Sumário: Aprova o Protocolo sobre os Privilégios e Imunidades do Tribunal Unificado de Paten-
tes, feito em Bruxelas, a 29 de junho de 2016.
Aprova o Protocolo sobre os Privilégios e Imunidades do Tribunal Unificado de Patentes, feito em Bruxelas
em 29 de junho de 2016
A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do ar-
tigo 166.º da Constituição, aprovar o Protocolo sobre os Privilégios e Imunidades do Tribunal Uni-
ficado de Patentes, feito em Bruxelas em 29 de junho de 2016, cuja versão autenticada em língua
inglesa, bem como a respetiva tradução para língua portuguesa, se publicam em anexo.

PROTOCOL ON PRIVILEGES AND IMMUNITIES OF THE UNIFIED PATENT COURT
The undersigning Contracting Member States of the Agreement on a Unified Patent Court:
Considering that the Unified Patent Court has been established by the Agreement on a Unified
Patent Court of 19 February 2013 as an international organisation with legal personality in each
Contracting Member State;
Recalling that the Agreement on a Unified Patent Court provides, in article 37(1), that Contrac-
ting Member States hosting the central division of the Court of First Instance or one of its sections,
a local or regional division of the Court of First Instance or the Court of Appeal of the Unified Patent
Court shall provide facilities and, during the initial seven years, also administrative support staff;
Recalling that the Statute of the Unified Patent Court provides, in article 8, that the Protocol on
the privileges and immunities of the European Union shall apply to the judges of the Unified Patent
Court;
Recalling that article 8(4) of the Statute of the Unified Patent Court covers both the privileges
and immunities of the judges of the Unified Patent Court and that the application of the Protocol on
the privileges and immunities of the European Union to the judges of the Unified Patent Court has
been foreseen because of the intrinsic link of the latter with the European patent with unitary effect
and cannot create any precedent for the application of that Protocol to other international organiza-
tions with regard to the host nation policies of the Contracting Member States;
Recalling that the Administrative Committee has the competence to set up an internal tax and
a social security scheme under the powers of administration which are conferred to it by the Unified
Patent Court Agreement;
Recalling that the Agreement on a Unified Patent Court provides, in article 4, that the Unified
Patent Court shall enjoy the most extensive legal capacity accorded to legal persons under the
national law of that State;
Recognizing that the Unified Patent Court needs to benefit from privileges and immunities which
are necessary for the exercise of its functions;
Considering that a common approach on how to address issues of privileges and immunities
is essential in view of the needs of the Unified Patent Court and of the Contracting Member States;
Recognizing that additional bilateral Headquarter Agreements may be concluded between the
Unified Patent Court and Contracting Member States hosting the central division of the Court of
First Instance or one of its sections, a local or regional division of the Court of First Instance or the
Court of Appeal of the Unified Patent Court;

have agreed as follows:
Article 1
Use of terms
For the purpose of this Protocol:
a) “Agreement” means the Agreement on a Unified Patent Court of 19 February 2013;
b) “Statute” means the Statute of the Unified Patent Court as set out in Annex I of the Agree-
ment;
c) “State Party” means a State party to this Protocol;
d) “Contracting Member State” means a State party to the Agreement;
e) “Court” means the Unified Patent Court created by the Agreement;
f) “Court of Appeal” means the Court of Appeal of the Court;
g) “The official activities of the Court” means the activities that are necessary for the fulfilment
by the Court of the purposes and functions it has been entrusted with in accordance with the pro-
visions of the Agreement;
h) “Premises of the Court” means land and buildings made available to the Court by the
Contracting Member State in accordance with article 37 of the Agreement and used for the official
activities of the Court;
i) “Judge” means a Judge of the Court.
j) “Registrar” means the Registrar and the Deputy-Registrar of the Court.
k) “Staff” means all personnel employed by the Court as officials and other servants of the Court
except the Judges and the Registrar.
l) “Family” means, with respect to any person, the spouse and dependent members of the
immediate family of such person forming part of such person’s household, as recognised by the
hosting Contracting Member State;
m) “Representatives of the parties” means the lawyers, European patent attorneys or patent
attorneys authorised to practice or assist before the Court under article 48 of the Agreement.
