Sumário: Aprova o Acordo entre a República Portuguesa e o Reino Unido da Grã-Bretanha e da Irlanda
do Norte sobre a Proteção de Informação Classificada, feito em Londres, a 15 de setembro
de 2025.
O Acordo entre a República Portuguesa e o Reino Unido da Grã-Bretanha e da Irlanda do Norte
sobre a Proteção de Informação Classificada, feito em Londres, a 15 de setembro de 2025, estabelece as
regras para a proteção da Informação Classificada que é fornecida ou divulgada, por uma Parte à outra
Parte, ou por uma Parte a um Contratante da outra Parte, ou por um Contratante de uma Parte a um
Contratante da outra Parte, em conformidade com as respetivas leis e regulamentos nacionais das Partes.
O presente Acordo confirma as excelentes relações bilaterais entre a República Portuguesa e Reino
Unido da Grã-Bretanha e da Irlanda do Norte, através do reforço da cooperação conjunta na garantia
da paz e da segurança internacional.
Assim:
Nos termos da alínea c) do n.º 1 do artigo 197.º da Constituição, o Governo aprova o Acordo entre
a República Portuguesa e o Reino Unido da Grã-Bretanha e da Irlanda do Norte sobre a Proteção de
Informação Classificada, feito em Londres, a 15 de setembro de 2025, cujo texto, nas versões autênticas,
em português e inglês, se publica em anexo.

Acordo entre a República Portuguesa e o Reino Unido da Grã-Bretanha e da Irlanda
do Norte sobre a Proteção de Informação Classificada
A República Portuguesa e o Reino Unido da Grã-Bretanha e da Irlanda do Norte («Reino Unido»),
a seguir designados conjuntamente por «Partes» ou individualmente por «Parte»;
Reconhecendo o importante papel da sua cooperação conjunta na garantia da paz, da segurança
internacional e da confiança mútua;
Desejando criar um conjunto de regras sobre a proteção mútua da informação classificada tro-
cada entre as Partes, os seus indivíduos ou pessoas coletivas, ao abrigo de convénios de cooperação,
protocolos ou contratos celebrados ou a celebrar;
Considerando que partilham normas de segurança equivalentes para a proteção da informação
classificada:
Acordaram no seguinte:
Artigo 1.º
Definições

No presente Acordo:
a) «Informação Classificada» significa qualquer informação, independentemente da sua forma,
natureza ou método de transmissão, à qual seja atribuído um grau de classificação de segurança por

uma Parte e que requeira proteção contra a divulgação, acesso ou destruição não autorizados, no
interesse da segurança nacional e em conformidade com as respetivas leis e regulamentos nacionais;
b) «Contrato Classificado» significa um instrumento juridicamente vinculativo que exige que um
Contratante aceda a Informação Classificada de uma Parte para fornecer bens ou serviços. Este termo
inclui o subcontrato ou a atividade pré-contratual;
c) «Autoridades de Segurança Competentes» (ASC) significa as organizações governamentais
designadas por cada Parte como as autoridades responsáveis, no âmbito das suas competências ao
abrigo das respetivas leis e regulamentos nacionais, pelo tratamento da Informação Classificada;
d) «Contratante» significa um indivíduo ou uma pessoa coletiva com capacidade jurídica para
celebrar um Contrato Classificado. Este termo inclui o subcontratante;
e) «Credenciação de Segurança Industrial» significa uma determinação por uma Parte, emitida
pela respetiva ANS ou ASC relevante, de que um Contratante cumpre os requisitos de segurança para
tratar Informação Classificada num determinado grau de classificação de segurança, em conformidade
com as respetivas leis e regulamentos nacionais;
f) «Autoridade Nacional de Segurança» (ANS) significa a autoridade governamental de uma Parte
com a responsabilidade pela segurança da Informação Classificada, de acordo com as disposições do
presente Acordo e as leis e regulamentos nacionais aplicáveis;
g) «Necessidade de Conhecer» significa que o acesso à Informação Classificada é limitado a indi-
víduos autorizados que precisam de ter acesso a Informação Classificada para desempenhar as suas
funções oficiais;
h) «Parte Originadora» significa a Parte que fornece Informação Classificada à Parte Recetora ao
abrigo do presente Acordo;
i) «Credenciação de Segurança Pessoal» significa uma determinação por uma Parte, emitida pela
respetiva ANS ou ASC relevante, de que um indivíduo é elegível para aceder a Informação Classificada
de um determinado grau de classificação de segurança, em conformidade com as respetivas leis
e regulamentos nacionais;
j) «Instruções de Segurança do Programa/Projeto» significa uma compilação de requisitos e pro-
cedimentos de segurança, em conformidade com as leis e regulamentos nacionais, aplicáveis a um
programa ou projeto específico, a fim de padronizar a proteção da Informação Classificada;
k) «Parte Recetora» significa a Parte que recebe Informação Classificada fornecida pela Parte
Originadora;
l) «Guia de Aspetos de Segurança» significa o documento associado a um Contrato Classificado
que identifica cada parte desse contrato que contém Informação Classificada;
m) «Incidente de Segurança» significa um ato ou omissão que resulta no processamento não
autorizado, perda ou comprometimento de Informação Classificada que tenha sido fornecida ou gerada
ao abrigo do presente Acordo; e
n) «Terceiro» significa qualquer indivíduo, pessoa coletiva, Estado ou organização internacional,
que não seja uma Parte ou um Contratante de uma Parte.
Artigo 2.º
Objetivo

1 — O presente Acordo estabelece as regras para a proteção da Informação Classificada que
é fornecida ou divulgada, por uma Parte à outra Parte, ou por uma Parte a um Contratante da outra
Parte, ou por um Contratante de uma Parte a um Contratante da outra Parte, em conformidade com as
respetivas leis e regulamentos nacionais das Partes.

2 — Nada no presente Acordo pode ser interpretado como vinculativo para uma Parte, no que
respeita à forma como trata e protege a sua própria Informação Classificada.
3 — Nada no presente Acordo pode ser interpretado como obrigando à troca de Informação Clas-
sificada entre as Partes.
Artigo 3.º
Autoridades Nacionais de Segurança
1 — As Partes designam as seguintes entidades como suas respetivas ANS:
a) Para a República Portuguesa:
Autoridade Nacional de Segurança;
b) Para o Reino Unido:
UK National Security Authority:
Cabinet Office.
2 — As Partes devem notificar-se mutuamente, através de canais diplomáticos, de qualquer alte-
ração relativa à designação das ANS.
3 — As ANS devem enviar-se mutuamente os dados de contacto oficiais e devem informar-se
mutuamente de quaisquer alterações subsequentes.
Artigo 4.º
Graus de classificação de segurança
1 — A Parte Originadora deve atribuir um grau de classificação de segurança à Informação Clas-
sificada e deve marcá-lo de acordo com as respetivas leis e regulamentos nacionais.
2 — A tabela abaixo identifica as marcações utilizadas pelas respetivas Partes correspondentes
aos seus graus de classificação de segurança da Informação Classificada:

3 — Salvo acordo em contrário entre as Partes, por escrito, o Reino Unido deve atribuir à Informação
Classificada de CONFIDENCIAL portuguesa o mesmo grau de proteção da Informação Classificada de
UK SECRET.
4 — A Parte Recetora pode aplicar uma marcação adicional ou instruções de manuseamento ade-
quadas à Informação Classificada fornecida pela Parte Originadora, indicando o grau de classificação
de segurança correspondente.
Artigo 5.º
Proteção e utilização da informação classificada
1 — As Partes devem proteger e utilizar a Informação Classificada fornecida ao abrigo do presente
Decreto n.º 3/2026
Acordo do seguinte modo:
a) A Parte Recetora deve atribuir à Informação Classificada o mesmo grau de proteção que atribui
à sua própria Informação Classificada do grau de classificação de segurança correspondente, conforme
estabelecido no artigo 4.º do presente Acordo;

b) A Parte Recetora deve utilizar a Informação Classificada apenas para o fim para que foi for-
necida, salvo se a Parte Originadora der o consentimento prévio, por escrito, para proceder de outro
modo. Para atingir este objetivo:
i) A Parte Originadora pode especificar, por escrito, as condições de divulgação ou as limitações
à sua utilização;
ii) A Parte Recetora não pode baixar o grau de classificação de segurança da Informação Classi-
ficada nem desclassificá-la sem o consentimento prévio, por escrito, da Parte Originadora;
iii) A Parte Originadora deve informar a Parte Recetora de qualquer alteração ao grau de classifi-
cação de segurança da Informação Classificada por si fornecida;
iv) A Parte Recetora deve tomar todas as medidas adequadas para prevenir um Incidente de
Segurança envolvendo a Informação Classificada; e
v) Nos termos do disposto no artigo 7.º do presente Acordo e das leis e regulamentos nacionais
aplicáveis, não divulgar essa Informação Classificada a Terceiro nem tornar disponível ao público tal
Informação Classificada sem a aprovação prévia, por escrito, da Parte Originadora.
2 — As Partes podem acordar mutuamente, por escrito, requisitos de segurança adicionais para
a proteção da Informação Classificada.
3 — Nos termos do disposto no n.º 1 do presente artigo, à Parte Recetora é permitido partilhar
Informação Classificada internamente com outras organizações governamentais dessa Parte, desde
que o destinatário tenha Necessidade de Conhecer e possa assegurar-lhe o grau adequado de proteção,
conforme estabelecido no presente Acordo.
4 — De forma a alcançar e manter padrões de segurança comparáveis, cada ANS deve, mediante
pedido, fornecer à outra Parte informação adequada sobre as suas normas, padrões, procedimentos
e práticas de segurança nacional para a salvaguarda da Informação Classificada e pode, para esse
efeito, facilitar visitas de representantes da outra Parte, conforme apropriado.
5 — Cada ANS deve notificar a outra sobre qualquer alteração nas respetivas leis e regulamentos
nacionais que afete substancialmente o grau de proteção da Informação Classificada fornecida ao
abrigo do presente Acordo.
Artigo 6.º
Acesso à Informação Classificada
1 — O acesso a Informação Classificada deve ser limitado a indivíduos que tenham Necessidade
de Conhecer e que tenham sido devidamente informados das suas responsabilidades e obrigações de
proteger a Informação Classificada.
2 — O acesso a Informação Classificada nos graus MUITO SECRETO, UK TOP SECRET, SECRETO,
UK SECRET ou CONFIDENCIAL deve ser limitado a indivíduos habilitados com a Credenciação de Segu-
rança Pessoal apropriada.
3 — Como exceção ao n.º 2 do presente artigo, certos indivíduos podem ser autorizados a ter
acesso a Informação Classificada em virtude das suas funções, se tal for permitido pelas respetivas
leis e regulamentos nacionais. Cada ANS deve notificar, por escrito, a outra ANS das categorias de
indivíduos a quem tal se aplica, assim que o Acordo entrar em vigor.
4 — Quando a Parte Originadora, por razões de segurança nacional, exigir que o acesso a Informa-

ção Classificada nos graus MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET ou CONFIDENCIAL
seja limitado com base na nacionalidade, tal deve ser marcado com a restrição adicional de «PRT/UK
EYES ONLY». A Informação Classificada com esta restrição deve ser circunscrita àqueles indivíduos
que possuam apenas a nacionalidade de uma ou de ambas as Partes.

5 — Não é necessária uma Credenciação de Segurança Pessoal para aceder a Informação Classifi-
cada no grau RESERVADO e UK OFFICIAL-SENSITIVE. Para este acesso, os indivíduos devem, no mínimo,
ter sido sujeitos a verificações no recrutamento que, se permitido pelas respetivas leis e regulamentos
nacionais, devem: determinar a identidade; verificar a nacionalidade e o estatuto de imigração; verificar
os registos profissionais e consultar os registos criminais.
Artigo 7.º
Divulgação de Informação Classificada
1 — No respeito pelas respetivas leis e regulamentos nacionais, a Parte Recetora deve tomar todas
as medidas razoáveis disponíveis para prevenir que a Informação Classificada da Parte Originadora
seja disponibilizada ao público ou divulgada a Terceiro sem a aprovação prévia, por escrito, da Parte
Originadora.
2 — Se houver qualquer pedido ou obrigação de disponibilizar qualquer Informação Classificada
da Parte Originadora ao público ou a Terceiro, a ANS da Parte Recetora deve notificar imediatamente
a ANS da Parte Originadora, por escrito, e ambas as Partes devem consultar-se mutuamente, por escrito,
antes de a Parte Recetora tomar uma decisão de divulgação.
Artigo 8.º
Informação Classificada fornecida em formato não eletrónico
1 — Se uma Parte pretender fornecer Informação Classificada nos graus MUITO SECRETO ou UK
TOP SECRET em formato não eletrónico, deve tomar providências para que a Informação Classificada
seja fornecida à Parte Recetora ou ao Contratante através de canais diplomáticos ou militares.
2 — Se uma Parte pretender fornecer Informação Classificada nos graus SECRETO, UK SECRET ou
CONFIDENCIAL em formato não eletrónico, deve tomar as providências necessárias para que a Infor-
mação Classificada seja fornecida ao destinatário através de canais diplomáticos, canais militares ou
por transporte pessoal autorizado. Outros métodos de fornecimento da Informação Classificada podem
ser utilizados se acordados, por escrito, pelas ANS ou ASC relevantes de ambas as Partes.
3 — Se uma Parte pretender transportar Informação Classificada nos graus MUITO SECRETO, UK
TOP SECRET, SECRETO, UK SECRET ou CONFIDENCIAL como carga, deve definir os meios de transporte,
a rota e quaisquer requisitos de escolta num plano de transporte. Este plano de transporte deve ser
mutuamente acordado, por escrito, pelas ANS ou ASC relevantes de ambas as Partes antes da reali-
zação do transporte.
4 — Se uma Parte pretender fornecer ao destinatário Informação Classificada nos graus RESER-
VADO ou UK OFFICIAL-SENSITIVE em formato não eletrónico, tal pode ser efetuado por serviços
postais, por empresas de correio comercial, por transporte pessoal autorizado ou através de canais
diplomáticos. A Informação Classificada nos graus RESERVADO ou UK OFFICIAL-SENSITIVE também
pode ser transportada como carga, desde que seja devidamente protegida, mas não é necessário um
plano de transporte.
5 — As ASC das respetivas Partes podem acordar mutuamente, por escrito, a utilização de métodos
alternativos aos previstos pelo presente artigo para o envio de Informação Classificada.
6 — No caso de a Informação Classificada abrangida pelo presente artigo ser convertida para
formato eletrónico devem ser aplicados os requisitos do artigo 9.º
Artigo 9.º

Informação Classificada transmitida em formato eletrónico
1 — A Informação Classificada recebida pelas Partes em formato eletrónico deve ser processada
utilizando apenas sistemas de informação e comunicações acreditados pela Parte Recetora, pelo menos
no grau de classificação de segurança correspondente.

