consultas realizar-se-ão no prazo de 30 dias a contar
da data da proposta para a sua realização, salvo acordo em contrário.
Artigo 5.º
Aplicação de legislação e procedimentos
1 — A legislação e os procedimentos de uma Parte relativos à entrada, permanência ou saída
do seu território de aeronaves utilizadas em serviços aéreos internacionais, ou relativos à operação
e navegação de tais aeronaves no seu território, aplicar-se-ão às aeronaves de ambas as Partes
à chegada, partida ou permanência no território da primeira Parte.
2 — A legislação e os procedimentos de uma Parte relativos à entrada, à permanência, ao
trânsito e à saída do seu território de passageiros, tripulação, bagagem, carga e correio transpor-
tados a bordo da aeronave, tais como a legislação relativa à entrada, ao despacho, à imigração,
a passaportes, às alfândegas e ao controlo sanitário, deverão ser cumpridos pela empresa de
transporte aéreo designada da outra Parte, ou em nome de tais passageiros, tripulação, ou dos
titulares da bagagem, carga e correio, tanto à chegada como à saída ou permanência no território
desta Parte.
Artigo 6.º
Isenção de direitos aduaneiros e outros encargos
1 — As aeronaves utilizadas em serviços aéreos internacionais pela empresa de transporte
aéreo designada de qualquer das Partes, bem como o seu equipamento normal, as peças sobressa-
lentes, as reservas de combustíveis e lubrificantes, outros consumíveis técnicos e provisões de bordo
(incluindo alimentos, bebidas e tabaco), que se encontrem a bordo de tais aeronaves, serão isentos
de direitos aduaneiros, taxas de inspeção e outros encargos semelhantes, à chegada ao território
da outra Parte, desde que esse equipamento, essas reservas e provisões permaneçam a bordo das
aeronaves até serem reexportados, ou utilizados na parte da viagem efetuada sobre esse território.
2 — Além desses, serão igualmente isentos dos mesmos direitos, taxas e impostos, com
exceção dos encargos relativos aos serviços prestados:
a) As provisões de bordo embarcadas no território de uma Parte, dentro dos limites fixados
pelas autoridades competentes dessa Parte, e para utilização nos voos de partida de aeronaves
utilizadas em serviços aéreos internacionais pelas empresas de transporte aéreo designadas da
outra Parte;
b) As peças sobressalentes e o equipamento normal de bordo trazidos para o território de uma
das Partes tendo em vista a manutenção ou reparação de aeronaves utilizadas em serviços aéreos
internacionais pelas empresas de transporte aéreo designadas da outra Parte;
c) Combustíveis, lubrificantes e outros consumíveis técnicos destinados ao abastecimento de
aeronaves em voos de partida, utilizadas em serviços aéreos internacionais pelas empresas de
transporte aéreo designadas da outra Parte, mesmo quando estes aprovisionamentos se destinem
a ser consumidos na parte da viagem efetuada sobre o território da Parte em que são embarcados.
3 — Todos os artigos referidos no n.º 2 deste artigo podem ter de ficar sob a supervisão ou
controlo aduaneiro.

4 — O equipamento normal de bordo bem como os artigos e aprovisionamentos existentes
a bordo das aeronaves das empresas de transporte aéreo designadas de qualquer das Partes
só podem ser descarregados no território da outra Parte mediante autorização das autoridades
aduaneiras dessa outra Parte. Nesses casos, podem ser colocados sob a supervisão das referidas
autoridades aduaneiras até serem reexportados ou lhes ser dado outro destino, de acordo com os
regulamentos aduaneiros.
5 — As isenções previstas neste artigo também deverão ser possíveis nos casos em que as
empresas de transporte aéreo designadas, de qualquer das Partes, tenham estabelecido acordos
com outra ou outras empresas de transporte aéreo para o empréstimo ou a transferência, no ter-
ritório da outra Parte, dos artigos especificados nos n.os 1 e 2 deste artigo, desde que essa outra
ou essas outras empresas de transporte aéreo também beneficiem das mesmas isenções junto
dessa outra Parte.
6 — Nada neste Acordo impede a República Portuguesa de aplicar, numa base não discrimi-
natória, impostos, taxas, direitos aduaneiros, custas ou encargos sobre o combustível fornecido
no seu território para utilização em aeronaves de uma empresa de transporte aéreo designada de
Curaçao e que opere entre um ponto situado no território da República Portuguesa e outro ponto
situado no território da República Portuguesa ou no território de outro Estado-Membro da União
Europeia.
Artigo 7.º
Taxas de utilização
1 — Cada Parte pode impor ou permitir que sejam impostas taxas justas e razoáveis pela
utilização de aeroportos e de outras instalações relacionadas com serviços de tráfego aéreo que
estejam sob o seu controlo.
2 — Tais taxas não serão mais elevadas do que as impostas às aeronaves utilizadas pelas
empresas de transporte aéreo designadas de cada Parte, em serviços aéreos internacionais se-
melhantes.
Artigo 8.º
Tráfego em trânsito direto
O tráfego em trânsito direto através do território de qualquer das Partes e sem sair da área
do aeroporto reservada para esse fim deverá ser sujeito apenas a um controlo simplificado, exceto
no que diz respeito a medidas de segurança contra a ameaça de interferência ilícita, tais como
violência e pirataria aérea e medidas ocasionais de combate ao tráfico ilícito de drogas. A bagagem
e a carga em trânsito direto estarão isentas de direitos aduaneiros, de taxas e de outros impostos
semelhantes.
Artigo 9.º
Reconhecimento de certificados e licenças
1 — Os certificados de aeronavegabilidade, os certificados de competência e as licenças emiti-
das, ou validadas, em conformidade com a legislação e os procedimentos de uma Parte, incluindo,
no caso da República Portuguesa, as leis e os regulamentos da União Europeia, e cujo prazo de
validade não tenha expirado, deverão ser reconhecidos como válidos pela outra Parte para efeitos
de exploração dos serviços acordados, desde que os requisitos a que obedeceram a sua emissão
ou validação sejam sempre equivalentes ou superiores aos padrões mínimos estabelecidos em
conformidade com a Convenção.
2 — O n.º 1 deste artigo também se aplica a uma empresa de transporte aéreo designada
pela República Portuguesa cujo controlo de regulação seja exercido e mantido por outro Estado-
-Membro da União Europeia.

3 — No que respeita a voos sobre o seu próprio território, cada Parte reserva-se no direito de
não reconhecer os certificados de competência e as licenças concedidas ou validadas aos seus
próprios nacionais pela outra Parte ou por qualquer outro Estado.
Artigo 10.º
Representação comercial
1 — As empresas de transporte aéreo designadas de cada Parte deverão poder:
a) Estabelecer no território da outra Parte escritórios para a promoção do transporte aéreo e
a venda de bilhetes de avião, bem como outras instalações necessárias à prestação de serviços
de transporte aéreo, em conformidade com a legislação da outra Parte;
b) Trazer para o e manter no território da outra Parte — em conformidade com a legislação dessa
outra Parte relativa à entrada, à residência e ao emprego — pessoal executivo, comercial, técnico,
operacional e outro pessoal especializado necessário à prestação de serviços de transporte aéreo; e
c) Proceder diretamente e, se as empresas de transporte aéreo assim o entenderem, através
dos seus agentes à venda de transporte aéreo no território da outra Parte.
2 — As autoridades competentes de cada Parte tomarão todas as medidas necessárias para
assegurar que os representantes das empresas de transporte aéreo designadas pela outra Parte
possam exercer as suas atividades de forma regular.
Artigo 11.º
Atividades comerciais
1 — As empresas de transporte aéreo designadas de cada Parte podem vender transporte
aéreo no território da outra Parte, sendo qualquer pessoa livre de comprar o referido transporte na
moeda daquele território ou em moedas livremente convertíveis de outros Estados, em conformi-
dade com os regulamentos vigentes em matéria cambial.
2 — No exercício das atividades comerciais, os princípios referidos no n.º 1 deste artigo deverão
ser aplicados às empresas de transporte aéreo designadas de ambas as Partes.
Artigo 12.º
Conversão e transferência de lucros
1 — Cada Parte concede às empresas de transporte aéreo designadas da outra Parte o direito
de transferir livremente, à taxa de câmbio oficial da moeda, as receitas isentas de impostos e os
excedentes de receitas auferidas sobre as despesas incorridas relacionadas com o transporte de
passageiros, bagagem, carga e correio nos serviços acordados no seu território e em conformidade
com o Direito interno aplicável no território da Parte a partir do qual é efetuada a transferência.
2 — Para os efeitos deste artigo, o Direito interno aplicável na República Portuguesa inclui
todas as medidas adotadas pela União Europeia.
Artigo 13.º
Concorrência leal
1 — As empresas de transporte aéreo designadas de ambas as Partes deverão beneficiar de
uma oportunidade justa e equitativa para explorarem os serviços acordados nas rotas especificadas.
2 — Cada Parte permitirá que cada empresa de transporte aéreo designada determine a fre-
quência e capacidade de serviços aéreos internacionais que oferece, com base em considerações
comerciais de mercado. De acordo com esse direito, nenhuma das Partes pode limitar unilateral-
mente nem o volume de tráfego, a frequência ou a regularidade do serviço, nem o tipo ou tipos de
aeronaves operadas pelas empresas de transporte aéreo designadas pela outra Parte, exceto se

exigido por motivos alfandegários, técnicos, operacionais ou ambientais, em condições uniformes,
compatíveis com o artigo 15.º da Convenção.
3 — Nenhuma das Partes permitirá que a sua ou as suas empresas de transporte aéreo de-
signadas abusem, em conjunto com qualquer outra empresa ou empresas de transporte aéreo ou
separadamente, do poder de mercado, tendo por efeito, ou sendo suscetível de ter ou pretendendo
ter por efeito, enfraquecer seriamente um concorrente ou excluí-lo de uma rota.
4 — Nenhuma das Partes concederá ou permitirá a concessão de subvenções ou auxílios
estatais à sua ou às suas empresas de transporte aéreo designadas, quando afetem adversamente
as oportunidades justas e equitativas da concorrência oferecidas às empresas de transporte aéreo
da outra Parte, na prestação de serviços aéreos internacionais.
5 — Por subvenções ou auxílios estatais entendem-se os apoios concedidos, direta ou indireta-
mente, pelo Estado ou por um organismo público ou privado designado ou controlado pelo Estado,
numa base discriminatória, a uma empresa de transporte aéreo designada. Tais apoios podem incluir
mas não estão limitados a compensação de perdas de exploração, entradas de capital, apoios a
fundo perdido ou empréstimos em condições privilegiadas, concessão de vantagens financeiras sob
a forma de não perceção de benefícios ou de não cobrança de créditos, renúncia a uma remunera-
ção normal dos fundos públicos utilizados, isenções fiscais, compensação por encargos financeiros
impostos pelas autoridades públicas, ou acesso discriminatório a instalações aeroportuárias, com-
bustíveis ou outras instalações adequadas, necessárias à exploração normal de serviços aéreos.
6 — Quando uma Parte concede subvenções ou auxílios estatais a uma empresa de trans-
porte aéreo designada em relação a serviços aéreos explorados ao abrigo deste Acordo deverá
exigir que a empresa de transporte aéreo identifique e apresente, clara e separadamente, essas
subvenções ou auxílios nas suas contas.
7 — Se uma das Partes considerar, de forma consubstanciada, que as suas empresas de
transporte aéreo designadas estão a ser alvo de discriminação ou de práticas desleais, ou que a
subvenção ou auxílio concedidos pela outra Parte são suscetíveis de afetar ou afetam adversamente
as oportunidades justas e equitativas de concorrência oferecidas às empresas de transporte aéreo
da primeira Parte, na prestação de serviços aéreos internacionais, esta tem o direito de suspender
o exercício dos direitos de tráfego, especificados no artigo 2.º deste Acordo, concedidos à empresa
de transporte aéreo designada da outra Parte, revogar a autorização de exploração ou sujeitar o
exercício desses direitos às condições que julgar necessárias.
Artigo 14.º
Aprovação das condições de exploração
1 — Os horários dos serviços aéreos acordados e as condições da sua exploração em geral deverão
ser notificados às autoridades aeronáuticas da outra Parte com, pelo menos, 30 dias de antecedência
em relação à data prevista para a sua aplicação. Qualquer alteração significativa a esses horários ou
às condições da sua exploração deverá ser igualmente notificada às autoridades aeronáuticas. Em
casos especiais, o prazo acima indicado pode ser reduzido mediante acordo das referidas autoridades.
2 — Em caso de alterações menores ou de voos suplementares, as empresas de transporte
aéreo designadas de uma Parte deverão notificar as autoridades aeronáuticas da outra Parte pelo
menos cinco dias úteis antes do início da exploração pretendida. Em casos especiais, este prazo
pode ser reduzido, mediante acordo das referidas autoridades.
Artigo 15.º
Segurança aérea
1 — Cada Parte pode, em qualquer momento, solicitar consultas sobre os padrões de se-
gurança adotados em qualquer área relacionada com a tripulação, a aeronave ou as condições
da sua operação. Tais consultas deverão realizar-se no prazo de 30 dias a contar desse pedido.
2 — Se, em consequência dessas consultas, uma Parte concluir que a outra Parte não man-
tém nem aplica efetivamente os padrões de segurança que sejam, pelo menos, iguais aos padrões

