Sumário: Aprova o Instrumento de Emenda da Constituição da Organização Internacional do
Trabalho, adotado pela Conferência Internacional do Trabalho, na sua 72.ª Sessão,
realizada em Genebra, a 24 de junho de 1986.

A Assembleia da República resolve, nos termos da alínea i) do artigo 161.º e do n.º 5 do
artigo 166.º da Constituição, aprovar o Instrumento de Emenda da Constituição da Organização
Internacional do Trabalho, incluindo as emendas constantes do anexo ao referido Instrumento,
adotado pela Conferência Internacional do Trabalho, em 24 de junho de 1986, cujo texto, na
versão autenticada em língua inglesa e respetiva tradução para a língua portuguesa, se publica
em anexo.

INSTRUMENT FOR THE AMENDMENT OF THE CONSTITUTION OF THE INTERNATIONAL LABOUR
ORGANISATION, ADOPTED BY THE CONFERENCE
AT ITS SEVENTY-SECOND, SESSION GENEVA, 24 JUNE 1986
The General Conference of the International Labour Organisation:
Having been convened at Geneva by the Governing Body of the International Labour Office,
and having met in its Seventy-second Session on 4 June 1986; and
Having decided upon the adoption of certain amendments to the Constitution of the Interna-
tional Labour Organisation, a question which is included in the seventh item on the agenda of the
Session:
adopts, this twenty-fourth day of June of the year one thousand nine hundred and eighty-six, the
following instrument for the amendment of the Constitution of the International Labour Organisa-
tion, which may be cited as the Constitution of the International Labour Organisation Instrument of
Amendment, 1986:
Article 1
As from the date of the coming into force of this Instrument of Amendment, the provisions of
the Constitution of the International Labour Organisation, of which the text at present in force is set
forth in the first column of the annex to this Instrument, shall have effect as amended in the second
column of the said annex.
Article 2
Two copies of this Instrument of Amendment shall be authenticated by the signatures of the
President of the Conference and of the Director-General of the International Labour Office. One of
these copies shall be deposited in the archives of the International Labour Office and the other shall
be communicated to the Secretary-General of the United Nations for registration in accordance with

article 102 of the Charter of the United Nations. The Director-General will communicate a certified
copy of the Instrument to all the Members of the International Labour Organisation.
Article 3
1 — The formal ratifications or acceptances of this Instrument of Amendment shall be com-
municated to the Director-General of the International Labour Office, who shall notify the Members
of the Organisation of the receipt thereof.
2 — This Instrument of Amendment will come into force in accordance with the provisions of
article 36 of the Constitution of the Organisation.
3 — On the coming into force of this Instrument, the Director-General of the International Labour
Office shall so notify all the Members of the International Labour Organisation and the Secretary-
General of the United Nations.

(iii) The appointments shall be communicated to the college
of Government delegates to the Conference in order
for it to proclaim the results. If the electoral process
or its results in a region or subregion are the subject
of dispute which cannot be settled at those levels, the

shall take a decision in the framework of the provisions
of the relevant protocol.
(c) Each electoral college shall take the necessary steps
to ensure that a substantial number of Members ap-
pointed to fill the seats assigned to that region is cho-
sen on the basis of the size of their population and
that an equitable geographical distribution is assured,
while at the same time taking into consideration other
factors such as the economic activity of the Members
concerned in accordance with the special characteris-
tics of the region. The means of implementing these
principles shall be specified in protocols agreed by the
governments of each electoral college which shall be
deposited with the Director-General of the International
Labour Office.