2 — Se uma Parte pretender transmitir Informação Classificada à outra Parte, deve encriptá-la
utilizando métodos de encriptação acordados por ambas as Partes.
3 — Como exceção ao n.º 2 do presente artigo, se uma Parte pretender transmitir à outra Parte, em
claro, Informação Classificada marcada UK OFFICIAL-SENSITIVE, pode fazê-lo, desde que não este-
jam disponíveis métodos e meios criptográficos adequados e se acordado previamente com a Parte
Originadora.
4 — No caso de a Informação Classificada abrangida pelo presente artigo ser convertida para um
formato não eletrónico, devem ser aplicados os requisitos do artigo 8.º
Artigo 10.º
Tradução, reprodução e destruição da Informação Classificada
1 — Salvo ser proibido pela Parte Originadora por meio de uma marcação apropriada, aviso por
escrito ou instruções de manuseio, a Parte Recetora pode traduzir, reproduzir ou destruir Informação
Classificada de acordo com os n.os 2, 3 e 4 do presente artigo.
2 — As traduções e reproduções de Informação Classificada devem manter o grau de classificação
de segurança atribuído ao original e devem ser protegidas em conformidade com o presente Acordo.
Tais traduções e reproduções devem ser limitadas ao mínimo necessário para um fim oficial e devem
ser feitas apenas por indivíduos que tenham acesso a Informação Classificada, em conformidade com
o artigo 6.º do presente Acordo.
3 — As traduções devem ser marcadas com uma anotação adequada, na língua para a qual foram
traduzidas, indicando que contêm Informação Classificada da Parte Originadora.
4 — Quando já não for necessária, a Informação Classificada protegida ao abrigo do presente
Acordo deve ser destruída de acordo com as normas e métodos que a Parte Recetora seria obrigada
a aplicar à sua Informação Classificada no grau de classificação de segurança correspondente. A Parte
Originadora pode especificar, por meio de uma marcação ou outras instruções de manuseamento, que
a Informação Classificada em formato não eletrónico deve ser devolvida à Parte Originadora quando já
não for necessária. Essa informação deve ser devolvida utilizando os mesmos métodos estabelecidos
no artigo 8.º do presente Acordo.
Artigo 11.º
Contratos Classificados
1 — Se uma Parte pretender celebrar um Contrato Classificado envolvendo Informação Classificada
nos graus MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET ou CONFIDENCIAL com um Con-
tratante sob jurisdição da outra Parte, a ANS ou a ASC da Parte que pretende celebrar o contrato deve
primeiramente obter a confirmação, por escrito, da ANS ou da ASC da outra Parte, em conformidade
com o artigo 12.º do presente Acordo, de que o Contratante e o seu pessoal relevante obtiveram uma
Credenciação de Segurança Industrial ou Credenciação de Segurança Pessoal, conforme aplicável, pelo
menos no grau de classificação de segurança adequado.
2 — Salvo acordo mútuo entre as Partes, e sem prejuízo do disposto no n.º 3 do presente artigo,
uma Parte que celebre ou proponha celebrar um Contrato Classificado envolvendo Informação Clas-
sificada nos graus MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET ou CONFIDENCIAL deve
assegurar que o Contratante é legalmente obrigado a conferir à Informação Classificada da outra Parte
o mesmo grau de proteção como que se fosse a Parte Recetora.
3 — A Parte deve assegurar que o Contrato Classificado adjudicado a um Contratante sob a juris-

dição da outra Parte inclua as seguintes disposições:
a) A referência ao presente Acordo, a definição do termo «Informação Classificada» estabelecida
no artigo 1.º do presente Acordo e a tabela das correspondências dos graus de classificação de segu-
rança das Partes, tal como estabelecido no artigo 4.º do presente Acordo;

b) Que a Informação Classificada gerada e/ou fornecida em consequência do Contrato Classifi-
cado deve ser protegida pelo Contratante de acordo com as leis e regulamentos nacionais aplicáveis;
c) Que o Contratante deve fornecer Informação Classificada apenas a indivíduos, de acordo com
os requisitos do artigo 6.º do presente Acordo, encarregados do desempenho de quaisquer tarefas ou
funções relacionadas com o Contrato Classificado;
d) Que a Informação Classificada relacionada com o Contrato Classificado deve ser utilizada
exclusivamente para o fim para o qual foi fornecida, ou conforme autorizado expressamente, por escrito,
pela Parte Originadora;
e) Que se o Contratante receber qualquer pedido para divulgar qualquer Informação Classificada
fornecida como resultado do Contrato Classificado a um Terceiro, ou um pedido para disponibilizar tal
informação ao público, o Contratante deve notificar imediatamente a respetiva ANS ou ASC por escrito;
f) Que, salvo se exigido pelas leis e regulamentos nacionais aplicáveis, o Contratante não pode
divulgar nem permitir a divulgação de Informação Classificada relacionada com o Contrato Classificado
a Terceiro, nem a disponibilizar ao público sem a aprovação prévia, por escrito, da Parte Originadora;
g) Os canais a serem utilizados para o fornecimento ou transmissão de Informação Classificada,
que devem estar em conformidade com os artigos 8.º e 9.º do presente Acordo;
h) Os procedimentos para a tradução, reprodução e destruição de Informação Classificada, que
devem estar em conformidade com o artigo 10.º do presente Acordo;
i) Que, no caso de Informação Classificada apenas nos graus MUITO SECRETO, UK TOP SECRET,
SECRETO, UK SECRET ou CONFIDENCIAL, o Contratante deve tratar essa informação apenas em ins-
talações que possuam uma Credenciação de Segurança Industrial com um grau de classificação de
segurança adequado;
j) Os detalhes dos procedimentos para a aprovação de visitas pelo Contratante a uma instalação
sob a jurisdição da outra Parte, que devem estar em conformidade com o artigo 13.º do presente Acordo;
k) O requisito de que o Contratante deve notificar a ANS ou a ASC na sua jurisdição sobre qualquer
ocorrência ou suspeita de Incidente de Segurança relacionado com o Contrato Classificado e tomar
todas as medidas razoáveis para ajudar a mitigar os efeitos;
l) Os detalhes dos procedimentos e mecanismos para comunicar alterações que possam surgir
em relação à Informação Classificada, incluindo alterações no seu grau de classificação de segurança,
ou quando a proteção já não for necessária;
m) Que caso um Contratante subcontrate a totalidade ou parte do contrato que envolva acesso
a Informação Classificada fornecida ou gerada ao abrigo do presente Acordo esse Contratante deve
incluir no subcontrato as mesmas disposições que aqui estabelecidas; e
n) Que caso o Contratante decida subcontratar a totalidade ou parte do Contrato Classificado fora
da jurisdição de qualquer das Partes deve obter a aprovação prévia, por escrito, da Parte Originadora.
4 — Os Contratos Classificados devem ser apoiados por Instruções de Segurança do Programa/
Projeto ou por um Guia de Aspetos de Segurança, conforme apropriado, que estabeleça os requisitos
de segurança e/ou os aspetos classificados do contrato.