mínimos então estabelecidos de acordo com a Convenção, a primeira Parte deverá notificar a outra
Parte dessas conclusões e das medidas consideradas necessárias para a adequação a esses
padrões mínimos, devendo a outra Parte tomar as medidas corretivas necessárias. O facto de a
outra Parte não adotar, no prazo de 15 dias ou num prazo maior, conforme acordado, medidas
adequadas constitui fundamento para aplicação do artigo 4.º deste Acordo.
3 — Sem prejuízo das obrigações referidas no artigo 33.º da Convenção, fica acordado que
qualquer aeronave operada pelas empresas de transporte aéreo designadas de uma Parte em
serviços de ou para o território da outra Parte pode, enquanto permanecer no território da outra
Parte, ser objeto de um exame realizado pelos representantes autorizados da outra Parte, a bordo
e no exterior da aeronave, a fim de verificar não só a validade dos documentos da aeronave e da
sua tripulação mas também o estado aparente da aeronave e do seu equipamento (denominada
«inspeção na plataforma de estacionamento»), desde que tal não implique atrasos desnecessários.
4 — Se qualquer dessas inspeções na plataforma de estacionamento ou série de inspeções
na plataforma de estacionamento suscitar:
a) Preocupações sérias de que uma aeronave, ou de que a operação de uma aeronave não
cumpre os padrões mínimos então estabelecidos pela Convenção; ou
b) Preocupações sérias quanto à falta de manutenção e aplicação efetiva dos padrões de
segurança então estabelecidos pela Convenção;
a Parte que efetuou a inspeção pode concluir, para os fins previstos no artigo 33.º da Convenção,
que os requisitos a que obedeceram a emissão e validação dos certificados ou das licenças dessa
aeronave ou da sua tripulação, ou que os requisitos de operação dessa aeronave, não são iguais
ou superiores aos padrões mínimos estabelecidos pela Convenção.
5 — No caso de o acesso para efeitos de uma inspeção na plataforma de estacionamento a
uma aeronave operada por uma empresa de transporte aéreo designada de uma Parte, nos termos
do n.º 3 deste artigo, ser negado pelos representantes dessa empresa de transporte aéreo desig-
nada, a outra Parte pode inferir que há preocupações sérias do tipo referido no n.º 4 deste artigo
e de tirar as conclusões nele referidas.
6 — Cada Parte reserva-se no direito de suspender ou alterar de imediato a autorização de
exploração da empresa de transporte aéreo designada da outra Parte caso a primeira Parte conclua,
em consequência de uma inspeção na plataforma de estacionamento, de uma série de inspeções
na plataforma de estacionamento, de uma recusa de acesso para efeitos de inspeção na plataforma
de estacionamento, de consultas, quer ainda de qualquer outro facto, que uma ação imediata é
imprescindível para a segurança da operação da empresa de transporte aéreo.
7 — Qualquer ação empreendida por uma Parte de acordo com os n.os 2 ou 6 deste artigo
deverá ser interrompida quando deixe de existir fundamento para essa ação.
8 — Caso a República Portuguesa tenha designado uma empresa de transporte aéreo cujo
controlo de regulação seja exercido e mantido por outro Estado-Membro da UE, os direitos da outra
Parte, previstos neste artigo, aplicam-se igualmente no que respeita à adoção, ao exercício ou à
manutenção dos padrões de segurança por esse outro Estado-Membro da UE, bem como no que
respeita à autorização de exploração dessa empresa de transporte aéreo.
Artigo 16.º
Segurança da aviação civil
1 — Em conformidade com os direitos e obrigações que lhes incumbem ao abrigo do Direito
Internacional, as Partes reafirmam que a sua obrigação mútua de protegerem a segurança da
aviação civil contra atos de interferência ilícita constitui parte integrante deste Acordo. Sem limitar
a generalidade dos seus direitos e obrigações decorrentes do Direito Internacional, as Partes de-
verão, em especial, agir em conformidade com o disposto:
a) Na Convenção Relativa às Infrações e a Certos Outros Atos Cometidos a Bordo de Aero-
naves, assinada em Tóquio, em 14 de setembro de 1963;

b) Na Convenção para a Repressão da Captura Ilícita de Aeronaves, assinada na Haia, em
16 de dezembro de 1970;
c) Na Convenção para a Repressão de Atos Ilícitos contra a Segurança da Aviação Civil, as-
sinada em Montreal, em 23 de setembro de 1971;
d) No seu Protocolo Suplementar para a Repressão de Atos Ilícitos de Violência nos Aeroportos
servindo a Aviação Civil Internacional, assinado em Montreal, em 24 de fevereiro de 1988; e
e) Na Convenção sobre a Marcação dos Explosivos Plásticos para Fins de Deteção, assinada
em Montreal, em 1 de março de 1991;
bem como em qualquer outro acordo multilateral que regule a segurança da aviação civil e seja
vinculativo para as Partes.
2 — As Partes deverão nas suas relações mútuas, no mínimo, atuar em conformidade com
as disposições sobre segurança da aviação estabelecidas pela Organização da Aviação Civil
Internacional denominadas Anexos à Convenção, na medida em que essas disposições sobre
segurança se apliquem às Partes; elas deverão exigir que os operadores de aeronaves regis-
tadas no seu território ou os operadores de aeronaves que nele tenham o seu estabelecimento
principal ou a sua residência permanente no território das Partes ou que nele estejam estabe-
lecidos, ou no caso da República Portuguesa os operadores de aeronaves que se encontrem
estabelecidos no seu território nos termos dos Tratados UE e sejam detentores de licenças de
exploração válidas em conformidade com o Direito da União Europeia, e que os operadores de
aeroportos situados no seu território, atuem em conformidade com tais disposições relativas à
segurança da aviação civil.
3 — As Partes deverão, a pedido, prestar-se toda a assistência mútua necessária com vista a
impedir atos de captura ilícita de aeronaves civis e outros atos ilícitos contra a segurança dessas
aeronaves, respetivos passageiros e tripulações, bem como de aeroportos, instalações e equipa-
mentos de navegação aérea, e ainda qualquer outra ameaça à segurança da aviação civil.
4 — Cada Parte concorda que se exija a esses operadores de aeronaves que cumpram as
disposições relativas à segurança da aviação, referidas no n.º 2 deste artigo, impostas pela outra
Parte à entrada no território dessa outra Parte e também à saída, ou permanência, no território
da outra Parte. Para a saída ou permanência no território da República Portuguesa, exige-se
que os operadores de aeronaves cumpram as disposições relativas à segurança da aviação, em
conformidade com o Direito da União Europeia. Cada Parte deverá assegurar, no seu território, a
aplicação efetiva de medidas adequadas para proteger as aeronaves e inspecionar passageiros,
tripulações, bagagem de mão, bagagem, carga e aprovisionamentos, antes e durante o embarque
ou carregamento. Cada Parte também deverá considerar favoravelmente qualquer pedido da ou-
tra Parte relativo à adoção de medidas especiais de segurança, razoáveis, para fazer face a uma
ameaça concreta.
5 — Em caso de incidente ou ameaça de incidente de captura ilícita de aeronaves civis ou de
outros atos ilícitos contra a segurança de tais aeronaves, seus passageiros e tripulações, de aero-
portos ou de instalações de navegação aérea, as Partes deverão ajudar-se mutuamente, facilitando
as comunicações e outras medidas adequadas, tendentes a pôr termo, de forma rápida e segura,
a esse incidente ou ameaça de incidente.
6 — Quando uma Parte tiver preocupações razoáveis para crer que a outra Parte não cum-
pre as disposições de segurança previstas neste artigo, a primeira Parte pode solicitar consultas
imediatas com as autoridades aeronáuticas da outra Parte.
Artigo 17.º
Provisão de estatísticas
As autoridades aeronáuticas de uma Parte deverão disponibilizar às autoridades aeronáuticas
da outra Parte, a pedido destas, as estatísticas que possam ser razoavelmente exigidas para fins
informativos.

Artigo 18.º
Tarifas
1 — As tarifas a serem cobradas pelas empresas de transporte aéreo designadas de uma
Parte para o transporte de ou para o território da outra Parte serão estabelecidas a níveis razoá-
veis, tendo em devida conta todos os fatores relevantes, incluindo o custo de exploração, um lucro
razoável e as tarifas praticadas por outras empresas de transporte aéreo que exploram a totalidade
ou parte da mesma rota.
2 — As tarifas devem ser submetidas à aprovação das autoridades aeronáuticas de ambas
as Partes com, pelo menos, 30 dias de antecedência da data proposta para a sua aplicação.
Em circunstâncias especiais, este prazo pode ser reduzido, mediante acordo das referidas
autoridades.
3 — Esta aprovação poderá ser dada por escrito. Se nenhuma das autoridades aeronáuti-
cas desaprovar as tarifas propostas no prazo de 25 dias a partir da data da sua submissão, em
conformidade com o n.º 2 deste artigo, essas tarifas serão consideradas aprovadas. No caso de
o período para submissão de tarifas ser reduzido, de acordo com o n.º 2 deste artigo, as auto-
ridades aeronáuticas poderão acordar que o período de notificação de qualquer desaprovação
será inferior a 25 dias.
4 — Se, durante o período aplicável, em conformidade com o n.º 3 deste artigo, uma auto-
ridade aeronáutica notificar a outra autoridade aeronáutica da sua desaprovação de qualquer
tarifa, as autoridades aeronáuticas das duas Partes envidarão esforços para fixar, de comum
acordo, a tarifa.
5 — Se as autoridades aeronáuticas não chegarem a acordo sobre a aprovação de qualquer
tarifa que lhes tenha sido submetida, em conformidade com o n.º 2 deste artigo, ou sobre a fixação
de qualquer tarifa, em conformidade com o n.º 4 deste artigo, o diferendo deverá ser solucionado
em harmonia com as disposições do artigo 21.º deste Acordo.
6 — As tarifas estabelecidas em conformidade com as disposições deste artigo continuarão
em vigor até que novas tarifas sejam estabelecidas. A validade da tarifa não poderá, no entanto,
ser prorrogada, por força deste número, por um período superior a 12 meses a contar da data em
que teria expirado.
7 — As Partes podem intervir para desaprovar uma tarifa. Essa intervenção ficará limitada à:
a) Proteção dos consumidores em relação a tarifas excessivamente elevadas em consequência
do abuso de posição dominante;
b) Prevenção de tarifas cuja aplicação constitui um comportamento anticoncorrencial que terá
ou aparenta ter ou visa notoriamente ter o efeito de obstaculizar, restringir ou distorcer a concor-
rência ou de excluir um concorrente da rota.
Artigo 19.º
Consultas
1 — A fim de assegurar uma estreita cooperação em todas as questões relativas à interpre-
tação e aplicação deste Acordo, as autoridades aeronáuticas de cada Parte deverão consultar-se,
sempre que necessário, a pedido de qualquer das Partes.
2 — Tais consultas deverão ter início no prazo de 45 dias a contar da data de receção do
pedido escrito, pela outra Parte.
Artigo 20.º
Emendas
1 — Se qualquer das Partes considerar que é conveniente alterar qualquer disposição
deste Acordo pode, em qualquer momento, solicitar negociações à outra Parte. Tais negociações

deverão ter início no prazo de 60 dias a contar da data em que a outra Parte tiver recebido um
pedido escrito.
2 — Se qualquer das Partes considerar que é conveniente alterar qualquer disposição deste
Acordo, tal emenda será acordada entre as Partes, confirmada por escrito por via diplomática, e
entrará em vigor em conformidade com o artigo 25.º deste Acordo.
3 — Não obstante o disposto no n.º 2 deste artigo, qualquer emenda ao anexo a este
Acordo poderá ser acordada entre as autoridades aeronáuticas das Partes, e confirmada por
troca de notas diplomáticas. Entrará em vigor na data a determinar nas notas diplomáticas.
Esta exceção ao n.º 2 deste artigo não se aplica no caso de serem adicionados direitos de
tráfego ao anexo.
Artigo 21.º
Resolução de diferendos
1 — Em caso de diferendo entre as Partes relativo à interpretação ou aplicação deste
Acordo, as Partes deverão, em primeiro lugar, procurar resolvê-lo através de negociações, por
via diplomática.
2 — Se as Partes não conseguirem resolver o diferendo por via da negociação, podem submetê-
-lo à decisão de uma entidade ou, a pedido de qualquer das Partes, pode o diferendo ser submetido
à decisão de um tribunal arbitral composto por três árbitros. Cada Parte deverá nomear um árbitro
e os dois árbitros assim nomeados deverão designar o terceiro.
3 — Cada uma das Partes deverá nomear um árbitro no prazo de 60 dias a contar da
data em que uma das Partes tenha recebido da outra Parte notificação, por via diplomática,
do pedido de arbitragem do diferendo, devendo o terceiro árbitro ser designado nos 60 dias
subsequentes.
4 — Se nenhuma das Partes nomear um árbitro no prazo estabelecido ou se o terceiro árbitro
não tiver sido designado no período especificado, o Presidente do Conselho da Organização da
Aviação Civil Internacional pode, a pedido de qualquer das Partes, designar um ou mais árbitros
conforme o exija o caso. Nesse caso, o terceiro árbitro deverá ser nacional de um Estado terceiro
e atuar como presidente do órgão arbitral.
5 — As Partes comprometem-se a cumprir qualquer decisão tomada ao abrigo do n.º 2 deste
artigo.
6 — Se, e enquanto, qualquer das Partes ou as empresas de transporte aéreo designa-
das de qualquer das Partes não cumprirem a decisão tomada ao abrigo do n.º 2 deste artigo,
a outra Parte pode limitar, suspender ou revogar quaisquer direitos ou privilégios que, em
virtude deste Acordo, tenha concedido à Parte em falta ou às empresas de transporte aéreo
designadas em falta.
7 — Cada Parte deverá suportar as despesas do árbitro por ela nomeado. As restantes des-
pesas do tribunal arbitral deverão ser repartidas em partes iguais entre as Partes.
Artigo 22.º
Vigência e denúncia
1 — Este Acordo permanecerá em vigor por período indeterminado.
2 — Cada Parte poderá, em qualquer momento, notificar por escrito a outra Parte, por via
diplomática, da sua decisão de denunciar este Acordo. Essa notificação será simultaneamente
comunicada à Organização da Aviação Civil Internacional.
3 — O Acordo cessará 12 meses após a data de receção da notificação pela outra Parte, salvo
se essa notificação for retirada, por comum acordo, antes de terminado esse período.