Article 2
General provisions on privileges and immunities of the Court
The Court shall enjoy in the territory of each State Party such privileges and immunities as are
necessary for the exercise of its official activities.
Article 3
Inviolability of the premises of the Court
The premises of the Court shall be inviolable, subject to such conditions as may be agreed with
the State Party concerned and subject to the responsibility of the State Party hosting the central
division of the Court of First Instance or one of its sections, a local or regional division of the Court
of First Instance or the Court of Appeal with respect to the facilities that are to be provided by such
a State Party.
Article 4
Inviolability of archives and documents
The archives of the Court, and all papers and documents in whatever form belonging to it, held
by it or addressed to it shall be inviolable at all times and wherever they may be located.

Article 5
Immunity of the Court, its property, assets and funds
1 — The Court shall enjoy immunity from legal process, except:
a) Insofar as in any particular case it has expressly waived its immunity;
b) As in the event of civil proceedings against it with respect to contractual liability brought by
persons others than the Judges, the Registrar or the Staff of the Court;
c) As in cases of civil proceedings against it with respect to non-contractual liability except
where the claim is based on the performance of the Court’s jurisprudence or
d) In the case of a civil proceeding brought by a third party for damages resulting from an ac-
cident caused by a motor vehicle belonging to, or operated on behalf of, the Court, or in respect of
a motor traffic offence involving such a vehicle.
2 — The Court shall enjoy immunity from legal process in respect of search, requisition, con-
fiscation, seizure or expropriation of, or any other form of interference with, the property, assets and
funds of the Court, wherever located, without the authorisation of the Court.
3 — To the extent necessary to exercise its official activities, the property, assets and funds of
the Court shall be exempt from restrictions, regulations, controls and moratoria of any nature.
Article 6
Immunity of Representatives of a State Party
1 — Representatives of a State Party shall enjoy, while attending meetings of the Administrative
Committee, the Budget Committee and the Advisory Committee immunities from legal process in
respect of all acts performed by them in their official capacity, including their words spoken or written.
This immunity shall continue to be accorded even after the termination of their mission.
2 — Their official papers and documents shall be inviolable.
3 — No State Party is obliged to extend the immunities referred to in paragraph 1 and 2 to its
own nationals or any person who at the time of taking up his functions with the Court has his per-
manent residence in that State.
Article 7
Exemption from taxes
1 — The Court, its property and assets, shall be exempt from all direct taxes.
2 — The Court shall
a) Be exempt from or accorded a refund of value added taxes paid on any substantial purchase
of goods and services which are necessary and supplied for the official activities of the Court, subject
to the limitations laid down by the host State Party;
b) However not be exempt from taxes and dues which amount to charges for public utility
services.
3 — Goods purchased under such an exemption or reimbursement shall not be sold or
otherwise disposed of in that State Party or in another Member State of the European Union, ex-
cept in accordance with the conditions laid down by the State Party which granted the exemption
or reimbursement.
4 — Without prejudice to the obligations arising for the State Parties under European Union
law and the application of laws and regulations, the conditions and procedure shall be determined
by the competent fiscal authorities of each State Party.

Article 8
Funds and freedom from currency restrictions
The State Parties shall accord the Court the freedom of currency restrictions which is necessary
for the exercise of its official activities.
Article 9
Privileges and Immunities of the Judges and the Registrar
1 — The privileges and immunities of the Judges are governed by article 8 of the Statute and
by reference in article 8 of the Statute by the Protocol on the privileges and immunities of the Eu-
ropean Union.
2 — Article 8 of the Statute and the Protocol on the privileges and immunities of the European
Union shall apply to the Registrar.
3 — When applied in accordance with paragraph 1 and 2, only article 11(b-e) to 14 of the Protocol
on the privileges and immunities of the European Union are to be applied in analogy adapted to the
specific circumstances of the Court. This means in particular that the Judges and the Registrar shall:
a) Be liable to an internal tax for the benefit of the Court on salaries, wages and emoluments
paid to them by the Court;
b) From the date on which the internal tax under letter (a) is applied, be exempted from national
taxation on the salaries, wages and emoluments, paid to them by the Court, but not on pensions
and annuities, paid to them by the Court;
c) From the date on which the Judges and the Registrar are subject to a social security and
health scheme established by the Court, with respect to services rendered for the Court, be exempted
from all compulsory contributions to national social security and health schemes.