5 — A ANS ou ASC deve ser notificada pela outra Parte quando um Contrato Classificado tiver
sido adjudicado a um Contratante sob a sua jurisdição, de acordo com o presente artigo, e fornecida
uma cópia das Instruções de Segurança do Programa/Projeto ou do Guia dos Aspetos de Segurança.

Artigo 12.º
Cooperação em Matéria de Segurança
1 — A ANS e as ASC da Parte devem, quando necessário e de acordo com as respetivas leis e regu-
lamentos nacionais, prestar assistência e cooperação à ANS ou às ASC da outra Parte no processo de
emissão de Credenciação de Segurança Industrial e de Credenciação de Segurança Pessoal.
2 — Quando uma Parte, em nome próprio ou de um Contratante, solicitar confirmação de uma
Credenciação de Segurança Industrial vigente relativa a uma instalação de um Contratante sob a juris-
dição da outra Parte, a respetiva ANS ou ASC deve apresentar um pedido formal, por escrito, à ANS ou
à ASC relevante da outra Parte. Esse pedido deve conter a seguinte informação:
a) Nome do Contratante;
b) Endereço do Contratante;
c) Se relevante, os detalhes de identificação das instalações do Contratante;
d) Motivo do pedido e o grau de Credenciação de Segurança Industrial exigido; e
e) Detalhes de contacto da ANS ou ASC requerente.
3 — Quando uma Parte, em nome próprio ou de um Contratante, solicitar a confirmação da Cre-
denciação de Segurança Pessoal vigente de um indivíduo, no pressuposto de ter sido concedida pela
outra Parte, a ANS ou ASC da Parte que solicita a confirmação deve submeter um pedido formal, por
escrito, à ANS ou ASC relevante da outra Parte. Esse pedido deve conter a seguinte informação:
a) Nome completo do indivíduo;
b) Data e local de nascimento do indivíduo;
c) Nacionalidade ou nacionalidades do indivíduo;
d) Nome da organização ou do Contratante que emprega o indivíduo;
e) Motivo do pedido e grau da Credenciação de Segurança Pessoal exigido; e
f) Detalhes de contacto da ANS ou ASC requerente.
4 — O mesmo processo descrito nos n.os 2 e 3 do presente artigo deve ser seguido quando uma
Parte pretender solicitar a emissão de Credenciação de Segurança Industrial ou de Credenciação de
Segurança Pessoal à outra Parte.
5 — Após a receção de um pedido apresentado em conformidade com os n.os 2, 3 ou 4 do presente
artigo, a ANS ou a ASC que receber o pedido deve fornecer à ANS ou à ASC requerente os dados relativos
a qualquer Credenciação de Segurança Industrial ou Credenciação de Segurança Pessoal relevante,
a data de validade da Credenciação de Segurança Industrial ou Credenciação de Segurança Pessoal
e o grau de classificação de segurança da Informação Classificada a que a respetiva credenciação
permite aceder.
6 — A ANS ou ASC de uma Parte pode, mediante apresentação de uma razão válida, solicitar à ANS
ou à ASC da outra Parte que proceda a uma revisão de qualquer Credenciação de Segurança Industrial
ou Credenciação de Segurança Pessoal que tenha emitida. A ANS ou ASC que proceder à revisão deve
notificar a ANS ou ASC requerente dos resultados.

7 — Se uma ANS ou ASC retirar ou baixar uma Credenciação de Segurança Industrial ou Creden-
ciação de Segurança Pessoal emitida a um Contratante ou indivíduo para o qual tenha sido fornecida
uma confirmação, deve notificar imediatamente a ANS ou ASC da outra Parte.

Artigo 13.º
Visitas Internacionais
1 — Se um funcionário governamental de uma Parte tiver de visitar uma instalação governamen-
tal sob a jurisdição da outra Parte e essa visita envolver ou puder envolver o acesso a Informação
Classificada nos graus MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET ou CONFIDENCIAL,
o visitante deve assegurar que os detalhes da sua autorização para aceder a Informação Classificada
são fornecidos ao anfitrião antes da visita.
2 — Se um funcionário governamental de uma Parte tiver de visitar uma instalação de um Con-
tratante ao qual tenha sido emitido uma Credenciação de Segurança Industrial pela outra Parte, e essa
visita envolver ou puder envolver o acesso a Informação Classificada nos graus MUITO SECRETO, UK
TOP SECRET, SECRETO, UK SECRET ou CONFIDENCIAL, aplica-se o procedimento estabelecido:
a) Um pedido de visita deve ser submetido pela ANS ou ASC do visitante proposto à ANS ou ASC
relevante da instalação anfitriã, pelo menos 20 dias úteis antes da visita proposta, ou conforme acor-
dado entre as ANS ou ASC. O pedido deve incluir, pelo menos, a seguinte informação:
i) Nome completo do visitante, data de nascimento (no formato dia/mês/ano), local de nascimento,
nacionalidade ou nacionalidades e número do passaporte (ou de outro documento de identificação
relevante);
ii) Cargo oficial do visitante, nome da organização que o visitante representa e, se aplicável, uma
descrição do Contrato Classificado em que participa e que seja objeto da visita;
iii) Data e duração da visita ou visitas solicitadas e, no caso de visitas recorrentes, o período total
abrangido pelas visitas deve ser indicado, em conformidade com a alínea 2. c) do presente artigo;
iv) Motivo da(s) visita(s) e assunto(s) a ser(em) discutido(s);
v) Nome, endereço, número de telefone e endereço de correio eletrónico do ponto de contacto da
instalação a visitar;
vi) O grau de classificação de segurança previsto da Informação Classificada a ser discutida ou
acedida;
vii) Confirmação do grau e data de validade da Credenciação de Segurança Pessoal do visitante
ou uma declaração confirmando a autorização da pessoa para aceder a Informação Classificada, se
a exceção prevista no n.º 3 do artigo 6.º do presente Acordo se aplicar; e
viii) Assinatura datada de um representante da ANS ou ASC do visitante. O representante não pode
ser a mesma pessoa que o visitante;
b) As visitas só podem ter lugar quando o pedido de visita tiver sido autorizado pela ANS ou pela
ASC relevante da instalação anfitriã;
c) Para contratos classificados específicos, pode ser possível, sujeito à aprovação prévia das
ANS ou ASC relevantes de ambas as Partes, estabelecer uma lista de visitantes recorrentes. Essa lista
permite que os indivíduos visitem uma instalação específica mais de uma vez sem necessidade de
autorização escrita adicional. Essa lista deve ser válida por um período não superior a 12 meses e pode
ser prorrogada por períodos adicionais, mediante aprovação mútua das ANS ou ASC relevantes. As lis-
tas de visitantes recorrentes devem ser submetidas e autorizadas de acordo com as alíneas a) e b) do
presente número. Uma vez autorizada essa lista, os preparativos de visita podem ser determinados
diretamente entre o visitante e a instalação anfitriã, sem o envolvimento adicional das ANS ou ASC;

d) As ANS ou ASC de ambas as Partes podem determinar e acordar mutuamente que procedimen-
tos de visita alternativos aos descritos nas alíneas a), b) e c) do presente número podem ser adotados
para Contratos Classificados específicos. Quaisquer procedimentos de visita alternativos devem ser
acordados, por escrito, pelas ANS ou ASC de ambas as Partes.