Organisation during its Seventy-second Session which was held at Geneva and declared closed

Convocada para Genebra pelo Conselho de Administração do Secretariado Internacional do
Trabalho, e aí reunida em 4 de junho de 1986, na sua septuagésima segunda sessão;
Após ter decidido adotar algumas propostas de emendas à Constituição da Organização
Internacional do Trabalho, questão que constitui o sétimo ponto da ordem de trabalhos da
sessão:
adota, neste dia 24 de junho de 1986, o instrumento abaixo enunciado para emenda à Constituição
da Organização Internacional do Trabalho, instrumento que será denominado «Instrumento de
Emenda à Constituição da Organização Internacional do Trabalho, 1986»:

A contar da data da entrada em vigor do presente Instrumento de Emenda, as disposições
da Constituição da Organização Internacional do Trabalho, cujo texto atualmente em vigor está

reproduzido na primeira coluna do anexo ao presente instrumento, terão efeito na forma emendada
que figura na segunda coluna do referido anexo.
Artigo 2.º
Dois exemplares autênticos do presente Instrumento de Emenda serão assinados pelo
Presidente da Conferência e pelo Diretor-Geral do Secretariado Internacional do Trabalho. Um
desses exemplares será depositado nos arquivos do Secretariado Internacional do Trabalho
e outro será transmitido ao Secretário-Geral das Nações Unidas, para efeitos de registo, nos
termos do artigo 102.º da Carta das Nações Unidas. O Diretor-Geral comunicará uma cópia
certificada, conforme com este Instrumento, a cada um dos membros da Organização Interna-
cional do Trabalho.
Artigo 3.º
1 — As ratificações ou aceitações formais do presente Instrumento de Emenda serão comuni-
cadas ao Diretor-Geral do Secretariado Internacional do Trabalho, que delas informará os membros
da Organização.
2 — O presente Instrumento de Emenda entrará em vigor nas condições previstas no artigo 36.º
da Constituição da Organização Internacional do Trabalho.

correspondente nas condições previstas no parágrafo 4
deste artigo, formarão os colégios eleitorais encarregues
de designar os Membros chamados a ocupar os lugares
que foram atribuídos a cada uma das referidas regiões.

Ocidental e os delegados governamentais dos Estados
Socialistas da Europa de Leste formarão colégios eleito-
rais separados. Devem acordar entre si, a repartição dos
lugares que cabem à região e designam, separadamente,
os seus representantes no Conselho de Administração.
ii) Quando as características de uma região o exijam, os gover-
nos dessa região poderão acordar em se subdividirem, numa
base sub-regional para designarem separadamente os Mem-
bros chamados a ocupar os lugares que cabem à sub-região.
iii) As designações serão comunicadas ao colégio dos delega-
dos governamentais da Conferência a fim de proclamar os
resultados. Se, numa região ou numa sub-região, as opera-
ções eleitorais ou os seus resultados sejam objeto de con-
testação e que não possam ser resolvidas a esses níveis,
o colégio dos delegados governamentais da Conferência
decidirá no quadro das disposições do protocolo aplicável.

c) Cada colégio eleitoral deverá tomar as disposições neces-
sárias a fim de que um número substancial de Membros
designados para ocuparem os lugares concedidos para
a região seja escolhido com base na importância da sua
população e, de modo a que seja assegurada uma reparti-
ção geográfica equitativa, tendo também em consideração
outros fatores, tais como as atividades económicas dos
Membros em questão de acordo com as características
próprias da região. As modalidades da execução desse
princípio serão especificadas por protocolos entre os Go-
vernos que façam parte do colégio eleitoral e que serão
depositados junto do Diretor-Geral do Secretariado Inter-
nacional do Trabalho.
4 — Cada um dos dois lugares restantes será atribuído ro-
tativamente à África e à América por um lado, e à Ásia e à
Europa, por outro, a fim de permitir que cada uma dessas
regiões assegurem em condições não discriminatórias a
participação no processo eleitoral dos Estados Membros
que façam geograficamente parte da região ou que lhes
estejam ligados por acordo mútuo ou que sejam convida-
dos para a Conferência Regional correspondente, mas não
estejam cobertos nem por protocolo dessa região nem por
nenhum outro, ficando assente que os ditos Estados não
poderão beneficiar de um tratamento privilegiado em rela-
ção aos Estados comparáveis da região. Quando o lugar
adicional não seja utilizado de acordo com as disposições
suprarreferidas, será ocupado pela região em causa, à luz
das disposições do seu protocolo.