Article 10
Immunities and privileges of the Staff
1 — The Staff shall be immune from legal process in respect of all acts performed by them
in their official capacity, including their words spoken or written. This immunity shall continue to be
accorded even after the termination of their employment with the Court.
2 — The Staff shall,
a) Be liable to an internal tax for the benefit of the Court on salaries, wages and emoluments
paid to them by the Court;
b) From the date on which the internal tax under letter (a) is applied, be exempted from national
taxation on the salaries, wages and emoluments, but not on pensions and annuities, paid to them by
the Court; these salaries, wages and emoluments may be taken into account by the State Parties
for the purpose of assessing the amount of taxation to be applied to income from other sources;
c) From the date on which the Staff is subject to a social security and health scheme establi-
shed by the Court, with respect to services rendered for the Court, be exempted from all compulsory
contributions to national social security and health schemes.
3 — No State Party is obliged to extend the privileges referred to in paragraph 2 to its own
nationals or to a person who immediately prior to the employment by the Court was a resident of
that State Party.
Article 11
Emblem and flag
The Court shall be entitled to display its emblem and flag at its premises subject to such con-
ditions as may be agreed with the State Party concerned, on vehicles used for official purposes as
well as on its website and documents.

Article 12
Cooperation with the authorities of State Parties
1 — Without prejudice to their privileges and immunities, it is the duty of all persons enjoying
privileges and immunities under article 6, 9 and 10 to respect the laws and regulations of the State
Party in whose territory they may operate in their official capacity.
2 — The Court shall cooperate at all times with the appropriate authorities of State Parties to
facilitate the enforcement of their laws and to prevent the occurrence of any abuse in connection
with the privileges, immunities and facilities referred to in this Protocol.
Article 13
Purpose and waiver of privileges and immunities provided for in article 6, 9 and 10
1 — The privileges and immunities provided for in this Protocol are not established for the
personal benefit of those persons in whose favour they are granted. Their purpose is solely in the
interest of the Court, especially to ensure, in all circumstances, the freedom of action of the Court
and the complete independence of the persons concerned.
2 — The Presidium of the Court shall have not only the right but also the duty to waive the
immunity of Judges, the Registrar and the Staff under articles 9 and 10, when it considers that such
immunity would hinder the normal course of justice, and that it is possible to waive such immunity
without prejudicing the interests of the Court. A State Party has the same right regarding its repre-
sentatives in the Administrative Committee and the Budget Committee (article 6). The Administra-
tive Committee shall have the same right and obligation regarding the members of the Advisory
Committee.
Article 14
Access, residence and departure
Without prejudice to European Union law, the concerned State Party shall take all the neces-
sary steps to facilitate;
a) The entry into, departure from and residence in its territory of all persons who are performing
official duties for the Court, namely the Judges, the Registrar, Staff employed by the Court and staff
provided by the State Parties as well as, where persons performing official duties for the Court are
based in the State Party and are not nationals or permanent residents of that State Party, dependent
members of their families, and
b) The entry into and departure from its territory of all persons who are called to or summoned
by the Court in an official capacity, namely parties, Representatives of parties, interpreters, witnesses
and experts before the Court.
Article 15
Notification
The Registrar shall communicate within one month of the entry into force of this Protocol to all
State Parties the names of the Judges, the Registrar and the Staff to whom this Protocol applies. In
addition to above, appointment/arrival of any Judge, Registrar or Staff to the Court and any change
of circumstances shall be reported as soon as possible and at the latest within one month of the
date of the relevant change of circumstance.
Article 16
Settlement of disputes
1 — The Court shall make provisions for appropriate modes of settlement of disputes involving
any person referred to in this Protocol who by reason of his or her official position enjoys immunity
or the Court in cases when it enjoys immunity under article 5, if such immunity has not been waived.