3 — As visitas relacionadas exclusivamente com o acesso a Informação Classificada nos graus
RESERVADO ou UK OFFICIAL-SENSITIVE devem ser organizadas diretamente entre o visitante e a ins-
talação anfitriã a ser visitada, sem o envolvimento das ANS ou ASC.
Artigo 14.º
Ações em Caso de Incidente de Segurança
1 — Qualquer ocorrência ou suspeita de Incidente de Segurança na jurisdição de uma Parte, ou
numa instalação no território de uma Parte, incluindo na missão diplomática dessa Parte, deve ser
imediatamente investigada por essa Parte.
2 — Se o Incidente de Segurança for confirmado pela Parte Recetora, esta deve tomar as medi-
das adequadas, de acordo com as respetivas leis e regulamentos nacionais aplicáveis, para limitar as
consequências do incidente e evitar a sua repetição.
3 — Se o Incidente de Segurança for confirmado pela Parte Recetora e se for considerado que
a Informação Classificada foi perdida ou comprometida, esta deve informar a Parte Originadora assim
que possível.
4 — A Parte Recetora deve encaminhar à Parte Originadora as conclusões de qualquer investigação
que tenha resultado da ocorrência ou suspeita de perda ou comprometimento de Informação Classificada.
Artigo 15.º
Custos
Cada Parte deve suportar os seus próprios custos incorridos no cumprimento das suas obrigações
nos termos do presente Acordo.
Artigo 16.º
Resolução de litígios
Qualquer litígio ou discordância relativa à interpretação ou aplicação do presente Acordo deve ser
resolvido por negociação entre as Partes, através dos canais diplomáticos.
Artigo 17.º
Disposições finais
1 — Cada Parte deve notificar a outra Parte, através dos canais diplomáticos, assim que as medidas
nacionais necessárias para a entrada em vigor do presente Acordo tiverem sido concluídas. O presente
Acordo deve entrar em vigor no primeiro dia do segundo mês seguinte à receção da última notificação.
2 — O presente Acordo pode ser alterado a qualquer momento, mediante consentimento mútuo,
por escrito, de ambas as Partes. As alterações acordadas devem entrar em vigor em conformidade
com o n.º 1 do presente artigo.
3 — As ANS ou ASC de ambas as Partes podem concluir instrumentos de execução suplementares
ao abrigo do presente Acordo. Esses instrumentos estão subordinados ao presente Acordo.
4 — O presente Acordo deve manter-se em vigor até notificação em contrário. Uma Parte pode
denunciar o presente Acordo mediante notificação, por escrito, entregue à outra Parte através de
Decreto n.º 3/2026
canais diplomáticos, produzindo a denúncia efeitos seis meses após a receção dessa notificação. Se
o presente Acordo for denunciado, qualquer Informação Classificada já gerada e/ou fornecida ao abrigo
do presente Acordo deve ser protegida pela Parte Recetora em conformidade com o presente Acordo
enquanto permanecer classificada, salvo acordo em contrário da Parte Originadora.

Agreement Between the Portuguese Republic and the United Kingdom of Great Britain
and Northern Ireland on the Protection of Classified Information
The Portuguese Republic and the United Kingdom of Great Britain and Northern Ireland (“the United
Kingdom”), hereinafter referred to jointly as “Parties” or individually as a “Party”;
Recognising the important role of their joint cooperation in ensuring peace, international security,
and mutual confidence;
Wishing to create a set of rules on the mutual protection of classified information exchanged
between the Parties, their individuals, or legal entities, under cooperation conventions, arrangements
or contracts concluded or to be concluded;
Considering that they share equivalent security standards for the protection of classified information:
Have agreed on the following:
Article 1
Definitions
In this Agreement:
a) “Classified Information” means any information of whatever form, nature or method of trans-
mission, that is assigned a security classification level by a Party and which requires protection against
unauthorised disclosure, access, or destruction in the interest of national security and in accordance
with its national laws and regulations;
b) “Classified Contract” means a legally binding instrument that requires a Contractor to access
the Classified Information of a Party to provide goods or services. This term includes a sub-contract
or a pre-contractual activity;
c) “Competent Security Authorities” (CSAs) means governmental organisations, which are designa-
ted by each Party as the authorities responsible, within their respective competence under their national
laws and regulations, for the handling of the Classified Information;
d) “Contractor” means an individual or a legal entity that has the legal capacity to enter into a Clas-
sified Contract. This term includes a sub-contractor;
e) “Facility Security Clearance” (FSC) means a determination by a Party, issued by its relevant NSA
or CSA, that a Contractor meets the security requirements to handle Classified Information to a particular

security classification level in accordance with its national laws and regulations;
f) “National Security Authority” (NSA) means the Government authority of a Party with ultimate
responsibility for the security of Classified Information in accordance with the provisions of this Agree-
ment and the national laws and regulations that apply;

g) “Need-To-Know” means that access to Classified Information is limited to authorised individuals
who need to have access to Classified Information in order to perform their official duties;
h) “Originating Party” means a Party which provides Classified Information to the receiving Party
under this Agreement;
i) “Personnel Security Clearance” (PSC) means a determination by a Party, issued by its relevant
NSA or CSA, that an individual is eligible to access Classified Information to a particular security clas-
sification level in accordance with its national laws and regulations;
j) “Programme/Project Security Instruction” means a compilation of security requirements and
procedures in accordance with national laws and regulations to be applied to a specific programme or
project in order to standardise the protection of its Classified Information;
k) “Receiving Party” means the Party which receives Classified Information provided by the Ori-
ginating Party;
l) “Security Aspects Letter” (SAL) means a document associated with a Classified Contract that
identifies each part of that contract which contains Classified Information;
m) “Security Incident” means an act or omission which results in the unauthorised processing, loss
or compromise of Classified Information which has been provided or generated under this Agreement; and
n) “Third Party” means any individual, legal entity, State or an international organisation, who is
not a Party or a Contractor of a Party.
Article 2
Purpose
1 — This Agreement sets out the rules for the protection of Classified Information that is provided
or disclosed by one Party to the other Party, or by one Party to a Contractor from the other Party, or by
a Contractor from one Party to a Contractor from the other Party, in accordance with the respective
national laws and regulations of the Parties.
2 — Nothing in this Agreement shall be interpreted as binding a Party in respect to how it handles
and protects its own Classified Information.
3 — Nothing in this Agreement shall be interpreted as compelling the exchange of Classified Infor-
mation between the Parties.
Article 3
National Security Authorities
1 — The Parties designate the following entities as their respective NSAs:
a) For the Portuguese Republic:
Autoridade Nacional de Segurança;
b) For the United Kingdom:
UK National Security Authority;
Cabinet Office.