4 — Caso a outra Parte não acuse a receção da notificação, esta deverá considerar-se efetuada
14 dias após a sua receção pela Organização da Aviação Civil Internacional.
Artigo 23.º
Registo
Este Acordo e qualquer emenda ao mesmo deverão ser registados junto da Organização da
Aviação Civil Internacional.
Artigo 24.º
Aplicabilidade do Acordo
No que se refere ao Reino dos Países Baixos, este Acordo apenas se aplica a Curaçao.
Artigo 25.º
Entrada em vigor
Este Acordo entrará em vigor no 1.º dia do 2.º mês seguinte à data de receção da última
notificação escrita, por via diplomática, através da qual as Partes tenham notificado mutuamente
ter concluído os procedimentos para a entrada em vigor deste Acordo, em conformidade com os
respetivos procedimentos legais.
Em fé do que os signatários, devidamente autorizados para o efeito pelos respetivos Governos,
assinaram este Acordo.
Feito em Lisboa, a 25 de junho de 2019, em dois originais, nas línguas portuguesa, holandesa
e inglesa, sendo todos os textos igualmente autênticos. Em caso de divergência de interpretação,
prevalecerá a versão inglesa.

sujeito a aprovação pelas autoridades aeronáuticas de ambas as Partes e pode ser estabelecido num acordo.
VERDRAG INZAKE LUCHTVERVOER TUSSEN HET KONINKRIJK DER NEDERLANDEN, TEN BEHOEVE
VAN CURAÇAO, EN DE PORTUGESE REPUBLIEK
Het Koninkrijk der Nederlanden, ten behoeve van Curaçao, en de Portugese Republiek (hierna
te noemen “de partijen”):
Partij zijnde bij het Verdrag inzake de internationale burgerluchtvaart, opengesteld voor onder-
tekening te Chicago op 7 december 1944;
Geleid door de wens internationale luchtdiensten op veilige en ordelijke wijze te organiseren
en de internationale samenwerking met betrekking tot deze diensten in de ruimst mogelijke mate
te bevorderen; en
Geleid door de wens een verdrag te sluiten ter bevordering van de ontwikkeling van geregelde
luchtdiensten tussen en via hun grondgebieden:
zijn het volgende overeengekomen:
Begripsomschrijvingen
Voor de toepassing van dit Verdrag:
a) Wordt onder “het Verdrag van Chicago” verstaan het Verdrag inzake de internationale bur-
gerluchtvaart, opengesteld voor ondertekening te Chicago op 7 december 1944, met inbegrip van
alle overeenkomstig artikel 90 van het Verdrag van Chicago aangenomen Bijlagen en alle wijzigin-
gen van de Bijlagen of van het Verdrag van Chicago ingevolge de artikelen 90 en 94 daarvan, voor
zover deze Bijlagen en wijzigingen door beide partijen zijn aangenomen;
b) Wordt onder “EU-verdragen” verstaan het Verdrag betreffende de Europese Unie en het
Verdrag betreffende de werking van de Europese Unie;
c) Wordt onder “luchtvaartautoriteiten” verstaan, wat de Portugese Republiek betreft, de Bur-
gerluchtvaartdienst; en, wat het Koninkrijk der Nederlanden, ten behoeve van Curaçao, betreft, de
minister verantwoordelijk voor de burgerluchtvaart; of, in beide gevallen, elke persoon of instantie
die bevoegd is elke functie die thans wordt vervuld door de genoemde autoriteiten of soortgelijke
functies te vervullen;
d) Wordt onder “aangewezen luchtvaartmaatschappij” verstaan een luchtvaartmaatschappij
die is aangewezen en gemachtigd overeenkomstig artikel 3 van dit Verdrag;

e) Heeft “grondgebied” de betekenis die eraan wordt toegekend in artikel 2 van het Verdrag
van Chicago;
f) Hebben “luchtdienst”, “internationale luchtdienst”, “luchtvaartmaatschappij” en “landing anders
dan voor verkeersdoeleinden” de betekenis die daaraan in artikel 96 van het Verdrag van Chicago
respectievelijk wordt toegekend;
g) Wordt onder “tarief” verstaan de prijzen die in rekening worden gebracht voor het
vervoer van passagiers, bagage en vracht en de voorwaarden waaronder deze prijzen van
toepassing zijn, met inbegrip van de prijzen en voorwaarden voor agentschappen en andere
aanvullende diensten, maar met uitzondering van de vergoedingen of voorwaarden voor het
vervoeren van post; en
h) Wordt onder “Bijlage” verstaan: de routetabel die als bijlage bij dit Verdrag is gevoegd en
alle clausules of noten die in deze Bijlage zijn vervat.
Artikel 2
Exploitatierechten
1 — Elke partij verleent de andere partij de volgende rechten voor het verrichten van interna-
tionale luchtdiensten door de aangewezen luchtvaartmaatschappijen van de andere partij:
a) Het recht zonder te landen over haar grondgebied te vliegen; en
b) Het recht op haar grondgebied te landen anders dan voor verkeersdoeleinden.
2 — Elke partij verleent de andere partij de hierna in dit Verdrag omschreven rechten ten behoeve
van de exploitatie van geregelde internationale luchtdiensten op de routes die omschreven zijn in
de desbetreffende delen van de routetabel die als Bijlage bij dit Verdrag is gevoegd. Deze diensten
en routes worden hierna respectievelijk de “overeengekomen diensten” en de “omschreven routes”
genoemd. Terwijl zij een overeengekomen dienst op een omschreven route exploiteren, hebben de
door elke partij aangewezen luchtvaartmaatschappijen behalve de rechten genoemd in het eerste
lid van dit artikel en afhankelijk van de bepalingen van dit Verdrag, het recht op het grondgebied
van de andere partij te landen op de punten die omschreven zijn in de routetabel bij dit Verdrag ten
behoeve van het opnemen en afzetten van passagiers, bagage, vracht en post.
3 — Geen van de bepalingen in het tweede lid van dit artikel wordt geacht de aangewezen
luchtvaartmaatschappijen van de ene partij het recht te geven op het grondgebied van de andere
partij tegen vergoeding passagiers, vracht en post op te nemen bestemd voor een ander punt op
het grondgebied van die andere partij.
4 — Indien de aangewezen luchtvaartmaatschappijen van de ene partij niet in staat zijn lu-
chtdiensten op hun normale route te exploiteren vanwege een gewapend conflict, politieke onlusten
of bijzondere en ongewone omstandigheden, stelt de ander partij alles in het werk om de voort-
gaande exploitatie van dergelijke diensten te vergemakkelijken door passende aanpassingen van
degelijke routes, waaronder het verlenen van rechten voor zolang dit nodig is om een financieel
haalbare exploitatie te vergemakkelijken. De bepalingen van deze norm worden zonder onderscheid
toegepast tussen de aangewezen luchtvaartmaatschappijen van de partijen.
Artikel 3
Aanwijzing en exploitatievergunning van luchtvaartmaatschappijen
1 — Elke partij heeft het recht door middel van een schriftelijke kennisgeving aan de andere
partij luchtvaartmaatschappijen aan te wijzen voor het verrichten van de overeengekomen diensten
op de in de Bijlage omschreven routes en deze aanwijzingen in te trekken of te wijzigen. Dergelijke
aanwijzingen geschieden schriftelijk en de andere partij wordt hiervan langs diplomatieke weg in
kennis gesteld.
2 — Na ontvangst van de kennisgeving van deze aanwijzing en van aanvragen van een aan-
gewezen luchtvaartmaatschappij, in de vorm en op de wijze die is voorgeschreven voor exploita-

tievergunningen en technische vergunningen, verleent de andere partij de aangewezen luchtvaart-
maatschappij met een minimum aan vertraging de passende exploitatievergunningen en technische
vergunningen, op voorwaarde dat:
a) In het geval van een luchtvaartmaatschappij aangewezen door de Portugese Republiek:
i) De luchtvaartmaatschappij gevestigd is op het grondgebied van de Portugese Republiek
overeenkomstig de EU-Verdragen en beschikt over een geldige exploitatievergunning in overeens-
temming met het recht van de Europese Unie; en
ii) De lidstaat van de Europese Unie die verantwoordelijk is voor de afgifte van het bewijs lu-
chtvaartexploitant daadwerkelijk controleert of de luchtvaartmaatschappij de regelgeving naleeft en
de desbetreffende luchtvaartautoriteit duidelijk wordt vermeld in de aanwijzing; en
iii) De luchtvaartmaatschappij rechtstreeks of via een meerderheidsbelang eigendom is van
en daadwerkelijk onder toezicht staat van lidstaten van de Europese Unie of de Europese Vrijhan-
delsassociatie en/of van onderdanen van deze staten;
b) Wat betreft een luchtvaartmaatschappij aangewezen door Curaçao:
i) De luchtvaartmaatschappij gevestigd is op het grondgebied van Curaçao en beschikt over
een geldige exploitatievergunning in overeenstemming met de van toepassing zijnde wetgeving
van Curaçao; en
ii) Curaçao daadwerkelijk controleert of de luchtvaartmaatschappij de regelgeving naleeft en
Curaçao verantwoordelijk is voor afgifte van het bewijs luchtvaartexploitant en de desbetreffende
luchtvaartautoriteit duidelijk wordt vermeld in de aanwijzing; en
iii) De luchtvaartmaatschappij rechtstreeks of via een meerderheidsbelang eigendom is van en
daadwerkelijk onder toezicht staat van Curaçao en/of van onderdanen van Curaçao;
c) De aangewezen luchtvaartmaatschappij in staat is te voldoen aan de in de wetgeving ges-
telde voorwaarden die de partij die de aanvraag of aanvragen ontvangt gewoonlijk toepast op de
exploitatie van internationale luchtdiensten.
Artikel 4
Weigering, intrekking, schorsing of beperking van rechten
1 — Elke partij heeft het recht de exploitatievergunningen of technische vergunningen van een
door de andere partij aangewezen luchtvaartmaatschappij te weigeren, in te trekken, te schorsen
of te beperken van de rechten omschreven in artikel 2 van dit Verdrag of de uitoefening van deze
rechten te onderwerpen aan de noodzakelijk geachte voorwaarden indien:
a) In het geval van een luchtvaartmaatschappij aangewezen door de Portugese Republiek:
i) De luchtvaartmaatschappij niet gevestigd is op het grondgebied van de Portugese Republiek
overeenkomstig de EU-Verdragen of niet beschikt over een geldige exploitatievergunning in overe-
enstemming met het recht van de Europese Unie; of
ii) De lidstaat van de Europese Unie die verantwoordelijk is voor de afgifte van het bewijs luchtva-
artexploitant niet daadwerkelijk controleert of de aangewezen luchtvaartmaatschappij de regelgeving
naleeft of de desbetreffende luchtvaartautoriteit niet duidelijk wordt vermeld in de aanwijzing; of
iii) De luchtvaartmaatschappij niet rechtstreeks of via een meerderheidsbelang eigendom is
van of niet daadwerkelijk onder toezicht staat van lidstaten van de Europese Unie of de Europese
Vrijhandelsassociatie en/of van onderdanen van deze staten;
b) In het geval van een luchtvaartmaatschappij aangewezen door Curaçao:
i) De luchtvaartmaatschappij niet gevestigd is op het grondgebied van Curaçao of niet bes-
chikt over een geldige exploitatievergunning in overeenstemming met de van toepassing zijnde
wetgeving; of