2 — All disputes arising out of the interpretation or application of this Protocol shall be referred to
an arbitral tribunal unless the parties have agreed to another mode of settlement. If a dispute arises
between the Court and a State Party which is not settled by consultation, negotiation or other agreed
mode of settlement within three months following a request by one of the parties to the dispute, it
shall at the request of either party be referred for final decision to a panel of three arbitrators: one to
be chosen by the Court, one to be chosen by the State Party and the third, who shall be Chairman of
the panel, to be chosen by the first two arbitrators. If either party has failed to make its appointment
of an arbitrator within two months of the appointment of an arbitrator by the other party, the President
of the European Court of Justice shall make such appointment. Should the first two arbitrators fail to
agree upon the appointment of the third arbitrator within three months following the appointment of
the first two arbitrators the third arbitrator shall be chosen by the President of the European Court
of Justice upon the request of the Court or the State Party.
Article 17
Signature, ratification, acceptance, approval or accession and deposition
1 — This Protocol shall be open for signature by all Contracting Member States from 29 June
2016 until 29 June 2017 at the Council of the European Union in Brussels.
2 — This Protocol is subject to ratification, acceptance or approval. Instruments of ratification,
acceptance or approval shall be deposited with the General Secretariat of the Council of the Euro-
pean Union, hereinafter referred to as the depositary.
3 — After 29 June 2017 this Protocol shall remain open for accession by all Contracting Member
States. The instruments of accession shall be deposited with the depositary.
Article 18
Entry into force
1 — This Protocol shall enter into force 30 days after the date on which the last of the four State
Parties — France, Germany, Luxemburg and the United Kingdom — has deposited its instrument
of ratification, acceptance approval or accession.
2 — For each State Party, which deposits its instrument after the date referred to in paragraph 1,
this Protocol shall enter into force 30 days after the date of deposit of its instrument of ratification,
acceptance, approval or accession.
Article 19
Provisional application
A Contracting Member State may at any time notify the depositary that it will apply this Protocol
provisionally.
In witness whereof, the undersigned, being duly authorized thereto, have signed this Protocol.
Done at Brussels this 29th of June 2016 in the English, French and German languages, all
three texts being equally authentic, in a single copy, which shall be deposited with the depositary
who shall transmit a certified true copy to all signatory and acceding States.

PROTOCOLO SOBRE OS PRIVILÉGIOS E IMUNIDADES DO TRIBUNAL UNIFICADO DE PATENTES
Os Estados Membros Contratantes, signatários do Acordo Relativo ao Tribunal Unificado de
Patentes:
Considerando que o Tribunal Unificado de Patentes foi criado pelo Acordo Relativo ao Tribu-
nal Unificado de Patentes de 19 de fevereiro de 2013 como uma organização internacional com
personalidade jurídica em cada um dos Estados Membros Contratantes;
Recordando que o Acordo Relativo ao Tribunal Unificado de Patentes prevê, no artigo 37.º,
n.º 1, que os Estados Membros Contratantes que acolhem a divisão central do Tribunal de Primeira
Instância ou uma das suas secções, uma divisão local ou regional do Tribunal de Primeira Instância
ou o Tribunal de Recurso do Tribunal Unificado de Patentes devem facultar instalações, bem como,
durante os sete anos iniciais, pessoal de apoio administrativo;
Recordando que o Estatuto do Tribunal Unificado de Patentes prevê, no seu artigo 8.º, que
o Protocolo Relativo aos Privilégios e Imunidades da União Europeia seja aplicável aos juízes do
Tribunal Unificado de Patentes;
Recordando que o artigo 8.º, n.º 4, do Estatuto do Tribunal Unificado de Patentes abrange os
privilégios e imunidades dos juízes do Tribunal Unificado de Patentes e que a aplicação do Proto-
colo Relativo aos Privilégios e Imunidades da União Europeia aos juízes do Tribunal Unificado de
Patentes foi prevista devido à ligação intrínseca deste último com a patente europeia com efeito
unitário e que não pode criar nenhum precedente para a aplicação desse Protocolo a outras or-
ganizações internacionais no que diz respeito às políticas do país anfitrião dos Estados Membros
Contratantes;