2 — The Parties shall notify each other, through diplomatic channels, of any change regarding to
the designation of the NSAs.
3 — The NSAs shall provide each other the official contact details and shall inform each other of
any subsequent changes.

Article 4
Security Classification Levels
1 — The Originating Party shall assign a security classification level to Classified Information and
shall mark it according to its national laws and regulations.
2 — The table below identifies the corresponding markings used by the respective Parties for their
security classification levels of Classified Information:

3 — Unless otherwise mutually agreed between the Parties in writing, the United Kingdom shall
afford Portuguese Classified Information at CONFIDENCIAL the same degree of protection as Classified
Information at UK SECRET.
4 — The Receiving Party may apply an additional marking or suitable handling instruction to
Classified Information that is provided by the Originating Party, indicating the corresponding security
classification level.
Article 5
Protection and Use of Classified Information
1 — The Parties shall protect and use Classified Information provided under this Agreement as
follows:
a) The Receiving Party shall afford Classified Information the same degree of protection as it
provides its own Classified Information at the corresponding security classification level as set out in
article 4 of this Agreement;
b) The Receiving Party shall use Classified Information only for the purpose for which it is provided,
unless the Originating Party gives prior consent in writing to do otherwise. To achieve this aim:
i) The Originating Party may specify, in writing, conditions of release or limitations on its use;
ii) The Receiving Party shall not downgrade the security classification level of Classified Information
or declassify it without the prior consent, in writing, of the Originating Party;
iii) The Originating Party shall inform the Receiving Party of any change in the security classification
level of Classified Information it has provided;
iv) The Receiving Party shall take all appropriate measures to prevent a Security Incident involving
Classified Information; and
v) Subject to article 7 of this Agreement, and applicable national laws and regulations, not disclose
such Classified Information to a Third Party or make such Classified Information available to the public

without the prior written approval of the Originating Party.
2 — The Parties may mutually agree, in writing, additional security requirements for the protection
of Classified Information.

3 — Subject to paragraph 1 of this article, the Receiving Party is permitted to share Classified
Information internally with other Government organisations of that Party, provided that the recipient has
a Need-To-Know and can afford it the appropriate degree of protection as set out in this Agreement.
4 — In order to achieve and maintain comparable standards of security, each NSA shall, on request,
provide the other with appropriate information about its national security policies, standards, procedu-
res and practices for safeguarding Classified Information, and may for this purpose facilitate visits by
representatives of the other Party as appropriate.
5 — Each NSA shall notify the other about any change to their national laws and regulations which
substantially affects the degree of protection of Classified Information provided under this Agreement.
Article 6
Access to Classified Information
1 — Access to Classified Information shall be limited to individuals who have a Need-To-Know
and who have been appropriately briefed on their responsibilities and obligations to protect Classified
Information.
2 — Access to Classified Information at the MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET
or CONFIDENCIAL levels shall be limited to individuals who have been granted an appropriate PSC.
3 — As an exception to paragraph 2 of this article, certain individuals may be allowed access to
Classified Information by virtue of their function if permitted under their respective national laws and
regulations. Each NSA shall notify the other NSA in writing of the categories of individuals to whom this
applies once the Agreement enters into force.
4 — Where the Originating Party, for reasons of national security, requires access to Classified
Information at the MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET or CONFIDENCIAL level to
be limited on the basis of nationality, it shall be marked with an additional “PRT/UK EYES ONLY” caveat.
Classified Information with this caveat shall be limited to those individuals holding the sole nationality
of one or of both Parties.
5 — A PSC is not required for access to Classified Information at the RESERVADO and UK
OFFICIAL-SENSITIVE level. As a minimum, individuals having such access shall have been subject to
recruitment checks which, if permissible under their respective national laws and regulations, should:
establish identity; verify nationality and immigration status; verify employment record and check cri-
minal records.
Article 7
Disclosure of Classified Information
1 — Within the scope of its national laws and regulations the Receiving Party shall take all reaso-
nable steps available to prevent Classified Information of the Originating Party being made available
to the public or being disclosed to a Third Party without the Originating Party’s prior written approval.
2 — If there is any request or obligation to make any Classified Information of the Originating
Party available to the public or to a Third Party, the NSA of the Receiving Party shall immediately notify
the NSA of the Originating Party in writing, and both Parties shall consult each other in writing before
a disclosure decision is taken by the Receiving Party.
Article 8

Classified Information provided in non-electronic form
1 — If a Party wishes to provide Classified Information at the MUITO SECRETO or UK TOP SECRET
level in non-electronic form it shall make arrangements for the Classified Information to be provided to
the Receiving Party or Contractor through diplomatic or military channels.

2 — If a Party wishes to provide Classified Information at the SECRETO, UK SECRET or CONFI-
DENCIAL levels in non-electronic form it shall make arrangements for the Classified Information to
be provided to the recipient through diplomatic channels, military channels, or by authorised personal
hand carriage. Other methods of providing the Classified Information may be used if agreed in writing
by the NSAs or relevant CSAs of both Parties.
3 — If a Party wishes to transport Classified Information at the MUITO SECRETO, UK TOP SECRET,
SECRETO, UK SECRET or CONFIDENCIAL levels as freight it shall set out the means of transport, the
route and any escort requirements in a transportation plan. This transportation plan shall be mutually
agreed in writing by the NSAs or relevant CSAs of both Parties before the transport takes place.
4 — If a Party wishes to provide Classified Information at the RESERVADO or UK OFFICIAL-SENSITIVE
level in non-electronic form it can be provided to the recipient by using postal services, by commercial
courier companies, by authorised personal hand carriage or through diplomatic channels. Classified
Information at the RESERVADO or UK OFFICIAL-SENSITIVE level may also be transported as freight
provided it is appropriately protected, but a transportation plan is not required.
5 — CSAs of the respective Parties may mutually agree, in writing, the use of alternative methods
to exchange Classified Information to those required by this article.
6 — In the event that Classified Information falling under this article is converted into an electronic
format, the requirements of article 9 shall apply.
Article 9
Classified Information transmitted in electronic form
1 — Classified Information received by the Parties in electronic form shall be processed only using
communications and information systems assured by the Receiving Party to at least the corresponding
security classification level.
2 — If a Party wishes to transmit Classified Information to the other Party it shall encrypt it using
cryptographic methods and means agreed by both the Parties.
3 — As an exception to paragraph 2 of this article, if a Party wishes to transmit Classified Infor-
mation marked UK OFFICIAL-SENSITIVE to the other Party it may do so in clear text provided suitable
cryptographic methods and means are not available, and if agreed in advance by the Originating Party.
4 — In the event that Classified Information falling under this article is converted into a non-electronic
format, the requirements of article 8 shall apply.
Article 10
Translation, reproduction and destruction of Classified Information
1 — Unless otherwise prohibited by the Originating Party, by way of an appropriate marking, writ-
ten notice or handling instructions, the Receiving Party may translate, reproduce or destroy Classified
Information in accordance with paragraphs 2, 3 and 4 of this article.
2 — Translations and reproductions of Classified Information shall retain the security classification
level applied to the original and shall be protected in accordance with this Agreement. Such translations
and reproductions shall be limited to the minimum required for an official purpose, and shall be made only
by individuals who have access to Classified Information in accordance with article 6 of this Agreement.
3 — Translations shall be marked with a suitable annotation, in the language into which they have