ii) De lidstaat van de Europese Unie die verantwoordelijk is voor de afgifte van het bewijs luchtva-
artexploitant niet daadwerkelijk controleert of de aangewezen luchtvaartmaatschappij de regelgeving
naleeft of de desbetreffende luchtvaartautoriteit niet duidelijk wordt vermeld in de aanwijzing; of
iii) De luchtvaartmaatschappij niet rechtstreeks of via een meerderheidsbelang eigendom is
van of niet daadwerkelijk onder toezicht staat van Curaçao en/of van onderdanen van Curaçao;
c) In het geval dat de aangewezen luchtvaartmaatschappij niet in staat is te voldoen aan de in
de wetgeving gestelde voorwaarden die de partij die de aanwijzing(en) ontvangt gewoonlijk toepast
op de exploitatie van internationale luchtdiensten; of
d) In het geval dat een dergelijke aangewezen luchtvaartmaatschappijen de wetgeving van de
partij die de exploitatievergunning of technische vergunning verleent niet naleeft; of
e) In het geval dat de aangewezen luchtvaartmaatschappij de overeengekomen diensten niet
exploiteert in overeenstemming met de voorwaarden die omschreven zijn in dit Verdrag en de hierbij
gevoegde Bijlage.
2 — Tenzij onmiddellijke weigering, intrekking, schorsing, beperking of oplegging van de in
het eerste lid van dit artikel genoemde voorwaarden van wezenlijk belang is om verdere inbreuken
op de wetgeving te voorkomen, wordt het recht van weigering, intrekking, schorsing, beperking of
oplegging van voorwaarden slechts uitgeoefend na overleg met de andere partij. Het overleg vangt
aan binnen een termijn van dertig (30) dagen na de datum van ontvangst van een dergelijk verzoek,
tenzij anders wordt overeengekomen.
Artikel 5
Toepassing van wetgeving en procedures
1 — De wetgeving en procedures van de ene partij met betrekking tot de toelating tot, het ver-
blijf op of het vertrek uit haar grondgebied van luchtvaartuigen die voor internationale luchtdiensten
worden ingezet, of met betrekking tot de exploitatie van en het vliegen met deze luchtvaartuigen die
zich op haar grondgebied bevinden, worden toegepast op luchtvaartuigen van beide partijen wanneer
zij het grondgebied van de eerste partij binnenkomen, erop verblijven of het weer verlaten.
2 — De wetgeving en procedures van de ene partij met betrekking tot de toelating tot, het verblijf
op, doorgaand verkeer via of het vertrek uit haar grondgebied van passagiers, bemanning, bagage,
vracht en post aan boord van luchtvaartuigen, zoals wetgeving met betrekking tot binnenkomst,
inklaring, immigratie, paspoorten, douanecontrole en sanitaire maatregelen, worden nageleefd door
de luchtvaartmaatschappij van de andere partij of namens deze passagiers, bemanning, rechtsper-
soon die het recht heeft met betrekking tot de bagage, vracht en post bij binnenkomst in, verblijf op
of het verlaten van het grondgebied van deze partij.
Artikel 6
Vrijstelling van douanerechten en andere heffingen
1 — Luchtvaartuigen die door de aangewezen luchtvaartmaatschappij van een van de partijen
voor internationale luchtdiensten worden gebruikt, alsmede hun normale uitrustingsstukken, reser-
veonderdelen, voorraden brandstof en smeermiddelen, andere technische verbruiksvoorraden en
boordproviand (waaronder etenswaren, dranken en tabaksartikelen) die zich aan boord van deze
luchtvaartuigen bevinden, zijn vrijgesteld van alle douanerechten, inspectiekosten en andere soort-
gelijke heffingen bij aankomst op het grondgebied van de andere partij, mits deze uitrustingsstukken,
voorraden en proviand aan boord van het luchtvaartuig blijven totdat zij weer worden uitgevoerd
of worden gebruikt tijdens het gedeelte van de vlucht dat wordt afgelegd boven dat grondgebied.
2 — Van deze rechten, kosten en belastingen, uitgezonderd heffingen in verband met verleende
diensten, zijn voorts vrijgesteld:
a) Boordproviand aan boord genomen op het grondgebied van een partij, binnen de grenzen
die door de autoriteiten van genoemde partij zijn vastgesteld, en bestemd voor gebruik aan boord

van uitgaande luchtvaartuigen die door de aangewezen luchtvaartmaatschappijen van de andere
partij worden ingezet voor internationale luchtdiensten;
b) Reserveonderdelen en normale uitrustingsstukken die het grondgebied van een van de partijen
worden binnengebracht voor het onderhoud of herstel van luchtvaartuigen die door de aangewezen
luchtvaartmaatschappijen van de andere partij worden ingezet voor internationale luchtdiensten;
c) Brandstoffen, smeermiddelen en andere technische verbruiksvoorraden bestemd ter be-
voorrading van uitgaande luchtvaartuigen die door de aangewezen luchtvaartmaatschappijen van
de andere partij worden ingezet voor internationale luchtdiensten, zelfs wanneer deze voorraden
worden gebruikt op het deel van de vlucht boven het grondgebied van partij waar zij aan boord zijn
genomen.
3 — Ten aanzien van alle in het tweede lid van dit artikel genoemde goederen kan worden
verlangd dat deze onder toezicht of beheer van de douane blijven.
4 — Normale boorduitrustingsstukken alsmede de materialen en voorraden die aan boord van
het luchtvaartuig van een aangewezen luchtvaartmaatschappij van een partij blijven, mogen op het
grondgebied van de andere partij slechts worden uitgeladen met toestemming van de douaneauto-
riteiten van die partij. In een dergelijk geval kunnen deze goederen onder toezicht van genoemde
douaneautoriteiten worden geplaatst tot het tijdstip waarop ze weer worden uitgevoerd of overe-
enkomstig de douanevoorschriften een andere bestemming hebben gekregen.
5 — De in dit artikel voorziene vrijstellingen zijn ook beschikbaar in situaties waarin de aan-
gewezen luchtvaartmaatschappijen van een van de partijen met een andere luchtvaartmaatschappij
of andere luchtvaartmaatschappijen regelingen zijn aangegaan voor het op het grondgebied van
de andere partij lenen of overdragen van de in het eerste en tweede lid van dit artikel opgesomde
goederen, mits de andere luchtvaartmaatschappij of andere luchtvaartmaatschappijen dezelfde
vrijstelling(en) geniet(en) van de andere partij.
6 — Niets in dit Verdrag belet de Portugese Republiek op basis van non-discriminatie belas-
tingen, rechten, heffingen of accijnzen op te leggen op de op zijn grondgebied geleverde brandstof
voor gebruik in een luchtvaartuig van een aangewezen luchtvaartmaatschappij van Curaçao dat
vliegt tussen een punt op het grondgebied van de Portugese Republiek en een ander punt op het
grondgebied van de Portugese Republiek of op het grondgebied van een andere lidstaat van de
Europese Unie.
Artikel 7
Gebruikersheffingen
1 — Elke partij mag billijke en redelijke heffingen opleggen of toestaan dat deze worden
opgelegd voor het gebruik van luchthavens, andere voorzieningen en luchtdiensten waarover zij
zeggenschap heeft.
2 — Deze heffingen mogen niet hoger zijn dan die worden opgelegd aan luchtvaartuigen van
de aangewezen luchtvaartmaatschappijen van elke partij die vergelijkbare internationale diensten
uitvoeren.
Artikel 8
Rechtstreeks doorgaand verkeer
Rechtstreeks doorgaand verkeer via het grondgebied van een van de partijen dat de daarvoor
gereserveerde zone van de luchthaven niet verlaat, wordt, behalve voor wat betreft veiligheids-
maatregelen tegen de dreiging van wederrechtelijke inmenging, zoals geweld en luchtpiraterij en
incidentele maatregelen ter bestrijding van de illegale handel in verdovende middelen, slechts aan
een vereenvoudigde controle onderworpen. Bagage en vracht in rechtstreeks doorgaand verkeer
zijn vrijgesteld van douanerechten, heffingen en andere vergelijkbare belastingen.

Artikel 9
Erkenning van bewijzen en vergunningen
1 — Bewijzen van luchtwaardigheid, bewijzen van bevoegdheid en vergunningen die zijn
afgegeven of geldig verklaard in overeenstemming met de wetgeving en procedures van de ene
partij, met inbegrip van, in het geval van de Portugese Republiek, de wet- en regelgeving van de
EU en die nog niet zijn verlopen, worden door de andere partij ten behoeve van de exploitatie van
de overeengekomen diensten als geldig erkend, mits de vereisten voor de afgifte of geldigverkla-
ring van de bewijzen en vergunningen ten minste gelijkwaardig zijn aan of zwaarder zijn dan de in
overeenstemming met het Verdrag van Chicago vastgestelde minimumeisen.
2 — Het eerste lid van dit artikel is tevens van toepassing op een door de Portugese Republiek
aangewezen luchtvaartmaatschappij waarbij een andere lidstaat van de Europese Unie controleert
of deze de regelgeving naleeft.
3 — Elke partij behoudt zich het recht voor de erkenning van bewijzen van bevoegdheid en
vergunningen door de andere partij of een andere staat verleend aan of geldig verklaard voor haar
eigen onderdanen te weigeren voor vluchten boven haar grondgebied.
Artikel 10
Commerciële vertegenwoordiging
1 — Het is de aangewezen luchtvaartmaatschappijen van beide partijen toegestaan:
a) Op het grondgebied van de andere partij kantoren te vestigen ten behoeve van de bevordering
van luchtvervoer en verkoop van vliegtickets alsmede, in overeenstemming met de wetgeving van
deze andere partij, andere voorzieningen die nodig zijn voor het verzorgen van luchtvervoer;
b) In overeenstemming met de wetgeving van de andere partij met betrekking tot binnenkomst,
verblijf en tewerkstelling, leidinggevend, commercieel, technisch, operationeel alsmede ander ges-
pecialiseerd personeel naar het grondgebied van deze andere partij te brengen en te doen verblijven
voor het verzorgen van luchtvervoer; en
c) Zich op het grondgebied van de andere partij rechtstreeks en, naar eigen goeddunken, via
hun agenten met de verkoop van luchtvervoer bezig te houden.
2 — De bevoegde autoriteiten van elke partij nemen alle noodzakelijke maatregelen om te
waarborgen dat de vertegenwoordiging van de door de andere partij aangewezen luchtvaartma-
atschappijen haar activiteiten op ordelijke wijze kan uitvoeren.
Artikel 11
Commerciële activiteiten
1 — De door elke partij aangewezen luchtvaartmaatschappijen hebben het recht, op het grond-
gebied van de andere partij, luchtvervoer te verkopen en het staat elke persoon vrij dit luchtvervoer
te kopen in de valuta van dat grondgebied of in vrij inwisselbare valuta van andere staten in overe-
enstemming met de van kracht zijnde regelgeving inzake valutatransacties.
2 — Voor wat betreft de commerciële activiteiten zijn alle principes vermeld in het eerste lid van
dit artikel van toepassing op de aangewezen luchtvaartmaatschappijen van beide partijen.
Artikel 12
Omwisselen en overmaken van opbrengsten
1 — Elke partij verleent de aangewezen luchtvaartmaatschappijen van de andere partij het recht
vrijgestelde inkomstenbelasting en het batig saldo van inkomsten en uitgaven die verband houden
met het vervoer van passagiers, bagage, vracht en post op de overeengekomen diensten op haar

grondgebied vrijelijk over te maken tegen de officiële wisselkoers, en overeenkomstig de toepasselijke
nationale wetgeving van het grondgebied van de partij vanwaar de overmaking plaatsvindt.
2 — Voor de toepassing van dit artikel omvat de toepasselijke nationale wetgeving van de
Portugese Republiek alle maatregelen die zijn getroffen door de Europese Unie.
Artikel 13
Eerlijke concurrentie
1 — Elke partij staat toe dat de aangewezen luchtvaartmaatschappijen van beide partijen op
eerlijke en gelijke wijze in de gelegenheid worden gesteld de overeengekomen diensten op de
omschreven routes te exploiteren.
2 — Elke partij staat toe dat elke aangewezen luchtvaartmaatschappij de frequentie en ca-
paciteit van de internationale luchtdiensten die zij aanbiedt, bepaalt op basis van commerciële
marktoverwegingen. In overeenstemming met dit recht beperkt geen van de partijen eenzijdig de
omvang van het verkeer, de frequentie of regelmatigheid van een dienst, of het type of de typen
van de door de aangewezen luchtvaartmaatschappij van de andere partij geëxploiteerde luchtva-
artuigen, tenzij dit nodig kan zijn om redenen op het gebied van douane, techniek, exploitatie of
milieu uit hoofde van uniforme voorwaarden in overeenstemming met artikel 15 van het Verdrag
van Chicago.
3 — Geen van de partijen staat haar aangewezen luchtvaartmaatschappij of luchtvaartmaats-
chappijen toe, hetzij samen met een andere luchtvaartmaatschappij of luchtvaartmaatschappijen
hetzij afzonderlijk, haar of hun marktmacht zodanig te misbruiken dat dit leidt tot ernstige verzwakking
van een concurrent of tot uitsluiting van een concurrent van een route, of dit hoogstwaarschijnlijk
tot gevolg of ten doel heeft.
4 — Geen van de partijen verstrekt staatssubsidie of staatssteun aan haar aangewezen lu-
chtvaartmaatschappij of luchtvaartmaatschappijen, of staat deze toe, die deze nadelige gevolgen
zou hebben voor de wijze waarop de luchtvaartmaatschappijen van de andere partij in de gele-
genheid worden gesteld eerlijk en op voet van gelijkheid te concurreren bij het verzorgen van de
internationale luchtdiensten.
5 — Onder staatssubsidie of staatssteun wordt verstaan het op discriminatoire basis geven van
steun aan een aangewezen luchtvaartmaatschappij, direct of indirect, door de staat of een publiek
of privaat lichaam dat is aangewezen door of beheerst wordt door de staat. Dit kan bijvoorbeeld,
maar niet uitsluitend, het volgende omvatten: compensatie voor bedrijfsverliezen, het verschaffen
van kapitaal, subsidies of leningen op gunstige voorwaarden, het verlenen van financiële voordelen
door het achterwege laten van de inning van winsten of vorderingen, het afzien van een normale
beloning voor de aangewende openbare middelen, belastingvrijstellingen, vergoeding van door
overheden opgelegde financiële lasten, of discriminatoire toegang tot luchthavenfaciliteiten, bran-
dstoffen of andere faciliteiten die redelijkerwijs noodzakelijk zijn voor de normale exploitatie van
luchtdiensten.
6 — Wanneer een partij staatssubsidie of staatssteun verleent aan een aangewezen luchtva-
artmaatschappij met betrekking tot diensten die uit hoofde van dit Verdrag worden geëxploiteerd,
verlangt zij dat de luchtvaartmaatschappij de subsidie of steun duidelijk en afzonderlijk in haar
boekhouding vermeldt.
7 — Indien een partij gegronde redenen heeft voor bezorgdheid dat haar aangewezen lu-
chtvaartmaatschappijen worden onderworpen aan discriminatoire of oneerlijke praktijken, of dat
subsidie of steun die door de andere partij wordt overwogen of verleend nadelige gevolgen heeft
of zou hebben voor de eerlijke en gelijke wijze waarop de luchtvaartmaatschappijen van de eerste
partij in de gelegenheid worden gesteld te concurreren bij het verzorgen van de internationale lu-
chtdiensten, heeft deze partij het recht de uitoefening van de in artikel 2 omschreven rechten van
dit Verdrag door de door de andere partij aangewezen luchtvaartmaatschappij te schorsen, of de
exploitatievergunning in te trekken, of door haar nodig geachte voorwaarden te verbinden aan de
uitoefening van deze rechten.

Artikel 14
Goedkeuring van exploitatievoorwaarden
1 — De luchtvaartautoriteiten van de andere partij worden ten minste dertig (30) dagen voor
de uitvoering ervan in kennis gesteld van de dienstregelingen van de overeengekomen diensten
en hun exploitatievoorwaarden in het algemeen. De luchtvaartautoriteiten worden tevens in kennis
gesteld van elke belangrijke wijziging van dergelijke dienstregelingen of exploitatievoorwaarden. In
specifieke gevallen kan de hierboven vastgestelde termijn worden bekort onder voorbehoud van
toestemming door genoemde autoriteiten.
2 — De door een partij aangewezen luchtvaartmaatschappijen stellen de luchtvaartautoriteiten
van de andere partij ten minste vijf (5) werkdagen voor de beoogde uitvoering in kennis van kleine
wijzigingen of in geval van aanvullende vluchten. In specifieke gevallen kan deze termijn worden
bekort onder voorbehoud van toestemming door genoemde autoriteiten.
Artikel 15
Veiligheid
1 — Elke partij kan te allen tijde verzoeken om overleg inzake door de andere partij aanvaarde
veiligheidsnormen op elk gebied met betrekking tot bemanning, luchtvaartuigen of hun exploitatie.
Dergelijk overleg vindt plaats binnen dertig (30) dagen na dat verzoek.
2 — Indien een partij na dergelijk overleg oordeelt dat de andere partij op een willekeurig gebied
niet op doeltreffende wijze veiligheidsnormen handhaaft en toepast die ten minste gelijk zijn aan de
minimumnormen die op dat moment uit hoofde van het Verdrag van Chicago waren vastgesteld, stelt
de eerste partij de andere partij daarvan in kennis en van de noodzakelijk geachte stappen om te
voldoen aan die minimumnormen en neemt die andere partij passende corrigerende maatregelen.
Indien de andere partij nalaat binnen vijftien (15) dagen of binnen een langere termijn als overeen
te komen, passende maatregelen te nemen, is dit aanleiding voor de toepassing van artikel 4 van
dit Verdrag.
3 — Onverminderd de verplichtingen genoemd in artikel 33 van het Verdrag van Chicago, wordt
overeengekomen dat elk luchtvaartuig dat door een aangewezen luchtvaartmaatschappij van de ene
partij wordt gebruikt voor diensten naar of vanuit het grondgebied van de andere partij, terwijl het
zich op het grondgebied van de andere partij bevindt, mag worden onderworpen aan een inspectie
door de bevoegde vertegenwoordigers van de andere partij, aan boord en rond het luchtvaartuig
om zowel de geldigheid van de documenten van het luchtvaartuig als die van zijn bemanning en
de kennelijke toestand van het luchtvaartuig en zijn uitrusting te controleren (aangeduid als “pla-
tforminspectie”), mits dit niet leidt tot onredelijke vertraging.
4 — Indien een dergelijke platforminspectie of reeks platforminspecties leidt tot:
a) Ernstige bezorgdheid dat een luchtvaartuig of de exploitatie van een luchtvaartuig niet voldoet
aan de minimumnormen die op dat moment zijn vastgesteld uit hoofde van het Verdrag van Chicago; of
b) Ernstige bezorgdheid dat de op dat moment uit hoofde van het Verdrag van Chicago vast-
gestelde veiligheidsnormen onvoldoende worden gehandhaafd en vastgelegd;
staat het de partij die de inspectie verricht vrij, voor de toepassing van artikel 33 van het Verdrag
van Chicago, de conclusie te trekken dat de vereisten krachtens welke de bewijzen of de vergun-
ningen ten aanzien van dat luchtvaartuig of ten aanzien van de bemanning van dat luchtvaartuig
zijn afgegeven of geldig verklaard, of dat de vereisten uit hoofde waarvan dat luchtvaartuig wordt
geëxploiteerd niet gelijk zijn aan of zwaarder zijn dan de minimumnormen die zijn vastgesteld uit
hoofde van het Verdrag van Chicago.
5 — Ingeval toegang ten behoeve van de uitvoering van een platforminspectie in overeens-
temming met het derde lid van dit artikel van een door een luchtvaartmaatschappij van een partij
geëxploiteerd luchtvaartuig door de vertegenwoordiger van die aangewezen luchtvaartmaatschappij
wordt geweigerd, staat het de andere partij vrij daaruit af te leiden dat er aanleiding is voor ernstige

bezorgdheid als bedoeld in het vierde lid van dit artikel en de conclusies te trekken zoals bedoeld
in dat lid.
6 — Elke partij behoudt zich het recht voor de exploitatievergunning van een luchtvaartmaats-
chappij van de andere partij onmiddellijk te schorsen of daarvan af te wijken, ingeval de eerste partij
concludeert, hetzij naar aanleiding van een platforminspectie of reeks platforminspecties, weigering
van toegang voor platforminspectie, overleg of anderszins, dat onverwijld ingrijpen essentieel is
voor de veiligheid van de exploitatie door de luchtvaartmaatschappij.
7 — Een maatregel door een partij in overeenstemming met het tweede of zesde lid van dit
artikel wordt beëindigd zodra de aanleiding voor die maatregel ophoudt te bestaan.
8 — Indien de Portugese Republiek een luchtvaartmaatschappij heeft aangewezen en een
andere lidstaat van de Europese Unie controleert of deze de regelgeving naleeft, zijn de rechten
van de andere partij uit hoofde van dit artikel op dezelfde wijze van toepassing op de aanneming,
uitoefening of handhaving van veiligheidsnormen door die andere lidstaat van de Europese Unie
en op de exploitatievergunning van die luchtvaartmaatschappij.
Artikel 16
Beveiliging
1 — Overeenkomstig hun rechten en verplichtingen ingevolge het internationale recht,
bevestigen de partijen opnieuw dat hun verplichting jegens elkaar tot bescherming van de
veiligheid van de burgerluchtvaart tegen daden van wederrechtelijke inmenging een integre-
rend onderdeel uitmaakt van dit Verdrag. Zonder hun rechten en verplichtingen ingevolge het
internationale recht in het algemeen te beperken handelen de partijen in het bijzonder overe-
enkomstig de bepalingen van:
a) Het Verdrag inzake strafbare feiten en bepaalde andere handelingen begaan aan boord van
luchtvaartuigen, ondertekend te Tokio op 14 september 1963;
b) Het Verdrag tot bestrijding van het wederrechtelijk in zijn macht brengen van luchtvaartuigen,
ondertekend te ‘s-Gravenhage op 16 december 1970;
c) Het Verdrag tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van
de burgerluchtvaart, ondertekend te Montreal op 23 september 1971;
d) Het Aanvullend Protocol tot bestrijding van wederrechtelijke daden van geweld op luchthavens
voor de internationale burgerluchtvaart, ondertekend te Montreal op 24 februari 1988; en
e) Het Verdrag inzake het merken van kneedspringstoffen ten behoeve van de opsporing ervan,
ondertekend te Montreal op 1 maart 1991;
alsmede elk ander multilateraal verdrag inzake beveiliging van de luchtvaart waardoor beide partijen
gebonden zijn.
2 — De partijen handelen in hun onderlinge betrekkingen minimaal in overeenstemming met
de bepalingen inzake beveiliging van de luchtvaart vastgesteld door de Internationale Burger-
luchtvaartorganisatie en aangeduid als Bijlagen bij het Verdrag van Chicago, voor zover deze
beveiligingsbepalingen van toepassing zijn op de partijen; zij verlangen dat exploitanten van
luchtvaartuigen die in hun land geregistreerd zijn of die hun voornaamste plaats van bedrijfsuito-
efening hebben of gevestigd zijn op het grondgebied van de partijen hebben of, in het geval van
de Portugese Republiek, exploitanten van luchtvaartuigen die op haar grondgebied gevestigd
zijn overeenkomstig de EU-verdragen en over een geldige exploitatievergunning beschikken in
overeenstemming met het recht van de Europese Unie, en de exploitanten van luchthavens op
hun grondgebied handelen in overeenstemming met deze bepalingen inzake beveiliging van de
luchtvaart.
3 — De partijen verlenen elkaar op verzoek alle nodige bijstand ter voorkoming van gedragingen
van het wederrechtelijk in zijn macht brengen van burgerluchtvaartuigen en andere wederrechtelijke
gedragingen gericht tegen de veiligheid van deze luchtvaartuigen, de passagiers en bemanning