Recordando que o Comité Administrativo tem competência para estabelecer um imposto in-
terno e um regime de segurança social sob os poderes de administração que lhe são conferidos
pelo Acordo Relativo ao Tribunal Unificado de Patentes;
Recordando que o Acordo Relativo ao Tribunal Unificado de Patentes prevê, no artigo 4,º, que
o Tribunal Unificado de Patentes goza da mais ampla capacidade jurídica concedida às pessoas
coletivas pela legislação nacional desse Estado;
Reconhecendo que o Tribunal Unificado de Patentes tem de beneficiar dos privilégios e imu-
nidades necessários ao exercício das suas funções;
Considerando que uma abordagem comum sobre as questões de privilégios e imunidades
é essencial tendo em conta as necessidades do Tribunal Unificado de Patentes e dos Estados
Membros Contratantes;
Reconhecendo que os acordos de sede bilaterais adicionais podem ser celebrados entre o
Tribunal Unificado de Patentes e os Estados Membros Contratantes que acolhem a divisão central
do Tribunal de Primeira Instância ou uma das suas secções, uma divisão local ou regional do Tri-
bunal de Primeira Instância ou o Tribunal de Recurso do Tribunal Unificado de Patentes:
acordaram no seguinte:
Artigo 1.º
Definições
Para efeitos do presente Protocolo:
a) «Acordo» designa o Acordo Relativo ao Tribunal Unificado de Patentes de 19 de fevereiro
de 2013;
b) «Estatuto» designa o Estatuto do Tribunal Unificado de Patentes conforme estabelecido no
anexo I do Acordo;
c) «Estado Parte» designa um Estado parte no presente Protocolo;
d) «Estado Membro Contratante» designa um Estado parte no Acordo;
e) «Tribunal» designa o Tribunal Unificado de Patentes criado pelo Acordo;
f) «Tribunal de Recurso» designa o Tribunal de Recurso do Tribunal;

g) «As atividades oficiais do Tribunal» designa as atividades necessárias para o cumprimento
pelo Tribunal da missão e das funções que lhe foram confiadas em conformidade com as disposi-
ções do Acordo;
h) «Instalações do Tribunal» designa os terrenos e os edifícios disponibilizados ao Tribunal
pelo Estado Membro Contratante em conformidade com o artigo 37.º do Acordo e utilizados para
as atividades oficiais do Tribunal;
i) «Juiz» designa um juiz do Tribunal;
j) «Secretário» designa o Secretário e o Secretário-Adjunto do Tribunal;
k) «Pessoal» designa os funcionários do Tribunal e outros agentes do Tribunal, exceto os
juízes e o Secretário;
l) «Família» designa, em relação a qualquer pessoa, o cônjuge e os membros dependentes
da família imediata dessa pessoa que com ela vivam, conforme reconhecido pelo Estado Membro
Contratante de acolhimento;
m) «Representantes das partes» designa os advogados, os mandatários de patentes euro-
peias ou os mandatários de patentes autorizados a praticar ou a dar apoio no Tribunal nos termos
do artigo 48.º do Acordo.
Artigo 2.º
Disposições gerais sobre os privilégios e as imunidades do Tribunal
O Tribunal goza, no território de cada Estado Parte, dos privilégios e imunidades necessários
ao exercício das suas atividades oficiais.
Artigo 3.º
Inviolabilidade das instalações do Tribunal
As instalações do Tribunal são invioláveis, sujeitas às condições que possam ser acordadas
com o Estado Parte interessado e sob a responsabilidade do Estado Parte que acolhe a divisão
central do Tribunal de Primeira Instância ou uma das suas secções, uma divisão local ou regional
do Tribunal de Primeira Instância ou o Tribunal de Recurso no que diz respeito às instalações que
serão disponibilizadas por esse Estado Parte.
Artigo 4.º
Inviolabilidade dos arquivos e dos documentos
Os arquivos do Tribunal, e todos os papéis e documentos, independentemente da sua forma,
que lhe pertençam, que estejam na sua posse ou que a ele são dirigidos, são em qualquer momento
e onde quer que se encontrem invioláveis.
Artigo 5.º
Imunidade do Tribunal, dos seus ativos, bens e fundos
1 — O Tribunal goza de imunidade de jurisdição, exceto:
a) Na medida em que em qualquer caso particular renuncie expressamente à sua imuni-
dade;
b) Em ações cíveis intentadas contra si em relação à responsabilidade contratual por pessoas
que não sejam os juízes, o Secretário ou o pessoal do tribunal;
c) Em casos de ações cíveis intentadas contra si em relação à responsabilidade extracontratual,
exceto quando o pedido se baseia no desempenho da sua jurisprudência; ou
d) No caso de uma ação cível interposta por um terceiro por danos resultantes de um acidente
causado por um veículo a motor pertencente ao, ou utilizado em nome do, Tribunal, ou em relação
a uma infração de trânsito que envolva tal veículo.