been translated, indicating that they contain Classified Information of the Originating Party.
4 — When no longer required, Classified Information that is protected under this Agreement shall be
destroyed in accordance with the standards and methods which the Receiving Party would be required
to apply to its Classified Information at the corresponding security classification level. The Originating

Party may specify, by means of a marking or other handling instructions, that non-electronic Classi-
fied Information shall be returned to the Originator when no longer required. Such information shall be
returned using the same methods as set out in article 8 of this Agreement.
Article 11
Classified Contracts
1 — If a Party intends to enter into a Classified Contract involving Classified Information at the
MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET or CONFIDENCIAL levels with a Contractor in
the jurisdiction of the other Party, the NSA or CSA of the Party intending to enter into the contract shall
first obtain written confirmation from the NSA or CSA of the other Party, in accordance with article 12
of this Agreement, that the Contractor and its relevant personnel have been granted a FSC or PSC, as
applicable, to at least the appropriate security classification level.
2 — Unless mutually agreed between the Parties, and subject to paragraph 3 of this article, a Party
entering or proposing to enter into a Classified Contract involving Classified Information at the MUITO
SECRETO, UK TOP SECRET, SECRETO, UK SECRET or CONFIDENCIAL levels shall ensure that the Con-
tractor is legally obliged to afford the other Party’s Classified Information the same degree of protection
as if it were the Receiving Party.
3 — A Party shall ensure that a Classified Contract awarded to a Contractor under the jurisdiction
of the other Party includes the following provisions:
a) A reference to this Agreement, the definition of the term “Classified Information” set out in
article 1 of this Agreement, and the table of corresponding security classification levels of the Parties
as set out in article 4 of this Agreement;
b) That Classified Information generated and/or provided as a consequence of the Classified Con-
tract shall be protected by the Contractor in accordance with its applicable national laws and regulations;
c) That the Contractor shall provide Classified Information only to individuals in accordance with
the requirements of article 6 of this Agreement and charged with the performance of any tasks or duties
in relation to the Classified Contract;
d) That Classified Information relating to the Classified Contract is to be used solely for the purpose
for which it has been provided, or as further expressly authorised in writing by the Originating Party;
e) That, if the Contractor receives any request to disclose any Classified Information provided as
a result of the Classified Contract to a Third Party, or a request to make such information available to
the public, the Contractor shall immediately notify their NSA or CSA in writing;
f) That, unless required by applicable national laws and regulations, the Contractor shall not disclose,
or permit the disclosure of, Classified Information relating to the Classified Contract to a Third Party or
make it available to the public without the prior written approval of the Originating Party;
g) The channels to be used for the provision or transmission of Classified Information, which shall
be in accordance with article 8 and 9 of this Agreement;
h) The procedures for the translation, reproduction and destruction of Classified Information, which
shall be in accordance with article 10 of this Agreement;
i) That for Classified Information at the MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET or
Decreto n.º 3/2026
CONFIDENCIAL levels only, the Contractor shall handle this information only in a facility that has a FSC
at an appropriate security classification level;
j) The details of the procedures for the approval of visits by the Contractor to a facility under the
jurisdiction of the other Party, which shall be in accordance with article 13 of this Agreement;

k) A requirement that the Contractor shall notify the NSA or CSA in its jurisdiction of any actual
or suspected Security Incident relating to the Classified Contract and take all reasonable measures to
assist in mitigating the effects;
l) The details of the procedures and mechanisms for communicating changes that may arise in
respect of the Classified Information, including changes in its security classification level, or where
protection is no longer necessary;
m) That should a Contractor sub-contract all or part of the contract involving access to Classified
Information provided or generated under this Agreement, that Contractor shall include the same provi-
sions as set out here in the sub-contract; and
n) That should the Contractor decide to sub-contract all or part of the Classified Contract outside
the jurisdiction of either Party, that the prior written approval of the Originating Party shall be obtained.
4 — Classified Contracts shall be supported by a Programme/Project Security Instructions, or
a SAL as appropriate, which sets out the security requirements and/or classified aspects of the contract.
5 — The NSA or CSA shall be notified by the other Party when a Contractor under its jurisdiction
has been awarded a Classified Contract in accordance with this article, and provided a copy of the
Programme/Project Security Instructions or the SAL.
Article 12
Security co-operation
1 — The NSA and CSAs of the Party shall, where necessary and in accordance with their national
laws and regulations, provide assistance and cooperation to the NSA or CSAs of the other Party in the
process of issuing FSCs and PSCs.
2 — When a Party, whether on behalf of itself or a Contractor, requires confirmation of an existing
FSC relating to a facility of a Contractor under the jurisdiction of the other Party, its NSA or CSA shall
submit a formal written request to the NSA or relevant CSA of the other Party. That request shall contain
the following information:
a) Name of the Contractor;
b) Address of the Contractor;
c) If relevant, the identifying details of the Contractor facility;
d) Reason for the request and the FSC level required; and
e) Contact details of the requesting NSA or CSA.
3 — When a Party, whether on behalf of itself or a Contractor, requires confirmation of an indivi-
dual’s existing PSC, understood to have been granted by the other Party, the NSA or CSA of the Party
requiring confirmation shall submit a formal written request to the NSA or relevant CSA of the other
Party. That request shall contain the following information:
a) Full name of the individual;
b) Date and place of birth of the individual;
c) Nationality or nationalities of the individual;

d) Name of the organisation or Contractor which employs the individual;
e) Reason for the request and the PSC level required; and
f) Contact details of the requesting NSA or CSA.