ervan, luchthavens en luchtvaartvoorzieningen, alsmede elke andere bedreiging voor de veiligheid
van de burgerluchtvaart.
4 — Elke partij stemt ermee in dat van haar exploitanten van luchtvaartuigen kan worden
verlangd dat deze de in het tweede lid van dit artikel bedoelde bepalingen inzake de beveiliging
van de luchtvaart in acht nemen die door de andere partij zijn voorgeschreven voor binnenkomst
op het grondgebied van de andere partij en voor vertrek uit of verblijf op het grondgebied van die
andere partij. Voor het vertrek uit of het verblijf op het grondgebied van de Portugese Republiek
wordt van exploitanten van luchtvaartuigen verlangd dat zij de bepalingen inzake veiligheid van de
luchtvaart in acht nemen overeenkomstig het recht van de Europese Unie. Elke partij waarborgt
dat op haar grondgebied adequate maatregelen op doeltreffende wijze worden uitgevoerd om
de luchtvaartuigen te beschermen en dat passagiers, bemanning, handbagage, bagage, vracht
en proviand vóór en tijdens het aan boord gaan of het laden aan controles worden onderworpen.
Elke partij neemt tevens elk verzoek van de andere partij binnen redelijke grenzen bijzondere
veiligheidsmaatregelen te nemen om een specifieke dreiging het hoofd te bieden, in welwillende
overweging.
5 — Wanneer een incident van het wederrechtelijk in zijn macht brengen van een burgerlu-
chtvaartuig of andere wederrechtelijke gedragingen tegen de veiligheid van een dergelijk burger-
luchtvaartuig, zijn passagiers en bemanning, luchthavens of luchtvaartvoorzieningen plaatsvindt
of dreigt plaats te vinden, verlenen de partijen elkaar bijstand door het vergemakkelijken van de
communicatie en andere passende maatregelen teneinde snel en veilig een einde te maken aan
een dergelijk incident of dergelijke dreiging.
6 — Wanneer een partij redelijke gronden heeft om aan te nemen dat de andere partij is af-
geweken van de bepalingen inzake de beveiliging van de luchtvaart in dit artikel, kan de eerste partij
verzoeken om onverwijld overleg met de luchtvaartautoriteiten van de andere partij.
Artikel 17
Verstrekken van statistieken
De luchtvaartautoriteiten van een partij voorzien de luchtvaartautoriteiten van de andere partij
op hun verzoek van de statistieken die redelijkerwijs verlangd kunnen worden voor informatiedoe-
leinden.
Artikel 18
Tarieven
1 — De tarieven die door de aangewezen luchtvaartmaatschappijen van een partij in rekening
worden gebracht voor vervoer naar en van het grondgebied van de andere partij worden op een
redelijk niveau vastgesteld, waarbij naar behoren rekening wordt gehouden met alle relevante
factoren, met inbegrip van de exploitatiekosten, een redelijke winst en de tarieven van andere lu-
chtvaartmaatschappijen die dezelfde route geheel of deels exploiteren.
2 — De tarieven worden ten minste dertig (30) dagen voor de voorgestelde datum van ingang
ter goedkeuring ingediend bij de luchtvaartautoriteiten van beide partijen. In specifieke gevallen
kan deze termijn worden bekort onder voorbehoud van toestemming door genoemde autoriteiten.
3 — Deze goedkeuring kan schriftelijk worden gegeven. Indien geen van de luchtvaartau-
toriteiten binnen vijfentwintig (25) dagen na de datum van indiening overeenkomstig het tweede
lid van dit artikel hun afkeuring van de voorgestelde tarieven heeft uitgesproken, worden deze
tarieven als goedgekeurd beschouwd. In het geval van verkorting van de indieningstermijn, zoals
bepaald in het tweede lid van dit artikel, kunnen de luchtvaartautoriteiten overeenkomen dat de
termijn waarbinnen van elke afkeuring kennis moet worden gegeven, minder dan vijfentwintig
(25) dagen bedraagt.
4 — Indien tijdens de overeenkomstig het derde lid van dit artikel van toepassing zijnde
termijn een luchtvaartautoriteit de andere luchtvaartautoriteit in kennis stelt van haar afkeuring

van een tarief, trachten de luchtvaartautoriteiten van beide partijen in onderling overleg het
tarief vast te stellen.
5 — Indien de luchtvaartautoriteiten geen overeenstemming kunnen bereiken over een tarief dat
hun krachtens het tweede lid van dit artikel wordt voorgelegd, of over de vaststelling van een tarief
krachtens het vierde lid van dit artikel, wordt het geschil geregeld overeenkomstig de bepalingen
van artikel 21 van dit Verdrag.
6 — Een tarief dat is vastgesteld in overeenstemming met de bepalingen van dit artikel
blijft van kracht totdat een nieuw tarief wordt vastgesteld. Een tarief wordt echter niet langer
dan twaalf (12) maanden na de datum waarop het anders zou zijn verstreken, verlengd uit
hoofde van dit lid.
7 — De partijen kunnen ingrijpen om een tarief af te keuren. Dit recht is beperkt tot:
a) Het beschermen van consumenten tegen tarieven die onredelijk hoog zijn als gevolg van
misbruik van marktmacht;
b) Het voorkomen van tarieven waarvan de toepassing concurrentiebeperkend gedrag vormt
dat de concurrentie belemmert, beperkt of verstoort of een concurrent buiten een route houdt, of dit
hoogstwaarschijnlijk tot gevolg heeft of uitdrukkelijk ten doel heeft.
Artikel 19
Overleg
1 — De luchtvaartautoriteiten van elke partij voeren, wanneer het nodig is, overleg om te
waarborgen dat nauw wordt samengewerkt bij alle kwesties met betrekking tot de uitlegging en
toepassing van dit Verdrag, op verzoek van een van de partijen.
2 — Dergelijk overleg vangt aan binnen een termijn van vijfenveertig (45) dagen na de datum van
ontvangst van het schriftelijke verzoek.
Artikel 20
Wijzigingen
1 — Indien een van de partijen het wenselijk acht een bepaling van dit Verdrag te wijzigen,
kan zij te allen tijde verzoeken om overleg met de andere partij. Dergelijk overleg vangt aan binnen
een termijn van zestig (60) dagen na de datum van ontvangst van het schriftelijk verzoek door de
andere partij.
2 — Indien een partij het wenselijk acht een bepaling van dit Verdrag te wijzigen, wordt deze
wijziging door de partijen overeengekomen, schriftelijk langs diplomatieke weg bevestigd en treedt
zij in werking overeenkomstig artikel 25 van dit Verdrag.
3 — Niettegenstaande de bepalingen van het tweede lid van dit artikel, kunnen wijzigingen van
de Bijlage bij dit Verdrag tussen de luchtvaartautoriteiten van de partijen worden overeengekomen
en bij diplomatieke notawisseling worden bevestigd. Deze treden in werking op een in de diploma-
tieke notawisseling te bepalen datum. Deze uitzondering op het tweede lid van dit artikel is niet van
toepassing indien er verkeersrechten worden toegevoegd aan de Bijlage.
Artikel 21
Regeling van geschillen
1 — Indien er tussen de partijen een geschil ontstaat met betrekking tot de uitlegging of to-
epassing van dit Verdrag, trachten de partijen dit in de eerste plaats langs diplomatieke weg te
regelen.
2 — Indien de partijen er niet in slagen door middel van onderhandelingen tot een regeling te
komen, kunnen zij overeenkomen het geschil ter beslissing aan een entiteit voor te leggen of het
geschil kan op verzoek van een van de partijen ter beslissing worden voorgelegd aan een gerecht

van drie scheidsmannen, van wie elke partij er een benoemt en de derde wordt benoemd door de
twee aldus benoemde scheidsmannen.
3 — Elk van de partijen benoemt een scheidsman binnen een termijn van zestig (60) dagen na
de datum waarop de ene partij van de andere partij langs diplomatieke weg een kennisgeving heeft
ontvangen waarin om een scheidsrechterlijke uitspraak wordt verzocht en de derde scheidsman
dient te worden benoemd binnen een volgende termijn van zestig (60) dagen.
4 — Indien een van de partijen nalaat een scheidsman te benoemen binnen de aangegeven
termijn of indien de derde scheidsman niet binnen de aangegeven termijn is benoemd, kan de
President van de Raad van de Internationale Burgerluchtvaart door een van de partijen worden
verzocht een scheidsman of scheidsmannen te benoemen, naargelang van het geval. In dat geval
dient de derde scheidsrechter onderdaan te zijn van een derde staat en op te treden als voorzitter
van het scheidsgerecht.
5 — De partijen verplichten zich ertoe zich te houden aan elke beslissing genomen op grond
van het tweede lid van dit artikel.
6 — Indien en zo lang een van de partijen niet voldoet aan een uit hoofde van het tweede lid
van dit artikel genomen beslissing, kan de andere partij alle rechten of voorrechten die zij uit hoofde
van dit Verdrag heeft toegekend aan de in gebreke blijvende partij of in gebreke blijvende luchtva-
artmaatschappij beperken, schorsen of intrekken.
7 — Elke partij betaalt de kosten van de door haar benoemde scheidsman. De overige kosten
van het scheidsgerecht worden door de partijen gelijkelijk gedeeld.
Artikel 22
Duur en beëindiging
1 — Dit Verdrag blijft voor onbepaalde tijd van kracht.
2 — Elk van de partijen kan te allen tijde de andere partij langs diplomatieke weg schriftelijk
in kennis stellen van haar besluit dit Verdrag te beëindigen. Deze kennisgeving wordt tegelijkertijd
toegezonden aan de Internationale Burgerluchtvaartorganisatie.
3 — Dit Verdrag treedt twaalf (12) maanden na de datum waarop de kennisgeving door de an-
dere partij is ontvangen buiten werking, tenzij de kennisgeving van beëindiging vóór het verstrijken
van deze termijn met wederzijdse instemming wordt ingetrokken.
4 — Indien de andere partij nalaat de ontvangst van de kennisgeving te bevestigen, wordt de
kennisgeving geacht te zijn ontvangen veertien (14) dagen na ontvangst van die kennisgeving door
de Internationale Burgerluchtvaartorganisatie.
Artikel 23
Registratie
Dit Verdrag en elke eventuele wijziging daarvan worden geregistreerd bij de Internationale
Burgerluchtvaartorganisatie.
Artikel 24
Toepasselijkheid van het verdrag
Wat het Koninkrijk der Nederlanden betreft, is dit Verdrag uitsluitend van toepassing op Curaçao.
Artikel 25
Inwerkingtreding
Dit Verdrag treedt in werking op de eerste dag van de tweede maand na de datum van on-
tvangst van de laatste schriftelijke kennisgeving langs diplomatieke weg waarin de twee partijen

elkaar ervan in kennis hebben gesteld aan de vereisten voor de inwerkingtreding van dit Verdrag
uit hoofde van hun onderscheiden wettelijke procedures is voldaan.
Ten blijke waarvan, de ondergetekenden, daartoe naar behoren gemachtigd door hun respec-
tieve regeringen, dit Verdrag hebben ondertekend.
Gedaan te Lissabon, 25 juni 2019, in drie originelen, in de Engelse, de Nederlandse en de
Portugese taal, waarbij alle teksten gelijkelijk authentiek zijn. In geval van verschil in interpretatie
van de bepalingen van dit Verdrag is de Engelse versie doorslaggevend.

4 — Het uitoefenen van vijfde vrijheidsverkeersrechten op aangegeven tussenliggende en/of verder gelegen pun-
ten dient te worden goedgekeurd door de luchtvaartautoriteiten van beide partijen en kan in een regeling worden afges-
proken.

AGREEMENT ON AIR TRANSPORT BETWEEN THE PORTUGUESE REPUBLIC AND THE KINGDOM
OF THE NETHERLANDS, IN RESPECT OF CURAÇAO
The Portuguese Republic and the Kingdom of the Netherlands, in respect of Curaçao (herein-
after referred to as “the Parties”):
Being Parties to the Convention on International Civil Aviation, opened for signature at Chicago
on 7 December 1944;
Desiring to organize, in a safe and orderly manner, International Air Services and to promote
in the greatest possible measure international cooperation in respect of such services; and
Desiring to establish an Agreement to foster the development of scheduled Air Services between
and beyond their Territories;
have agreed as follows:
Article 1
Definitions
For the purpose of this Agreement:
a) The term “Convention” shall mean the Convention on International Civil Aviation, opened
for signature at Chicago on 7 December 1944, including any Annex adopted under article 90 of the
Convention and any amendment of the Annexes or the Convention under articles 90 and 94 thereof,
so far as those Annexes and amendments have been adopted by both Parties;
b) The term “EU Treaties” shall mean the Treaty on the European Union and the Treaty on the
Functioning of the European Union;
c) the term “Aeronautical Authorities” shall mean, in the case of the Portuguese Republic, the
Civil Aviation Authority; in the case of the Kingdom of the Netherlands, in respect of Curaçao, the
Minister responsible for Civil Aviation; or, in both cases, any person or body authorized to perform
any functions at present exercised by the said authorities or similar functions;
d) The term “Designated Airline” shall mean any Airline, which has been designated and author-
ized in accordance with article 3 of this Agreement;
e) The term “Territory” shall have the meaning assigned to it in article 2 of the Convention;
f) The terms “Air Service”, “International Air Service”, “Airline” and “Stop for Non-Traffic purposes”
shall have the meanings assigned to them in article 96 of the Convention;
g) The term “Tariff” shall mean the prices to be paid for the carriage of passengers, baggage and
cargo and the conditions under which those prices apply, including prices and conditions for agency
and other ancillary services, but excluding remuneration or conditions for the carriage of mail; and
h) The term “Annex” shall mean the Route Schedule attached to this Agreement and any
Clauses or Notes appearing in such Annex.
Article 2
Operating rights
1 — Each Party grants to the other Party the following rights in respect of International Air
Services conducted by the Designated Airlines of the other Party:
a) The right to fly across its Territory without landing; and
b) The right to make stops in its Territory for Non-Traffic purposes.
2 — Each Party grants to the other Party the rights hereinafter specified in this Agreement
for the purpose of operating scheduled International Air Services on the routes specified in the ap-
propriate Section of the Route Schedule annexed to this Agreement. Such services and routes are
hereinafter called “the Agreed Services” and “the Specified Routes” respectively. While operating an

Agreed Service on a Specified Route the Airlines designated by each Party shall enjoy in addition
to the rights specified in paragraph 1 of this article and subject to the provisions of this Agreement,
the right to make stops in the Territory of the other Party at the points specified for that route in the
Route Schedule to this Agreement for the purpose of taking on board and disembarking passengers,
baggage, cargo and mail.
3 — Nothing in paragraph 2 of this article shall be deemed to confer on the Designated Airlines
of one Party the right of embarking, in the Territory of the other Party, traffic carried for remuneration
or hire and destined for another point in the Territory of that Party.
4 — If the Designated Airlines of one Party are unable to operate Air Services on its normal
routing because of armed conflict, political disturbances, or special and unusual circumstances the
other Party shall make its best efforts to facilitate the continued operation of such services through
appropriate rearrangements of such routes, including the grant of rights for such time as may be
necessary to facilitate viable operations. The provisions of this norm shall be applied without dis-
crimination between the Designated Airlines of the Parties.
Article 3
Designation and operating authorization of airlines
1 — Each Party shall have the right to designate in writing to the other Party, Airlines for the
purpose of operating the Agreed Services on the Specified Routes in the Annex and to withdraw or
alter such designations. Those designations shall be made in writing and shall be transmitted to the
other Party through diplomatic channels.
2 — Upon receipt of the notice of such designation, and of applications from a Designated
Airline, in the form and manner prescribed for operating authorizations and technical permissions,
the other Party shall grant to the Airline designated the appropriate operating authorizations and
permissions with minimum procedure delay, provided that:
a) In the case of an Airline designated by the Portuguese Republic:
i) The Airline is established in the Territory of the Portuguese Republic under the EU Treaties
and has a valid Operating Licence in accordance with the law of the European Union; and
ii) Effective regulatory control of the Airline is exercised and maintained by the European Union
Member State responsible for issuing its Air Operator’s Certificate and the relevant Aeronautical
Authority is clearly identified in the designation; and
iii) The Airline is owned, directly or through majority ownership, and it is effectively controlled by
Member States of the European Union or the European Free Trade Association and/or by nationals
of such States;
b) In the case of an Airline designated by Curaçao:
i) The Airline is established in the Territory of Curaçao and has a valid Operating Licence in
accordance with the applicable law of Curaçao; and
ii) Effective regulatory control of the Airline is exercised and maintained by Curaçao and Curaçao
is responsible for issuing its Air Operator’s Certificate and the relevant Aeronautical Authority is
clearly identified in the designation; and
iii) The Airline is owned, directly or through majority ownership, and it is effectively controlled
by Curaçao and/or by its nationals;
c) The Designated Airline is qualified to meet the conditions prescribed under the legislation
normally applied to the operation of International Air Services by the Party considering the applica-
tion or applications.

Article 4
Refusal, revocation, suspension or limitation of rights
1 — Each Party shall have the right to refuse, revoke, suspend or limit the operating authori-
zations or technical permissions of an Airline designated by the other Party of the rights specified
in article 2 of this Agreement, or to submit the exercise of those rights to the conditions considered
necessary, where:
a) In the case of an Airline designated by the Portuguese Republic:
i) The Airline is not established in the Territory of the Portuguese Republic under the EU Treaties
or does not have a valid Operating Licence in accordance with the law of the European Union; or
ii) Effective regulatory control of the Designated Airline is not exercised or not maintained by the
European Union Member State responsible for issuing its Air Operator’s Certificate or the relevant
Aeronautical Authority is not clearly identified in the designation; or
iii) The Airline is not owned, directly or through majority ownership, or it is not effectively con-
trolled by Member States of the European Union or the European Free Trade Association and/or
by nationals of such States;
b) In the case of an Airline designated by Curaçao:
i) The Airline is not established in the Territory of Curaçao or does not have a valid Operating
Licence in accordance with the applicable law; or
ii) Effective regulatory control of the Designated Airline is not exercised or not maintained by
Curaçao or Curaçao is not responsible for issuing its Air Operator’s Certificate or the relevant Aero-
nautical Authority is not clearly identified in the designation; or
iii) The Airline is not owned, directly or through majority ownership, or it is not effectively con-
trolled by Curaçao and/or by its nationals;
c) In the case the Designated Airline fails to meet the conditions prescribed under the legis-
lation normally applied to the operation of International Air Services by the Party considering the
application or applications; or
d) In the case of failure by such Designated Airline to comply with the legislation of the Party
granting the authorization or permission; or
e) In the case the Designated Airline fails to operate the Agreed Services in accordance with
the conditions prescribed under this Agreement and the Annex attached hereto.
2 — Unless immediate refusal, revocation, suspension, limitation or imposition of the condi-
tions mentioned in paragraph 1 of this article is essential to prevent further infringements of the
legislation, the right to refuse, revoke, suspend, limit or impose conditions shall be exercised only
after consultation with the other Party. The consultations shall take place within a period of thirty
(30) days from the date of receipt of the request unless otherwise agreed.
Article 5
Application of legislation and procedures
1 — The legislation and procedures of one Party relating to the admission to, sojourn in or
departure from its Territory of aircraft engaged in International Air Services, or to the operation and
navigation of such aircraft while within its Territory, shall be applied to the aircraft of both Parties
upon entering into or departing from or while within the Territory of the first Party.
2 — The legislation and procedures of one Party relating to the admission to, sojourn in, tran-
sit and departure from its Territory of passengers, crew, baggage, cargo and mail transported on
board the aircraft, such as legislation relating to entry, clearance, immigration, passports, customs
and sanitary control, shall be complied with by the Airline of the other Party, or on behalf of such

passengers, crew, entity entitled of baggage, cargo and mail upon entrance into or departure from
or while within the Territory of this Party.
Article 6
Exemption from customs duties and other charges
1 — Aircraft operating on International Air Services by the Designated Airline of either Party,
as well as their regular equipment, spare parts, supplies of fuels and lubricants, other consumable
technical supplies and aircraft stores (including food, beverages and tobacco) on board such aircraft
shall be exempt from all customs duties, inspection fees and other similar charges on arriving in the
Territory of the other Party, provided such equipment, supplies and aircraft stores remain on board
the aircraft up to such time as they are re-exported or are used on the part of the journey performed
over that Territory.
2 — In addition, the following shall also be exempt from the same duties, fees and taxes, with
the exception of charges corresponding to the services performed:
a) Aircraft stores taken on board in the Territory of a Party, within limits fixed by the authorities
of the said Party, and for use on board outbound aircraft engaged in an International Air Service by
the Designated Airlines of the other Party;
b) Spare parts and regular equipment brought into the Territory of either Party for the maintenance
or repair of aircraft used on International Air Services by the Designated Airlines of the other Party;
c) Fuels, lubricants and other consumable technical supplies destined to the supply outbound
aircraft operated on International Air Services by the Designated Airlines of the other Party, even
when these supplies are to be used on the part of the journey performed over the Territory of the
Party in which they are taken on board.
3 — All materials referred to in paragraph 2 of this article may be required to be kept under
customs supervision or control.
4 — The regular airborne equipment, as well as the materials and supplies retained on board
the aircraft operated by the Designated Airline of either Party, may be unloaded in the Territory of
the other Party only with the approval of the customs authorities of that Party. In such cases, they
may be placed under the supervision of the said customs authorities up to such time as they are
re-exported or otherwise disposed of in accordance with customs regulations.
5 — The exemptions provided for by this article shall also be available in situations where
the Designated Airlines of either Party have entered into arrangements with another Airline or
Airlines for the loan or transfer in the Territory of the other Party of the items specified in para-
graphs 1 and 2 of this article, provided such other Airline or Airlines similarly enjoy such exemp-
tions from such other Party.
6 — Nothing in this Agreement shall prevent the Portuguese Republic from imposing, on a non-
-discriminatory basis, taxes, levies, duties, fees or charges on fuel supplied in its Territory for use in
an aircraft of a Designated Airline of Curaçao that operates between a point in the Territory of the
Portuguese Republic and another point in the Territory of the Portuguese Republic or in the Territory of
another European Union Member State.
Article 7
User charges
1 — Each Party may impose or permit to be imposed just and reasonable charges for the use
of airports, other facilities and Air Services under its control.
2 — Those charges shall not be higher than the charges imposed upon aircraft of the Desig-
nated Airlines of each Party engaged in similar International Air Services.

Article 8
Traffic in direct transit
Traffic in direct transit across the Territory of either Party and not leaving the area of the airport
reserved for such purpose shall, except in respect of security measures against the threat of unlawful
interference, such as violence and air piracy and occasional measures for the combat of illicit drug
traffic, be subject to no more than a simplified control. Baggage and cargo in direct transit shall be
exempt from custom duties, charges and other similar taxes.
Article 9
Recognition of certificates and licences
1 — Certificates of airworthiness, certificates of competency and licences issued, or rendered
valid, in accordance with the legislation and procedures of one Party, including, in the case of the
Portuguese Republic, European Union laws and regulations, and unexpired shall be recognised as
valid by the other Party for the purpose of operating the Agreed Services, provided always that the
requirements under which such certificates and licences were issued, or rendered valid, are equal
to or above the minimum standards established pursuant to the Convention.
2 — Paragraph 1 of this article also applies with respect to an Airline designated by the Portu-
guese Republic whose regulatory control is exercised and maintained by another European Union
Member State.
3 — Each Party reserves the right to refuse to recognize, for flights above its own Territory,
certificates of competency and licences granted to or validated for its own nationals by the other
Party or by any other State.
Article 10
Commercial representation
1 — The Designated Airlines of each Party shall be allowed:
a) To establish in the Territory of the other Party offices for the promotion of air transportation
and sale of air tickets as well as, in accordance with the legislation of such other Party, other facili-
ties required for the provision of air transportation;
b) To bring in and maintain in the Territory of the other Party — in accordance with the legisla-
tion of such other Party relating to entry, residence and employment — managerial, sales, technical,
operational and other specialist staff required for the provision of air transportation; and
c) In the Territory of the other Party to engage directly and, at the Airlines discretion, through
its agents in the sale of air transportation.
2 — The competent authorities of each Party shall take all necessary steps to ensure that
the representation of the Airlines designated by the other Party may exercise their activities in an
orderly manner.
Article 11
Commercial activities
1 — The Designated Airlines of each Party shall have the right to sell, in the Territory of the
other Party, air transportation and any person shall be free to purchase such transportation in the
currency of that Territory or in freely convertible currencies of other states in accordance with the
foreign exchange regulations in force.
2 — For the commercial activities all principles mentioned in paragraph 1 of this article shall
apply to the Designated Airlines of both Parties.

Article 12
Conversion and transfer of revenues
1 — Each Party grants to the Designated Airlines of the other Party the right of free transfer at
the official rate of currency exchange, of revenues tax exempted and of the excess sums of receipts
over expenditures achieved in connection with the carriage of passengers, baggage, cargo and mail
on the Agreed Services in its Territory, and in accordance with the applicable domestic law in the
Territory of the Party from which the transfer is made.
2 — For the purpose of this article, the applicable domestic law of the Portuguese Republic
includes all measures taken by the European Union.
Article 13
Fair competition
1 — Each Party shall allow fair and equal opportunity for the Designated Airlines of both Parties
to operate the Agreed Services on the Specified Routes.
2 — Each Party shall allow each Designated Airline to determine the frequency and capacity
of the International Air Service it offers based upon commercial considerations in the marketplace.
Consistent with this right, neither Party shall unilaterally limit the volume of traffic, frequency or
regularity of service, or the aircraft type or types operated by the Airlines designated by the other
Party, except as may be required for customs, technical, operational or environmental reasons under
uniform conditions consistent with article 15 of the Convention.
3 — Neither Party shall allow its Designated Airline or Airlines, either in conjunction with any other
Airline or Airlines or separately, to abuse market power in a way which has or is likely or intended to
have the effect of severely weakening a competitor or excluding a competitor from a route.
4 — Neither Party shall provide or permit state subsidy or support for or to its Designated Airline
or Airlines in such way that would adversely affect the fair and equal opportunity of the Airlines of
the other Party to compete in providing International Air Service.
5 — State subsidy or support means the provision of support on a discriminatory basis to a
Designated Airline, directly or indirectly, by the state or by a public or private body designated or
controlled by the state. Without limitation, it may include the setting-off of operational losses; the
provision of capital, non-refundable grants or loans on privileged terms; the granting of financial
advantages by forgoing profits or the recovery of sums due; the forgoing of a normal return on public
funds used; tax exemptions; compensation for financial burdens imposed by the public authorities;
or discriminatory access to airport facilities, fuels or other reasonable facilities necessary for the
normal operation of Air Services.
6 — Where a Party provides state subsidy or support to a Designated Airline in respect of
services operated under this Agreement, it shall require that Airline to identify the subsidy or support
clearly and separately in its accounts.
7 — If one Party has substantiated concerns that its Designated Airlines are being subjected
to discrimination or unfair practices, or that a subsidy or support being considered or provided by
the other Party would adversely affect or is adversely affecting the fair and equal opportunity of the
Airlines of the first Party to compete in providing International Air Service, it shall have the right to
suspend the exercise of the rights specified in article 2 of this Agreement by the Airline designated
by the other Party, or to revoke the operating authorization, or to impose such conditions as it may
deem necessary on the exercise of these rights.
Article 14
Approval of conditions of operation
1 — The timetables of the Agreed Services and in general the conditions of their operation
shall be notified to the Aeronautical Authorities of the other Party, at least thirty (30) days before the
intended date of their implementation. Any significant modification to such timetables or conditions

of their operation shall also be notified to the Aeronautical Authorities. In special cases, the above
set time limit may be reduced subject to the agreement of the said authorities.
2 — For minor modifications or in case of supplementary flights, the Designated Airlines of one
Party shall notify the Aeronautical Authorities of the other Party, at least five (5) working days before
their intended operation. In special cases, this time limit may be reduced subject to agreement of
the said authorities.
Article 15
Safety
1 — Each Party may request consultations at any time concerning safety standards in any area
relating to aircrew, aircraft or their operation adopted by the other Party. Such consultations shall
take place within thirty (30) days of that request.
2 — If, following such consultations, one Party finds that the other Party does not effectively
maintain and administer safety standards in any such area that are at least equal to the minimum
standards established at that time pursuant to the Convention, the first Party shall notify the other
Party of those findings and the steps considered necessary to conform with those minimum stand-
ards, and that other Party shall take appropriate corrective action. Failure by the other Party to take
appropriate action within fifteen (15) days or such longer period as may be agreed, shall be grounds
for the application of article 4 of this Agreement.
3 — Notwithstanding the obligations mentioned in article 33 of the Convention it is agreed that
any aircraft operated by the Designated Airlines of one Party on services to or from the Territory of the
other Party may, while within the Territory of the other Party, be made the subject of an examination
by the authorized representatives of the other Party, on board and around the aircraft to check both
the validity of the aircraft documents and those of its crew and the apparent condition of the aircraft
and its equipment (called “ramp inspection”), provided this does not lead to unreasonable delay.
4 — If any such ramp inspection or series of ramp inspections gives rise to:
a) Serious concerns that an aircraft or the operation of an aircraft does not comply with the
minimum standards established at that time pursuant to the Convention; or
b) Serious concerns that there is a lack of effective maintenance and administration of safety
standards established at that time pursuant to the Convention,
the Party carrying out the inspection shall, for the purposes of article 33 of the Convention, be free
to conclude that the requirements under which the certificate or licences in respect of that aircraft
or in respect of the crew of that aircraft had been issued or rendered valid, or that the requirements
under which that aircraft is operated, are not equal to or above the minimum standards established
pursuant to the Convention.
5 — In the event that access for the purpose of undertaking a ramp inspection of an aircraft
operated by a Designated Airline of one Party in accordance with paragraph 3 of this article is denied
by the representative of that Designated Airline, the other Party shall be free to infer that serious
concerns of the type referred to in paragraph 4 of this article arise and draw the conclusions referred
in that paragraph.
6 — Each Party reserves the right to suspend or vary the operating authorization of a Designated
Airline of the other Party immediately in the event the first Party concludes, whether as a result of a
ramp inspection, a series of ramp inspections, a denial of access for ramp inspection, consultations
or otherwise, that immediate action is essential to the safety of the Airlines’ operation.
7 — Any action by one Party in accordance with paragraphs 2 or 6 of this article shall be dis-
continued once the basis for the taking of that action ceases to exist.
8 — Where the Portuguese Republic has designated an Airline whose regulatory control is
exercised and maintained by another European Union Member State, the rights of the other Party
under this article shall apply equally in respect of the adoption, exercise or maintenance of safety
standards by that other European Union Member State and in respect of the operating authoriza-
tion of that Airline.

Article 16
Security
1 — Consistent with their rights and obligations under international law, the Parties reaffirm that
their obligation to each other to protect the security of civil aviation against acts of unlawful interference
forms an integral part of this Agreement. Without limiting the generality of their rights and obligations
under international law, the Parties shall in particular act in conformity with the provisions of:
a) The Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed
at Tokyo on 14 September 1963;
b) The Convention for the Suppression of Unlawful Seizure of Aircraft, signed at The Hague
on 16 December 1970;
c) The Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation,
signed at Montreal on 23 September 1971;
d) Its Supplementary Protocol for the Suppression of Unlawful Acts of Violence at Airports
Serving International Civil Aviation, signed at Montreal on 24 February 1988; and
e) The Convention on the Marking of Plastic Explosives for the Purpose of Detection, signed
at Montreal on 1 March 1991;
and any other multilateral agreement governing aviation security binding upon both Parties.
2 — The Parties shall, in their mutual relations, act as a minimum, in conformity with the aviation
security provisions established by the International Civil Aviation Organization and designated as
Annexes to the Convention to the extent that such security provisions are applicable to the Parties;
they shall require that operators of aircraft of their registry or operators of aircraft which have their
principal place of business or permanent residence in the Territory of the Parties or are established
in the Territory of the Parties, or, in the case of the Portuguese Republic, operators of aircraft which
are established in its Territory under the EU Treaties and have received valid Operating Licences in
accordance with European Union Law, and the operators of airports in their Territory act in conformity
with such aviation security provisions.
3 — The Parties shall provide upon request all necessary assistance to each other to prevent
acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft,
their passengers and crew, airports and air navigation facilities, and any other threat to the security
of civil aviation.
4 — Each Party agrees that its operators of aircraft shall be required to observe the aviation
security provisions referred to in paragraph 2 of this article required by the other Party for entry
into the Territory of that other Party and also for departure from, or while within, the Territory of the
other Party. For departure from, or while within, the Territory of the Portuguese Republic, operators
of aircraft shall also be required to observe aviation security provisions in conformity with Euro-
pean Union law. Each Party shall ensure that adequate measures are effectively applied within its
Territory to protect the aircraft and to inspect passengers, crew, carry-on items, baggage, cargo
and aircraft stores prior to and during boarding or loading. Each Party shall also give sympathetic
consideration to any request from the other Party for reasonable special security measures to meet
a particular threat.
5 — When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful
acts against the safety of such aircraft, their passengers and crew, airports or air navigation facili-
ties occurs, the Parties shall assist each other by facilitating communications and other appropriate
measures intended to terminate rapidly and safely such incident or threat thereof.
6 — When a Party has reasonable grounds to believe that the other Party has departed from
the security provisions of this article, the first Party may request immediate consultations with the
Aeronautical Authorities of the other Party.

Article 17
Provision of statistics
The Aeronautical Authorities of one Party shall supply the Aeronautical Authorities of the other
Party, at their request, with such statistics as may be reasonably required for information purposes.
Article 18
Tariffs
1 — The Tariffs to be charged by the Designated Airlines of one Party for carriage to or from
the Territory of the other Party shall be established at reasonable levels, due regard being paid to
all relevant factors, including cost of operation, reasonable profit and the Tariffs of other Airlines
operating the whole or part of the same route.
2 — The Tariffs shall be submitted for the approval of the Aeronautical Authorities of both Parties
at least thirty (30) days before the proposed date of their introduction. In special cases, this period
may be reduced, subject to the agreement of the said authorities.
3 — This approval may be given in writing. If neither of the Aeronautical Authorities has ex-
pressed disapproval of the proposed Tariffs within twenty-five (25) days from the date of submission,
in accordance with paragraph 2 of this article, these Tariffs shall be considered as approved. In the
event of the period for submission being reduced, as provided for in paragraph 2 of this article, the
Aeronautical Authorities may agree that the period within which any disapproval must be notified
shall be less than twenty-five (25) days.
4 — If during the period applicable in accordance with paragraph 3 of this article, one Aeronauti-
cal Authority gives the other Aeronautical Authority notice of its disapproval of any Tariff, the Aero-
nautical Authorities of the two Parties shall endeavour to determine the Tariff by mutual agreement.
5 — If the Aeronautical Authorities cannot agree on any Tariff submitted to them under para-
graph 2 of this article, or on the determination of any Tariff under paragraph 4 of this article, the
dispute shall be settled in accordance with the provisions of article 21 of this Agreement.
6 — A Tariff established in accordance with the provisions of this article shall remain in force
until a new Tariff has been established. Nevertheless, a Tariff shall not be prolonged by virtue of this
paragraph for more than twelve (12) months after the date on which it otherwise would have expired.
7 — The Parties may intervene to disapprove a Tariff. This intervention shall be limited to:
a) The protection of consumers from Tariffs that are excessive due to the abuse of market power;
b) The prevention of Tariffs whose application constitutes anti-competitive behaviour which has
or is likely to have or is explicitly intended to have the effect of preventing, restricting or distorting
competition or excluding a competitor from the route.
Article 19
Consultations
1 — The Aeronautical Authorities of each Party shall consult each other whenever it becomes
necessary, in order to ensure close cooperation concerning all the issues related to the interpreta-
tion and application of this Agreement, on request of either Party.
2 — Such consultations shall begin within a period of forty five (45) days from the date the other
Party has received the written request.
Article 20
Amendments
1 — If either Party considers it desirable to amend any provision of this Agreement, it may at
any time request negotiations with the other Party. Such negotiations shall begin within a period of
sixty (60) days from the date the other Party has received the written request.

2 — If either Party considers it desirable to amend any provision of this Agreement, such
amendment shall be agreed upon by the parties, confirmed in writing through diplomatic channels,
and shall enter into force in accordance with article 25 of this Agreement.
3 — Notwithstanding the provisions of paragraph 2 of this article, any amendment to the
Annex of this Agreement may be agreed upon between the Aeronautical Authorities of the Par-
ties, and confirmed through an exchange of diplomatic notes. They shall enter into force on a
date to be determined in the diplomatic notes. This exception to paragraph 2 of this article does
not apply in case any traffic rights are added to the Annex.
Article 21
Settlement of disputes
1 — If any dispute arises between the Parties relating to the interpretation or application of
this Agreement, the Parties shall in the first place endeavour to settle their dispute by negotiation
through diplomatic channels.
2 — If the Parties fail to reach a settlement by negotiation, they may agree to refer the dispute
for decision to some entity, or the dispute may at the request of either Party be submitted for deci-
sion to an arbitral tribunal of three arbitrators, one to be nominated by each Party and the third to
be appointed by the two so nominated.
3 — Each of the Parties shall nominate an arbitrator within a period of sixty (60) days from the
date of receipt by either Party from the other of a notice through diplomatic channels requesting
arbitration of the dispute, and the third arbitrator shall be appointed within a further period of sixty
(60) days.
4 — If either of the Parties fails to nominate an arbitrator within the period specified or the third
arbitrator is not appointed within the period specified, the President of the Council of the International
Civil Aviation Organization may be requested by either Party to appoint an arbitrator or arbitrators
as the case requires. In such case, the third arbitrator shall be a national of a third State and shall
act as president of the arbitral tribunal.
5 — The Parties undertake to comply with any decision given under paragraph 2 of this article.
6 — If and as long as either Party or the Designated Airlines of either Party fail to comply with
the decision given under paragraph 2 of this article, the other Party may limit, suspend or revoke
any rights or privileges which it has granted by virtue of this Agreement to the Party in default or to
a Designated Airline in default.
7 — Each Party shall pay the expenses of the arbitrator it has nominated. The remaining ex-
penses of the arbitral tribunal shall be shared equally by the Parties.
Article 22
Duration and termination
1 — This Agreement shall remain in force for an undetermined period.
2 — Each Party may, at any time, give notice in writing through diplomatic channels to the other
Party of its decision to terminate this Agreement. Such notice shall simultaneously be communicated
to the International Civil Aviation Organization.
3 — The Agreement shall terminate twelve (12) months after the date of receipt of the notice
by the other Party, unless the notice to terminate is withdrawn by mutual agreement before the
expiry of this period.
4 — In the absence of acknowledgement of receipt of the notification of the other Party, notice
shall be deemed to have been received fourteen (14) days after the receipt of the notice by the
International Civil Aviation Organization.

Article 23
Registration
This Agreement and any amendment thereto shall be registered with the International Civil
Aviation Organization.
Article 24
Applicability of the Agreement
As regards the Kingdom of the Netherlands, this Agreement shall apply to Curaçao only.
Article 25
Entry into force
This Agreement shall enter into force on the first day of the second month following the date of
receipt of the last written notification, through diplomatic channels, by which the two Parties have
notified each other that the requirements for the entry into force of this Agreement under their re-
spective legal procedures have been fulfilled.
In witness whereof, the undersigned, being duly authorized thereto by their respective Govern-
ments, have signed this Agreement.
Done in Lisbon, on the 25th of June of 2019, in duplicate in the Portuguese, Dutch and English
languages, all texts being equally authentic. In case of divergence in interpretation of the provisions
of this Agreement, the English version shall prevail.