2 — O Tribunal goza de imunidade de jurisdição em relação a buscas, requisição, confisco,
apreensão ou expropriação, ou qualquer outra forma de interferência com os ativos, de bens e
fundos do Tribunal, onde quer que estejam localizados, sem a autorização do Tribunal.
3 — Na medida do necessário ao exercício das suas atividades oficiais, os ativos, bens e
fundos do Tribunal estão isentos de restrições, regulamentos, controlos e moratórias de qualquer
natureza.
Artigo 6.º
Imunidade dos Representantes de um Estado Parte
1 — Os Representantes de um Estado Parte gozam, ao participarem nas reuniões do Comité
Administrativo, do Comité Orçamental e do Comité Consultivo, de imunidade de jurisdição em re-
lação a todos os atos por eles praticados na sua qualidade oficial, incluindo as suas palavras orais
ou escritas. Esta imunidade continuará a ser concedida mesmo após a cessação das suas funções.
2 — Os seus papéis e documentos oficiais são invioláveis.
3 — Nenhum Estado Parte é obrigado a estender as imunidades referidas nos n.os 1 e 2 aos
seus próprios nacionais ou a qualquer pessoa que, no momento da sua entrada em funções no
Tribunal, tenha a sua residência permanente nesse Estado.
Artigo 7.º
Isenção de impostos
1 — O Tribunal, os seus ativos e bens, estão isentos de todos os impostos diretos.
2 — O Tribunal:
a) Está isento ou é reembolsado de impostos sobre o valor acrescentado pagos sobre qualquer
compra substancial de bens e serviços necessários e prestados às atividades oficiais do Tribunal,
sob reserva das limitações previstas pelo Estado Parte de acolhimento;
b) No entanto, não está isento de impostos e taxas que representem encargos com serviços
de utilidade pública.
3 — Os bens adquiridos sob tal isenção ou reembolsados não serão vendidos ou de qualquer
forma cedidos nesse Estado Parte ou em outro Estado-Membro da União Europeia, exceto nas
condições estabelecidas pelo Estado Parte que concedeu a isenção ou o reembolso.
4 — Sem prejuízo das obrigações dos Estados Partes, decorrentes do direito da União Euro-
peia e da aplicação das leis e regulamentos, as condições e o procedimento serão determinados
pelas autoridades fiscais competentes de cada Estado Parte.
Artigo 8.º
Fundos e isenção de restrições monetárias
Os Estados Partes concedem ao Tribunal isenção de restrições monetárias necessária ao
exercício das suas atividades oficiais.
Artigo 9.º
Privilégios e imunidades dos juízes e do Secretário
1 — Os privilégios e imunidades dos juízes encontram-se previstos no artigo 8.º do Estatuto
e, por referência no artigo 8.º do Estatuto, no Protocolo Relativo aos Privilégios e Imunidades da
União Europeia.
2 — O artigo 8.º do Estatuto e o Protocolo sobre os privilégios e imunidades da União Europeia
aplicam-se ao Secretário.
3 — Quando aplicado em conformidade com os n.os 1 e 2, só os artigos 11.º, alíneas b) a e),
a 14.º do Protocolo Relativo aos Privilégios e Imunidades da União Europeia devem ser aplicados

por analogia, adaptando-os às circunstâncias específicas do Tribunal. Isto significa nomeadamente
que os juízes e o Secretário:
a) São sujeitos a um imposto interno em benefício do Tribunal sobre vencimentos, salários e
emolumentos que lhes são pagos pelo Tribunal;
b) A partir do momento em que o imposto interno referido na alínea a) é aplicado, estão isentos
de impostos nacionais sobre os vencimentos, salários e emolumentos que lhes são pagos pelo
Tribunal, mas não sobre pensões e anuidades que lhes são pagas pelo Tribunal;
c) A partir do momento em que os juízes e o Secretário se encontram sujeitos a um regime de
segurança social e de saúde estabelecido pelo Tribunal, no que diz respeito a serviços prestados
ao Tribunal, estão isentos de todas as contribuições obrigatórias para a segurança social e planos
de saúde nacionais.