4 — The same process as described in paragraphs 2 and 3 of this article shall be followed when
a Party wishes to request the issuing of a FSC or PSC from the other Party.
5 — On receipt of a request submitted in accordance with paragraphs 2, 3 or 4 of this article, the
NSA or CSA receiving the request shall provide the requesting NSA or CSA with details of any relevant
FSC or PSC, the date of expiry of the FSC or PSC, and the security classification level of the Classified
Information to which the respective clearance permits access.
6 — A NSA or CSA of a Party may, on providing a valid reason, request the NSA or a CSA of the
other Party to undertake a review of any FSC or PSC it has issued. The NSA or CSA which undertakes
the review shall notify the requesting NSA or CSA of the results.
7 — If a NSA or CSA withdraws or downgrades a FSC or PSC issued to a Contractor or individual
for which or for whom a confirmation has been provided they shall immediately notify the NSA or CSA
of the other Party.
Article 13
International Visits
1 — If a Government official of a Party is required to visit a Government facility under the jurisdic-
tion of the other Party, and this visit will or may involve access to Classified Information at the MUITO
SECRETO, UK TOP SECRET, SECRETO, UK SECRET or CONFIDENCIAL levels, the visitor shall ensure that
details of their authorisation to access Classified Information are provided to the host prior to the visit.
2 — If a Government official of a Party is required to visit a facility of a Contractor which has been
issued a FSC by the other Party, and this visit will or may involve access to Classified Information at
the MUITO SECRETO, UK TOP SECRET, SECRETO, UK SECRET or CONFIDENCIAL levels, the procedure
set out applies:
a) A request for visit shall be submitted by the NSA or CSA of the proposed visitor to the NSA or
relevant CSA of the host facility at least 20 working days in advance of the proposed visit, or as otherwise
agreed between the NSAs or CSAs. The request shall include at least the following information:
i) Visitor’s full name, date of birth (in day/month/year format), place of birth, nationality or natio-
nalities, and passport (or other relevant identity document) number;
ii) Official job title of the visitor, the name of the organisation the visitor represents and, if applicable,
a description of the Classified Contract in which they are participating and which is the subject of the visit;
iii) Date and duration of the requested visit or visits and, in the case of recurring visits, the total
period covered by the visits shall be stated, in accordance with paragraph 2.c) of this article;
iv) Purpose of the visit(s) and subject(s) to be discussed;
v) Name, address, telephone number and e-mail address of the point of contact of the facility to
be visited;
vi) The anticipated security classification level of the Classified Information to be discussed or
accessed;
vii) Confirmation of the level and date of expiry of the visitor’s PSC or a statement confirming the
person’s authorisation to access Classified Information if the exception in paragraph 3 of article 6 of
this Agreement applies; and

viii) A dated signature of a representative of the visitor’s NSA or CSA. The representative shall not
be the same person as the visitor;
b) Visits shall only take place when the request for visit has been authorised by the NSA or relevant
CSA of the host facility;

c) For specific Classified Contracts, it may be possible, subject to the prior approval of the NSAs or
relevant CSAs of both Parties, to establish a recurring visitor list. Such a list allows individuals to visit
a specified facility more than once without further written authorisation. Such a list shall be valid for
a period not exceeding twelve months and may be extended for further periods of time subject to the
mutual approval of the NSAs or relevant CSAs. Recurring visitor lists shall be submitted and authori-
sed in accordance with paragraphs a. and b. of this paragraph. Once such a list has been authorised,
visit arrangements may be determined directly between the visitor and host facility without the further
involvement of the NSAs or CSAs;
d) The NSAs or CSAs of both Parties may mutually determine and agree that alternative visit pro-
cedures to those described in paragraphs a., b. and c. of this paragraph may be adopted for specific
Classified Contracts. Any alternative visit procedures shall be agreed by the NSAs or CSAs of both
Parties in writing.
3 — Visits relating solely to accessing Classified Information at the RESERVADO or UK OFFICIAL-SENSITIVE
level shall be arranged directly between the visitor and the host facility to be visited without the involvement
of the NSAs or CSAs.
Article 14
Actions in the event of a Security Incident
1 — Any actual or suspected Security Incident occurring in the jurisdiction of a Party, or at a facility
in the territory of a Party, including that Party’s diplomatic mission, shall be investigated immediately
by that Party.
2 — If a Security Incident is confirmed by the Receiving Party, it shall take appropriate measures
according to its applicable national laws and regulations to limit the consequences of the incident and
prevent a recurrence.
3 — If a Security Incident is confirmed by the Receiving Party, and Classified Information is assessed
to be lost or compromised, it shall inform the Originating Party as soon as is practicable.
4 — The receiving Party shall forward the outcome of any investigation that has resulted in the
actual or suspected loss or compromise of Classified Information to the Originating Party.
Article 15
Costs
Each Party shall bear its own costs incurred in the course of implementing its obligations under
this Agreement.
Article 16
Resolution of disputes
Any dispute or disagreement regarding the interpretation or application of this Agreement shall be
settled by negotiation between the Parties, through diplomatic channels.
Article 17
Final Provisions
1 — Each Party shall notify the other Party through diplomatic channels once the national measures

necessary for entry into force of this Agreement have been completed. This Agreement shall enter into
force on the first day of the second month following the receipt of the later notification.
2 — This Agreement may be amended with the mutual, written consent of both the Parties at any
time. Agreed amendments shall enter into force in accordance with paragraph 1 of this article.

3 — The NSAs or CSAs of both the Parties may conclude implementing arrangements pursuant to
this Agreement. These arrangements are subordinate to this Agreement.
4 — This Agreement shall remain in force until further notice. A Party may terminate this Agreement
by written notification delivered to the other Party through diplomatic channels, the termination taking
effect six months after such notification is received. If this Agreement is terminated, any Classified
Information already generated and/or provided under this Agreement shall be protected by the Receiving
Party in accordance with this Agreement for as long as it remains classified, unless otherwise agreed
by the Originating Party.

Portaria n.º 61/2026/1, de 6 de fevereiro
Sumário: Procede à primeira alteração da Portaria n.º 151/2013, de 16 de abril, que aprova os Estatu-
tos do Instituto dos Vinhos do Douro e do Porto, I. P., e revoga a Portaria n.º 219-I/2007, de
28 de fevereiro.
A orgânica do Instituto dos Vinhos do Douro e do Porto, I. P. (IVDP, I. P.), foi aprovada pelo Decreto-Lei
n.º 97/2012, de 23 de abril, e os respetivos Estatutos aprovados pela Portaria n.º 151/2013, de 16 de abril.
Considerando que nos termos do disposto no n.º 1 do artigo 1.º a organização interna é consti-
tuída por três unidades orgânicas de primeiro nível (Direção de Serviços Administrativos e Financeiros,
Direção de Serviços Técnicos e de Certificação e Direção de Serviços de Fiscalização) e que o n.º 3 do
referido artigo 1.º fixa em seis o número máximo de unidades orgânicas de segundo nível;
Considerando, também, que no âmbito da prossecução da missão do IVDP, I. P., constituída pelos
eixos da proteção e defesa, da regulação, da certificação, do controlo e fiscalização e da promoção das
denominações de origem Porto e Douro e indicação geográfica Duriense, as atribuições e as competên-
cias que cabem a este instituto, bem como o grau de exigência que implica a sua gestão administrativa
e financeira, a par da sua autonomia para se financiar, verifica-se a necessidade aumentar o número de
unidades orgânicas de segundo nível e, por conseguinte, proceder à primeira alteração aos Estatutos
do IVDP, I. P., aprovados em anexo à Portaria n.º 151/2013, de 16 de abril:

Ao abrigo do disposto nos n.os 4 e 5 do artigo 21.º da Lei n.º 4/2004, de 15 de janeiro, na sua
redação atual, manda o Governo, pelo Ministro de Estado e das Finanças e pelo Ministro da Agricultura
e Mar, o seguinte:
