SOBRE O RENDIMENTO E SOBRE O PATRIMÓNIO.
No momento da assinatura da Convenção entre a Repú-
blica Portuguesa e a Geórgia para evitar a dupla tributação
e prevenir a evasão fiscal em matéria de impostos sobre o
rendimento e sobre o património (a seguir designada por
«Convenção»), os signatários acordaram nas disposições
seguintes, que fazem parte integrante da Convenção:
1 — Direito aos benefícios da Convenção:
a) Entende-se que as disposições da Convenção não
serão interpretadas de modo a impedir a aplicação por um
Estado Contratante das disposições anti-abuso previstas na
sua legislação interna;
b) Entende-se que os benefícios previstos na Convenção
não serão concedidos a um residente de um Estado Contra-
tante que não seja o beneficiário efectivo dos rendimentos
obtidos no outro Estado Contratante;
c) Entende-se que as disposições da Convenção não

CONVENTION BETWEEN THE PORTUGUESE REPUBLIC AND
GEORGIA FOR THE AVOIDANCE OF DOUBLE TAXATION AND
THE PREVENTION OF FISCAL EVASION WITH RESPECT TO
TAXES ON INCOME AND ON CAPITAL.
The Portuguese Republic and Georgia, desiring to con-
clude a Convention for the Avoidance of Double Taxation
and the Prevention of Fiscal Evasion with respect to Taxes
on Income and on Capital, in order to promote and streng-

CHAPTER I
Scope of the Convention
Article 1

This Convention shall apply to persons who are resi-
dents of one or both of the Contracting States.
Article 2
Taxes covered
1 — This Convention shall apply to taxes on income
and on capital imposed on behalf of a Contracting State
or of its political or administrative subdivisions or local
authorities, irrespective of the manner in which they
are levied.
2 — There shall be regarded as taxes on income or
on capital all taxes imposed on total income, on total
capital, or on elements of income or of capital, including
taxes on gains from the alienation of movable or immov-
able property, taxes on the total amounts of wages or
salaries paid by enterprises, as well as taxes on capital
appreciation.
3 — The existing taxes to which this Convention shall
apply are in particular:
a) in the case of Portugal:
(i) the personal income tax (imposto sobre o rendimento

(ii) the corporate income tax (imposto sobre o rendi-
mento das pessoas colectivas — IRC); and
(iii) the surtaxes on corporate income (derramas);
(hereinafter referred to as «Portuguese tax»);
b) in the case of Georgia:
(i) the profit tax;
(ii) the income tax; and
(iii) the property tax;
(hereinafter referred to as «Georgian tax»).
4 — The Convention shall apply also to any identical
or substantially similar taxes that are imposed after the
date of signature of the Convention in addition to, or
in place of, the existing taxes. The competent authori-
ties of the Contracting States shall notify each other of
any significant changes that have been made in their
taxation laws.