Artigo 10.º
Imunidades e privilégios do pessoal
1 — O pessoal goza de imunidade de jurisdição no que respeita a todos os atos por este
praticados na sua qualidade oficial, incluindo as suas palavras orais ou escritas. Esta imunidade
continuará a ser concedida mesmo após a cessação das suas funções no Tribunal.
2 — O pessoal:
a) Está sujeito a um imposto interno em benefício do Tribunal sobre vencimentos, salários e
emolumentos que lhe são pagos pelo Tribunal;
b) A partir do momento em que o imposto interno referido na alínea a) é aplicado, está isento
de impostos nacionais sobre os vencimentos, salários e emolumentos que lhe são pagos pelo Tri-
bunal, mas não sobre pensões e anuidades que lhe são pagas pelo Tribunal; estes vencimentos,
salários e emolumentos podem ser tidos em conta pelos Estados Partes para avaliar o montante
da tributação a aplicar aos rendimentos provenientes de outras fontes;
c) A partir do momento em que o pessoal se encontra sujeito a um regime de segurança social e
de saúde estabelecido pelo Tribunal, no que diz respeito a serviços prestados ao Tribunal, está isento
de todas as contribuições obrigatórias para a segurança social e planos de saúde nacionais.
3 — Nenhum Estado Parte é obrigado a estender os privilégios referidos no n.º 2 aos seus
próprios nacionais ou a uma pessoa que imediatamente antes da sua entrada em funções no Tri-
bunal tinha residência nesse Estado Parte.
Artigo 11.º
Emblema e bandeira
O Tribunal tem o direito de exibir o seu emblema e a sua bandeira nas suas instalações sujeito
às condições que possam ser acordadas com o Estado Parte interessado, nos veículos utilizados
para fins oficiais, bem como no seu sítio da internet e documentos.
Artigo 12.º
Cooperação com as autoridades dos Estados Partes
1 — Sem prejuízo dos seus privilégios e imunidades, é dever de todas as pessoas que gozam
dos privilégios e imunidades ao abrigo dos artigos 6.º, 9.º e 10.º respeitar as leis e regulamentos
do Estado Parte em cujo território estão a exercer funções na sua qualidade oficial.
2 — O Tribunal cooperará a qualquer momento com as autoridades competentes dos Estados
Partes para facilitar a aplicação das suas leis e evitar a ocorrência de qualquer abuso em relação
aos privilégios, imunidades e facilidades referidos no presente Protocolo.

Artigo 13.º
Finalidade e renúncia aos privilégios e imunidades previstos nos artigos 6.º, 9.º e 10.º
1 — Os privilégios e imunidades previstos no presente Protocolo não são estabelecidos para
benefício pessoal das pessoas a quem são concedidos. O seu objetivo é unicamente servir o inte-
resse do Tribunal, particularmente para garantir, em todas as circunstâncias, a liberdade de ação
do Tribunal e a total independência das pessoas em causa.
2 — O Presidium do Tribunal tem não só o direito mas também o dever de renunciar à imuni-
dade dos juízes, do Secretário e do pessoal ao abrigo dos artigos 9.º e 10.º, quando considerar que
tal imunidade pode prejudicar o curso normal da justiça e que é possível renunciar a essa imuni-
dade sem prejudicar os interesses do Tribunal. Um Estado Parte tem o mesmo direito em relação
aos seus representantes no Comité Administrativo e no Comité Orçamental (artigo 6.º). O Comité
Administrativo tem o mesmo direito e obrigação em relação aos membros do Comité Consultivo.
Artigo 14.º
Acesso, residência e partida
Sem prejuízo do direito da União Europeia, o Estado Parte interessado toma todas as medidas
necessárias para facilitar:
a) A entrada, a partida e a residência no seu território de todas as pessoas que estão a exercer
funções oficiais para o Tribunal, nomeadamente os juízes, o Secretário, os funcionários do Tribunal
e o pessoal disponibilizado pelos Estados Partes, bem como, nos casos em que as pessoas que
exercem funções oficiais no Tribunal estão colocadas no Estado Parte e não são nacionais nem
residentes permanentes desse Estado Parte, aos membros dependentes das suas famílias; e
b) A entrada e saída do território de todas as pessoas notificadas ou convocadas para com-
parecer perante o Tribunal na sua qualidade oficial, nomeadamente as partes, os representantes
das partes, os intérpretes, as testemunhas e os peritos.
Artigo 15.º
Notificação
O Secretário comunicará a todos os Estados Partes, no prazo de um mês da entrada em
vigor do presente Protocolo, os nomes dos juízes, do Secretário e do pessoal a quem o presente
Protocolo se aplica. Além disso, a nomeação/chegada de qualquer juiz, Secretário ou pessoal ao
Tribunal e qualquer alteração das circunstâncias será notificada o mais rápido possível e, o mais
tardar, um mês a contar da data da mudança de circunstâncias em causa.
Artigo 16.º
Resolução de diferendos
1 — O Tribunal tomará medidas para prever os meios adequados de resolução de diferendos
que envolvam qualquer pessoa mencionada no presente Protocolo que, em virtude do seu cargo
oficial, goze de imunidade ou o Tribunal, nos casos em que este goza de imunidade ao abrigo do
artigo 5.º, se não tiver havido renúncia a tal imunidade.
2 — Todos os diferendos decorrentes da interpretação ou aplicação do presente Protocolo
serão encaminhados para um tribunal arbitral, a menos que as partes tenham aceitado outro meio
de resolução. Se surgir um diferendo entre o Tribunal e um Estado Parte que não possa ser resol-
vido mediante consulta, negociação ou outro meio de resolução acordado no prazo de três meses
após um pedido de uma das partes no diferendo, este será encaminhado, a pedido de qualquer
uma das partes, para decisão final para um painel de três árbitros: um escolhido pelo Tribunal, um
escolhido pelo Estado Parte e o terceiro, que será o presidente do painel, escolhido pelos dois pri-
meiros árbitros. Se qualquer uma das partes não tiver nomeado um árbitro no prazo de dois meses

a contar da data da nomeação de um árbitro pela outra parte, o presidente do Tribunal de Justiça
da União Europeia procederá a tal nomeação. Se os dois primeiros árbitros não acordarem na no-
meação do terceiro árbitro no prazo de três meses após a nomeação dos dois primeiros árbitros, o
terceiro árbitro será escolhido pelo Presidente do Tribunal de Justiça da União Europeia a pedido
do Tribunal ou do Estado Parte.
Artigo 17.º
Assinatura, ratificação, aceitação, aprovação ou adesão e depósito
1 — O presente Protocolo está aberto à assinatura de todos os Estados Membros Contratantes
de 29 de junho de 2016 até 29 de junho de 2017 no Conselho da União Europeia em Bruxelas.
2 — O presente Protocolo está sujeito a ratificação, aceitação ou aprovação. Os instrumentos
de ratificação, aceitação ou aprovação serão depositados junto do Secretariado-Geral do Conselho
da União Europeia, doravante designado o depositário.
3 — Após 29 de junho de 2017, o presente Protocolo permanecerá aberto à adesão de todos
os Estados Membros Contratantes. Os instrumentos de adesão serão depositados junto do depo-
sitário.
Artigo 18.º
Entrada em vigor
1 — O presente Protocolo entrará em vigor 30 dias após a data em que o último dos quatro
Estados Partes — França, Alemanha, Luxemburgo e Reino Unido — tenha depositado o seu ins-
trumento de ratificação, aprovação ou adesão.
2 — Para cada Estado Parte que deposita o seu instrumento após a data referida no n.º 1, o
presente Protocolo entrará em vigor 30 dias após a data do depósito do seu instrumento de ratifi-
cação, aceitação, aprovação ou adesão.
Artigo 19.º
Aplicação provisória
Um Estado Membro Contratante pode, a qualquer momento, notificar o depositário de que
aplicará provisoriamente o presente Protocolo.
Em fé do que, os abaixo assinados, devidamente autorizados para o efeito, assinaram o pre-
sente Protocolo.
Feito em Bruxelas, em 29 de junho de 2016, nas línguas inglesa, francesa e alemã, fazendo
todos os três textos igualmente fé, num único exemplar, que será depositado junto do depositário,
que transmitirá uma cópia autenticada a todos os Estados signatários e aderentes.
